Tiere
(2023)
The main reason for human dignity is our capacity for autonomy. By virtue of our gift of reason we can relativize our purposes in the interests of others and set limits for ourselves. This also gives rise to our duty to recognize and respect animals. From the recognition of every living being as an end in itself follows the duty to respect its intrinsic value. But since animals are not recognized de lege lata as legal subjects with their own rights and cannot adequately assert their interests, the right to rights based on their dignity remains only a moral one. Law that does not posit this right is immoral and therefore unjust.
There are several reasons why the question of the legal requirements for the killing of unneeded laboratory animals is currently being raised more frequently in research institutions. The starting point is the wording of the relevant regulations. In view of the public's increased awareness of animal experimentation, which is usually not based on expert knowledge, the lack of clarity in these regulations is leading to uncertainty in the handling of these regulations by the authorities, and in some cases even to the involvement of investigating authorities in order to clarify under criminal law whether and to what extent the legal requirements for the killing of laboratory animals have been observed in a specific case.
Klimaschutzklagen
(2023)
The Paris Agreement enshrines the triad of mitigation, adaptation and resilience. In this connection, climate protection lawsuits are increasingly being filed. The question for the courts is whether or not they are functionally overburdened in view of the dimension of climate change and transformation. They will have to find a path between non-functional activism and misplaced restraint. Adapted from the usual introductory question for civil law cases, «Who wants what out of what from whom?», an overview of the subjects of dispute will be provided. Subsequently, the challenges of the courts of lower instance and the Federal Constitutional Court with regard to the separation of powers and the principle of democracy are presented. Particular attention is paid to the climate decision of the Federal Constitutional Court of March 24th, 2021.
