Die Versammlungsfreiheit des Art. 8 GG stellt sich – auch und gerade in jüngster Zeit – immer wieder aufs Neue als ein höchst lebendiges und streitbares Grundrecht dar. Unverändert analog bietet es den Bürgerinnen und Bürgern räumlich die Möglichkeit, ihre Anliegen öffentlichkeits- und medienwirksam zur Sprache zu bringen. Der Klimaschutz und der Ukrainekrieg sind aktuell zwei zentrale Themenstellungen. Auch die Covid-19-Pandemie beschert den Rechtsanwendern neue und oftmals fundamentale Fragestellungen, auf die Antworten gegeben werden müssen. So sieht sich das Versammlungsrecht mit seinem Art. 8 GG als Basisnorm mit einer Vielzahl neuartiger Probleme konfrontiert. Zu Beginn standen der Pandemie vor allem die teilweise absoluten und flächendeckenden Versammlungsverbote im Streit. Seit kurzem sind Verbote von „Corona-Spaziergängen“ durch Allgemeinverfügungen in der Diskussion, und zwar für den Zeitraum einiger Wochen und begrenzt für das Gebiet einer Gemeinde oder eines Landkreises. Der nachfolgende Beitrag beschäftigt sich mit dieser Thematik.

Digitales Versammlungsrecht?

Das Grundrecht der Versammlungsfreiheit ist bekanntermaßen entwicklungsoffen. Geschützt werden also nicht nur historisch gewachsene „klassische“ Versammlungstypen. Immer wieder zeigen sich neuartige Erscheinungsformen, die es in den Schutzbereich des Art. GG Artikel 8 GG einzuordnen gilt. Aus jüngerer Zeit sind etwa Flashmobs oder Demonstrationen auf Schienen zur Fussnote 1 und mit Wohnmobilen zur Fussnote 2 zu nennen. Diskutiert werden auch Online-Versammlungen, bei denen die Teilnehmenden vollständig auf ein körperliches Zusammentreffen verzichten und sich nur virtuell via Computer oder Smartphone zusammenschalten. Angesichts absoluter und relativer Versammlungsverbote in coronabedingten Lockdowns zur Fussnote 3 steht mehr denn je die verfassungsrechtliche Dimension dieserart nichtphysischer Zusammentreffen im Streit. Der Beitrag befasst sich daher mit der Frage, ob die Versammlungsfreiheit des Art. GG Artikel 8 GG im digitalen Zeitalter auch eine virtuelle Seite hat.
