Der Verfasser kommentiert den Beschluss des BayObLG vom 12.11.1999, 1 Z BR 34/99. Das erkennende Gericht beschäftigte sich mit der Frage der Nachlassspaltung und Ermittlung der Eigentumsverhältnisses, wenn dem Nachlass einer vor dem 3.11.1990 verstorbenen Erlasserin das Miteigentum von Grundstücken in der ehemaligen DDR zugerechnet wird.
Der Verfasser hebt die Haftungsprivilegierung des $ 1359 BGb hervor, stellt aber vergleichend den Haftungsmaßstab gegenüber. Auch die Regelungen der $$ 421 ff BGB fließen mit ein in die Überlegungen bzgl. einer Gesamtschuldnerhaftung bei Ehegatten im Vergleich zu nichtehelichen Lebensgemeinschaften. Auch werden im Zuge der Eröterung nicht nur die Tierhaltung, als auch alle anderen Haftungstypen beleuchtet.
Der Beitrag befasst sich mit dem Urteil des BGH vom 26.1.2001, V ZR 452/99. Der Verfasser zeigt die Fortsetzung der Rechtsprechung für die sog. Nachverwertungsverbote auf. Er erläutert, warum die Nachverwertungsklauseln zu den stark umstrittenen Konstruktionen in Treuhandanstalt-Verträgen zählen, und zeigt auf, warum das Urteil des BGH dazu führt, einen Verstoß dieser Klauseln gegen $ 9 AGBG nicht mehr mit der einseitigen Eingreifen der Klauseln zu Lasten des Käufers in das Äquivalenzverhältnis des Bertrages begründet werde kann.

Der Verfasser befasst sich mit einem Urteil des OLG Dresden vom 19.12.2001, 8 U 2256/01, wo es um eine Klage eines Verbrauchers aus einer Gewinnzusage gemäß $ 661a BGB geht. Der Autor setzt sich zunächst mit der Qualifizierung des sich aus $ 661a BGB ergebenden Schuldverhältnisses auseinander. Im Folgenden beschäftigt er sich mit der internationalen Zuständigkeit bei einer Klage auf einen Anspruch aus $ 661a BGB. Weiter wird die Frage erörtert, welches Recht zur Anwendung kommt. Daran prüft er, ob $ 661a BGB zwingendes internationales Recht ist.
Nach herrschender Meinung kann ein Auftragnehmer fällige Anschlagszahlungen nach Beendigung des Vertragsverhältnisses nicht mehr gerichtlich durchsetzen. Der Unternehmer hat vielmehr nach Kündigung des Vertragsverhältnisses die Schlussrechnung zu erstellen und seine Forderungen auf diesem Wege weiterzuverfolgen. Die Verfasser setzen sich kritisch mit dieser herschenden Meinung auseinander, die ihres Erachtens den Unternehmer insbesondere dann unangemessen benachteiligt, wenn der Besteller das Vertragsverhältnis während eines auf Zahlung fälliger Abschgszahlungen gerichteten Prozesses kündigt.
Der Verfasser kommentiert das Urteil des BGH vom 13.9.2001, VII ZR 415/99. Danach ist derjenige, der die Beseitigung der Folgen aus einer nach widerrechtlicher Drohung eingegangenen Verpflichtung verlangen kann, grundsätzlich nicht dem Einwand des Mitverschuldens nach $ 254 Abs.1 BGB ausgesetzt. Weiterhin beschäftigt sich der Autor mit der Möglichkeit, neben der Anfechtung nach $ 123 BGB einen Schadensersatzanspruch auf Befreiung von der eingegangenen Verbindlichkeit nach den Grundsätzen der c.i.c. durchzusetzen. Schließlich geht er auf weitere Ansprüche des Klägers ein. Hier geht es in erster Linie um bereicherungsrechtliche Ansprüche.
