Tasks and Content of Landscape Management Planning and Landscape Implementation Planning - Requirements in terms of feasibility of re-checks Zusammenfassung Vor dem Hintergrund in Nachkontrollen vielfach festgestellter Abweichungen des Landschaftspflegerischen Ausführungsplans (LAP) von den Aussagen des Landschaftspflegerischen Begleitplans (LBP) werden Aufgabenverteilung und "Abschichtung" zwischen beiden Planwerken kritisch beleuchtet. Im Landschaftspflegerischen Ausführungsplan nachträglich vorgenommene Anpassungen von z.B. Zielen und räumlicher Lage von Ausgleichs- und Ersatzmaßnahmen können u.U. auch Auswirkungen auf die im LBP zu erstellende Bilanz der Beeinträchtigungen und Kompensationswirkungen und damit auf die Genehmigungsvoraussetzungen haben. Verschiedene Fallbeispiele belegen, dass immer dann, wenn Ausgleichs- und Ersatzmaßnahmen im Landschaftspflegerischen Begleitplan nicht hinreichend konkretisiert werden, der Bezug zu den Beeinträchtigungen schnell verloren geht. Durchgeführte Maßnahmen entsprechen dann zwar i.d.R. noch den Zielen von Naturschutz und Landschaftspflege im betroffenen Naturraum, aber häufig nicht mehr den rechtlichen Anforderungen der Eingriffsregelung. Nachkontrollen sind nur noch im Hinblick auf die korrekte Durchführung, nicht mehr jedoch auf die Funktionserfüllung der Maßnahmen möglich. Als Konsequenz aus den Ergebnissen wird der Vorschlag einer klaren Aufgabenteilung von Landschaftspflegerischem Begleit- und Ausführungsplan entwickelt. Er beinhaltet neben einer hinreichenden Zieldefinition für die Kompensation im Landschaftspflegerischen Begleitplan eine durchgängige Beibehaltung der Maßnahmenbezeichnungen in beiden Planwerken sowie eine gesonderte Darlegung im Landschaftspflegerischen Ausführungsplan vorgenommener Änderungen.
Zusammenfassung In der naturschutzrechtlichen Eingriffsregelung wird das Landschaftsbild gegenüber den Belangen des Naturhaushalts oft nachrangig behandelt, obwohl es von den Voraussetzungen des Bundesnaturschutzgesetzes her gleichermaßen in alle Schritte der Folgenbewältigung einzubeziehen ist. Für diese Schritte werden exemplarisch rechtliche Rahmenbedingungen und fachliche Anforderungen aufgezeigt. Ingesamt wird so eine strukturierte Herangehensweise deutlich, die über die einzelnen Arbeitsschritte der Erfassung des Ist-Zustandes, der Aufstellung eines Zielkonzeptes, der Ableitung von Vorkehrungen zur Vermeidung sowie der Begründung von Maßnahmen zur landschaftsgerechten Wiederherstellung und Neugestaltung des Landschaftsbildes hinweg durchgängig auf denselben Beschreibungsmerkmalen aufbaut und damit einen durchgängigen Ableitungszusammenhang von den ermittelten Beeinträchtigungen des Landschaftsbildes zu darauf Bezug nehmenden Maßnahmen begründet. Wesentlich ist, dass dabei die Charakteristik des jeweiligen Landschaftsraumes im Vordergrund steht und dass nicht nur einzelne Beeinträchtigungen betrachtet, sondern diese jeweils in ihrem Zusammenwirken auf den wahrgenommenen Raumeindruck beleuchtet werden. Ein wichtiger Aspekt ist zudem die Rechtssicherheit, weshalb sich der verwendete Rahmen eng an die Terminologie des Bundesnaturschutzgesetzes anlehnt Summary How to deal with Disturbance of the Visual Landscape by Traffic Projects? Legal framework conditions and special requirements The impact regulation of nature conservation only gives inferior treatment to the visual landscape compared to other natural resources although nature conservation legislation requires its equal integration into all steps of consequential dealing. For these steps the study shows exemplary legal framework conditions and specialist requirements. They should make clearer a structural approach including individual working steps, such as recording of present site conditions, establishment of a target concept, derivation of measures of avoidance and justification of measures for a sensitive regeneration and design of the visual landcape. The approach continuously bases on the same features of description, leading to a consistent connection between identified disturbances of the visual landscape and related measures. The focus of attemtion should be given to the characteristics of the respective landscape and the analysis should not only consider disturbances or compensation measures individually but also in combination with the general spatial perception. Another important aspect is the legal security; therefore the text closely follows the terminology of the Federal Nature Conservation Legislation.
Das Referat Bodenschutz in brandenburgischen Ministerium für Landwirtschaft, Umweltschutz und Raumordnung hat im Oktober ein Vorhaben mit dem Titel "Bodenbewertung für Planungs- und Zulassungsverfahren im Land Brandenburg" an den Lehrstuhl für Landschaftsplanung an der Universität Potsdam vergeben. Ziel ist, auf der Grundlage des Bundes-Bodenschutzgesetzes die Belange des Bodenschutzes künftig über einheitliche und nachvollziehbare Bewertungsmethoden in Planungs- und Zulassungsverfahren einzubringen. Das entwickelte Bewertungsverfahren bezieht sich auf die aus dem BBodSchG ableitbaren natürlichen Bodenfunktionen Lebensraum- und Regulationsfunktionen sowie auf seine Funktion als Archiv der Natur- und Kulturgeschichte und soll helfen, die spezifisch brandenburgischen Gegebenheiten bei planerischen Bewertungen zu berücksichtigen. Der Beitrag enthält eine Synopse des Herleitungsvorganges und gibt die wesentlichen Bewertungsergebnisse für die einzelnen Teilfunktionen wieder.
Zusammenfassung Die Eingriffsregelung wurde 1976 mit dem Bundesnaturschutzgesetz eingeführt, griff dabei aber bereits auf eine längere Tradition von "Landschaftspflegeplänen" zurück, die bei verschiedenen Vorhaben überwiegend zu deren Eingrünung erstellt wurden. Entsprechend dauerte es seine Zeit, bis sich über derartige "Gestaltungsmaßnahmen" hinaus die differenzierte wirkungsbezogene Herleitung und Umsetzung von Vermeidungs-, Ausgleichs- und Ersatzmaßnahmen durchsetzen konnte. Deutschland hat sich damit eine Regelung gegeben, die den Anspruch eines umfassenden Verschlechterungsverbots der Leistungsfähigkeit von Naturhaushalt und Landschaftsbild verfolgt und im Anwendungsbereich wie auch in den Rechtsfolgen weitergehender ist als in allen anderen Ländern (z.B. USA, Schweiz, Niederlande), in denen gleichfalls Regelungen zur Bewältigung von Umweltauswirkungen existieren. Im Alltagsgeschäft der Naturschutzbehörden ist es dabei eine hohe Zahl an Vorgängen - vielfach mehrere 100 im Jahr -, die von den Fachreferenten zu bewältigen ist. Eine kritische Betrachtung, inwieweit die Eingriffsregelung die in sie gesetzten Erwartungen tatsächlich erfüllt hat, ergibt ein differenziertes Bild: -
Zusammenfassung Eine Diskussion um das künftige Verhältnis von Landschaftsplanung und Strategischer Umweltprüfung (SUP) hat von den unterschiedlichen Aufgabenstellungen beider Instrumente auszugehen (Umweltfolgenprüfung durch die SUP und konzeptionell-planungsbezogener Ansatz der Landschaftsplanung). Um Überschneidungsbereiche von SUP und Landschaftsplanung zu identifizieren, werden in dem Beitrag verfahrensmäßige und inhaltliche Aspekte getrennt betrachtet. Deutlich wird, dass die Landschaftsplanung für den Bereich Natur und Landschaft eine zentrale Daten- und Informationsgrundlage für die SUP sein kann. Es bleibt zu hoffen, dass vor diesem Hintergrund die im Entwurf zu einem SUP-Stammgesetz vom Juli 2003 vorgesehene SUP- Pflicht für Landschaftsplanungen noch einmal überdacht wird. Bei der Zuarbeit zur SUP besteht für die Landschaftsplanung sowohl die Gefahr einer Überfrachtung als auch die Chance für eine substanzielle inhaltliche Weiterentwicklung: Insbesondere können von der SUP Impulse für mehr Prozesshaftigkeit der Landschaftsplanungen, eine größere Aktualität sowie häufigere und zielgenauere Fortschreibungen ihrer Planwerke ausgehen. Eine zu starke Fixierung der Landschaftsplanung auf die SUP würde allerdings zu einer zu starken fachlichen Einengung auf die Folgenprüfung führen. Um dem zu begegnen, scheint eine flexible Kombination beider Instrumente zielführend. Diese kann erreicht werden, indem die Landschaftsplanung einzelne problembezogen angelegte Module zur SUP erarbeitet und damit für sie den wesentlichen Baustein für die Aufarbeitung der Naturschutzaspekte liefert. A discussion abuot the future relation of Landscape Planning and Strategic Environmental Assessment (SEA) has to base on the different tasks of both instruments (analysis of environmental consequences by the SEA and conceptional approach related to planning by Landscape Planning). In order to identify overlapping parts of SEA and Landscape Planning the study separately investigates aspects of procedure and content. The results show that landscape planning can provide a central base of data and information for the SEA. Against this setting the draft of a SEA core law of July 2003 requiring the conduction of SEA for Landscape Planning will hopefully be reconsidered. The contribution of SEA to Landscape Planning on the one hand holds the risk of overloading but also offers the chance for a substantial further development: The SEA can improve the process aspect of Landscape Planning as well as stimulate more topicality and more frequent and exact updating of planning projects. On the other hand, however, a very strong specification of Landscape Planning towards SEA would lead to a restriction on the analysis of environmental consequences. A flexible combination of both instruments appears to fulfil the target. This means that Landscape Planning develops individual problem-related modules of SEA providing the fundamental component to deal with the nature conservation aspects.
Mit der Neufassung der Eingriffsregelung im novellierten Bundesnaturschutzgesetz sind der Eingriffstatbestand erweitert und die Entscheidungsabfolge verändert worden, indem die Abwägung nunmehr erst hinter dem Ersatz angesiedelt ist. Wenngleich in der Theorie weiter ein Vorrang von Vermeidung und Ausgleich besteht, ist zu erwarten, dass diese Aspekte dadurch in der Praxis indirekt geschwächt werden. Hervorzuheben ist hingegen, dass Ersatzmaßnahmen nunmehr bundeseinheitlich definiert sind und dabei einen Bezug zu konkreten Beeinträchtigungen aufweisen müssen und dass der Gesetzgeber mit der neuen Stellung der Abwägung in der Entscheidungsabfolge ausdrücklich den Vorrang von realer Kompensation betont. Mögliche Folgen der Neuregelung werden anhand exemplarischer Handlungsfelder diskutiert: Dem Schutzgut Landschaftsbild, der Verbindung der Landschaftsplanung zur Eingriffsregelung, den Bezügen zur guten fachlichen Praxis in der Land- und Forstwirtschaft sowie Flächenpools und Ökokonten. Angesichts knapper Kassen ist die Gefahr, dass die Eingriffsregelung zum wesentlichen Finanzierungsinstrument für die Umsetzung von Naturschutzmaßnahmen wird, nicht von der Hand zu weisen. Handlungsbedarf besteht daher vor allem in der Ausarbeitung fachlicher Konventionen zur notwendigen "Gleichwertigkeit" von Ersatzmaßnahmen sowie zur Festlegung fachlicher Qualitätsprofile für Flächenpools.
