Während über Max Webers Religionssoziologie ganze Bibliotheken geschrieben worden sind, gibt es zu seiner Rechtssoziologie – ungeachtet ihrer von Talcott Parsons herausgestellten Zentralität in Webers Werk – vergleichsweise wenige Veröffentlichungen. Insbesondere ist sein Verhältnis zur juristischen Methodenlehre nahezu unberücksichtigt geblieben, obwohl er als promovierter und habilitierter Jurist im weitesten Sinne von ihr ausgegangen ist. Max Webers Rechtssoziologie ist für die Rechtsdogmatik nicht zuletzt deshalb so interessant, weil Weber das Recht und die juristische Methode inwendig kannte und von daher deutend verstehen konnte.
Für die Neuauflage hat Jens Petersen alle Nachweise auf die Max-Weber-Gesamtausgabe umgestellt und nicht nur die in den vergangenen fünf Jahren erschienene Literatur zu seiner Rechtssoziologie berücksichtigt, sondern auch älteres Schrifttum.
Die vorliegende Abhandlung bereitet erstmals systematisch das Verhältnis von Rechtsordnung und Wirtschaftsordnung nach der Theorie der Interdependenz der Ordnungen von Walter Eucken auf.
Die meisten Juristen werden Walter Eucke noch mit dem Ordoliberalismus in Verbindung bringen, manche der Freiburger Schule zuordnen, die wenigsten jedoch seine 'Grundsätze der Wirtschaftspolitik' oder gar seine juristisch nicht minder gehaltvollen 'Grundlagen der Nationalökonomie' gelesen haben. Gerade die ersteren jedoch – sein nachgelassenes Hauptwerk – bilden nicht nur für Ökonomen, sondern auch für Juristen eine überaus anregende Lektüre.
Jedem Juristen, vor allem jedem Wirtschaftsrechtler, sollte eine beiläufige Beobachtung zu denken geben, die Walter Eucken in seinen 'Grundlagen der Nationalökonomie' angestellt hat: „Werden der Wissenschaft in zwei Jahrtausenden nur unsere wichtigsten Rechtsnormen bekannt sein, so wird sie von unserer Wirtschaftsordnung kein wirkliches Bild gewinnen".
Blaise Pascal (1623-1662) gehört zu den größten Geistern, die je auf Erden gelebt haben. Der vorliegende Band versucht eine Verbindungslinie zwischen seiner Rechtsphilosophie und seiner Religionsphilosophie herzustellen, indem er Pascals Gedanken über die Gerechtigkeit zu seiner berühmten Lehre von den drei Ordnungen ins Verhältnis setzt.
