Zahlreiche Kommunen vor allem in westdeutschen Flächenländern weisen eine sehr starke Verschuldung auf, die mittlerweile die Erfüllung nicht nur ihrer freiwilligen, sondern auch ihrer pflichtigen Aufgaben erheblich beeinträchtigt (I.). Dies hat die Diskussion angestoßen, ob von Verfassung wegen ein Staatsziel der Gleichwertigkeit der Lebensverhältnisse besteht (II.) und sich daraus ein Recht oder gar eine Pflicht des Bundes zur finanziellen Entlastung dieser Kommunen ergibt. In diesem Zusammenhang sind nach geltender Verfassungslage direkte Leistungen des Bundes an die Kommunen (III.) von Zuweisungen des Bundes über die Länder an die Kommunen (IV.) sowie die Möglichkeiten des Bundes, die Länder zur Hilfeleistung an ihre Kommunen zu bewegen (V.), zu unterscheiden. Davon zu trennen ist die Frage, ob im Wege einer Grundgesetzänderung auch noch weitergehende finanzielle Hilfen des Bundes zur Entschuldung der Kommunen vorgesehen werden könnten (VI.). Schließlich werden die gefundenen Ergebnisse zusammengefasst (VII.).
Das Jahr 2019 markiert nicht nur 100 Jahre Weimarer Reichsverfassung, sondern zugleich 100 Jahre Staatskirchenrecht sowie 100 Jahre des nicht erfüllten Verfassungsauftrags der Ablösung der Staatsleistungen an die Kirchen gem. Art. WRV Artikel 138 Abs. WRV Artikel 138 Absatz 1 WRV (I.). Im Folgenden sollen der genaue Inhalt dieses Auftrags geklärt (II.) und die Rechtsfolgen seiner möglichen Umsetzung beleuchtet werden (III.). Zudem ist zu untersuchen, ob sich aus diesem Verfassungsauftrag ein Verbot neuer Staatsleistungen an die Kirchen und Religionsgesellschaften ergibt (IV.) und auf welche Weise dieser Auftrag ggf. verfassungsprozessual durchgesetzt werden kann (V.). Abschließend werden die Kernaussagen zusammengefasst (VI.).
Twinning stellt trotz jahrelanger Praxis für viele Beamte immer noch eine terra incognita dar. Im Folgenden werden zunächst der Begriff und die Bedeutung des Twinnings geklärt (I.), bevor geeignete Rechtsformen für den Einsatz als Kurz- oder Langzeitexperte (II.) sowie als Projektleiter erörtert werden (III.), wobei besondere Fragen entstehen, wenn twinnende Behörde und Entsendebehörde nicht identisch sind (IV.). Sodann werden die finanziellen Vorteile für den twinnenden Beamten (V.), sein Versicherungsschutz (VI.) sowie die pensionsrechtlichen Folgen (VII.) betrachtet. Eine Zusammenfassung rundet die Darstellung ab (VIII.).
Nach der vornehmlich auf bayerischen Druck hin erfolgten Öffnung des GG für eigene Landesgesetze im Bereich der Grundsteuer plant die Bayerische Staatsregierung, eine Grundsteuer als Flächensteuer einzuführen. Im vorliegenden Beitrag werden zunächst die bayerischen Pläne vorgestellt (1.), bevor eine in solcher Weise ausgestaltete Grundsteuer am GG (2.) und an der Bayerischen Landesverfassung (3.) gemessen wird. Schließlich werden die gefundenen Ergebnisse zusammengefasst (4.).
Addressing both scholars of international law and political science as well as decision makers involved in cybersecurity policy, the book tackles the most important and intricate legal issues that a state faces when considering a reaction to a malicious cyber operation conducted by an adversarial state. While often invoked in political debates and widely analysed in international legal scholarship, self-defence and countermeasures will often remain unavailable to states in situations of cyber emergency due to the pervasive problem of reliable and timely attribution of cyber operations to state actors. Analysing the legal questions surrounding attribution in detail, the book presents the necessity defence as an evidently available alternative. However, the shortcomings of the doctrine as based in customary international law that render it problematic as a remedy for states are examined in-depth. In light of this, the book concludes by outlining a special emergency regime for cyberspace.
The steadily rising number of investor-State arbitration proceedings within the EU has triggered an extensive backlash and an increased questioning of the international investment law regime by different Member States as well as the EU Commission. This has resulted in the EU's assertion of control over the intra-EU investment regime by promoting the termination of bilateral intra-EU investment treaties (intra-EU BITs) and by opposing the jurisdiction of arbitral tribunals in intra-EU investor-State arbitration proceedings. Against the backdrop of the landmark Achmea decision of the European Court of Justice, the book offers an in depth analysis of the interplay of international investment law and the law of the European Union with regard to intra-EU investments, i.e. investments undertaken by an investor from one EU Member State within the territory of another EU Member State. It specifically analyses the conflict between the two investment protection regimes applicable within the EU with a particular emphasis on the compatibility of the international legal instruments with the law of the European Union. The book thereby addresses the more general question of the relationship between EU law and international law and offers a conceptual framework of intra-European investment protection based on the analysis of all intra-EU BITs, the Energy Charter Treaty and EU law, as well as the arbitral practice in over 180 intra-EU investor-State arbitration proceedings. Finally, the book develops possible solutions to reconcile the international legal standards of protection with the regionalized transnational law of the European Union
Die Umdeutung von Verwaltungsakten gemäß § 47 VwVfG steht ungeachtet ihrer Examensrelevanz nicht im Zentrum der Aufmerksamkeit aller Studierender. Um auch vor dem Hintergrund jüngerer höchstrichterlicher Entscheidungen den Blick für dieses Rechtsinstitut zu schärfen, kennzeichnet der Verfasser zunächst das nicht ohne Weiteres aus dem Gesetz ablesbare Wesen der Umdeutung und grenzt diese von anderen Instrumenten zur Interpretation, Korrektur und Aufrechterhaltung von Verwaltungsakten ab. Sodann stellt er im Einzelnen die Voraussetzungen und Ausschlussgründe des § 47 VwVfG vor.
Currently a political debate is ongoing in Germany as to whether Germany should, following the example of several other European countries such as France and the Netherlands, adopt a Supply Chain Act (Lieferkettengesetz). If adopted, the act in question would impose due diligence obligations on German corporations to prevent human rights violations taking place in their respective global supply chains. It is against this background that the article examines the preconditions that must be met in order for such act to be eventually compatible with both, German constitutional and international law. The authors further deal with the question whether Germany might even be obliged under international, as well as under German constitutional law, to enact such a supply chain law in order to protect the human rights of workers employed by companies forming part of the global supply chains of German companies. As far as German constitutional law is concerned the article notably deals with the question whether it is the Federal parliament that may adopt such a law also taking into account the competencies of the European Union in the field, and what are the requirements of legal specificity and proportionality in order for the draft law to stand constitutional scrutiny. The authors further offer detailed suggestions how corporate due diligence standards might be best provided for in the envisaged law and propose a risk analysis approach that varies not only according to specific countries and sector-specific characteristics, but that by the same token also takes into account the ability of the respective German company to exercise an appropriate due diligence standard when it comes to human rigths issues arising within the framewok of their supply chain. As far as the substantive human rights standards are concerned that should serve as benchmarks for the envisaged Supply Chain Act the authors propose to rely on, and refer to, those instruments such as the ICCPR and the CESCR, as well as the ILO treaties containing core labour standards, that enjoy almost universal acceptance and reflect customary international law.
