Das vorliegende Buch ist der Versuch einer etwas anderen Systematik der Stoffvermittlung, bei der die Vorgehensweise der Bearbeitung eines Strafrechtsfalles die Funktion des leitenden und strukturierenden roten Fadens hat. Die Fülle des strafrechtlichen Stoffes wird hier nicht streng nach AT und BT gegliedert, sondern danach, an welcher Stelle im Prozess der Bearbeitung eines Strafrechtsfalles etwas zum Tragen kommt. Daher sollte die Arbeit mit dem Buch den nicht zu unterschätzenden Nebeneffekt haben, mit der Vermehrung und Verfestigung des Strafrechtswissens zugleich den Rhythmus der strafrechtlichen Fallbearbeitung zu verinnerlichen. Von einem Lehrbuch unterscheidet sich das vorliegende Werk noch in einem zweiten Punkt, der gerade in der heißen Examensvorbereitungsphase von nicht zu unterschätzender Bedeutung ist: der behandelte Stoff wird begrenzt durch die Vorgaben der Juristenausbildungsordnungen der Bundesländer, die sich in dieser Hinsicht jedenfalls im Kern nur unwesentlich unterscheiden. Was nicht prüfungsrelevant ist, bleibt außen vor. Vor allem aus dem Besonderen Teil werden daher manche Tatbestände überhaupt nicht angesprochen, weil sie in allen oder den meisten Bundesländern nicht zum Prüfungsstoff gehören.
Strafrecht im Zivilrecht

Dass die Entscheidung eines Zivilgerichts die gesteigerte Aufmerksamkeit von Strafrechtlern auf sich zieht, ist sicher nicht die Regel. Steht aber im Mittelpunkt einer solchen Entscheidung eine BGB-Vorschrift, die das Tatbestandsmerkmal „gestohlen“ enthält, liegt es nahe, dass der Fall etwas mit § STGB § 242 StGB zu tun haben könnte. Das interessiert dann natürlich auch einen Juristen, der Zivilrecht zwar wie alle im Studium und Referendariat gelernt hat, danach aber hauptsächlich im Strafrecht unterwegs ist. In dem Fall, der dem Urteil des 5. Zivilsenats des BGH vom BGH 18.9.2020 zur Fussnote 1 zugrunde lag, ging es um die Anwendung des § BGB § 935 BGB § 935 Absatz I BGB, die durch das erwähnte Wort mit dem Strafrecht verknüpft ist. Überraschenderweise ging der BGH in seiner Entscheidung mit keiner Zeile auf Diebstahl ein. Das wird dem Sachverhalt nicht ganz gerecht. Es mag sein, dass die Richtigkeit des Ergebnisses dadurch nicht in Frage gestellt wird. Begründungstechnisch erscheint die Vorgehensweise der BGH-Richter jedoch ergänzungsbedürftig. Im Folgenden soll die gebotene strafrechtliche Würdigung nachgeholt werden.
Auftreten unter falschem Namen in Straf- und Bußgeldverfahren ist gewiss kein alltägliches Ereignis. Existiert die Person tatsächlich, deren Namen ein anderer im Verfahren als Betroffener oder Beschuldigter verwendet, stellt sich vor allem die Frage, wen die verfahrensabschließende Entscheidung (Bußgeldbescheid, Urteil, Beschluss) betrifft. Verschiedene Konstellationen sind denkbar. Das OLG Stuttgart hatte es mit einem Fall zu tun, in dem letztlich der „richtige Täter“ verurteilt wurde. Ob sich das Verfahren auch gegen den „richtigen Betroffenen“ richtete, ist eine andere Frage.

Das "Donaulied"

In der niederbayerischen Metropole Passau sowie einigen weiteren Städten der Region ist gegenwärtig in der Bevölkerung eine heftige Auseinandersetzung über ein Lied im Gang, das regelmäßig auf Volksfesten und ähnlichen Veranstaltungen aufgeführt und gesungen wird. Es handelt sich um das „Donaulied“, das die Initiatoren einer Petition – Studenten der Universität Passau – wegen sexistischer Textpassagen verbieten lassen wollen, während es ihre Widersacher als Ausdrucksform bayerischer Volkstümlichkeit für unantastbar erklären. „Weg mit dem Donaulied“ und „Hände weg vom Donaulied“ könnte man die konträren Standpunkte propagandistisch zugespitzt etikettieren. Die Trumpfkarte des Strafrechts wird in diesem Streit von den Gegnern des Liedes zur Bekräftigung ihrer Forderungen offenbar noch nicht ausgespielt. Das kann daran liegen, dass diese Karte (noch) nicht sticht, weil das Strafrecht in Bezug auf diesen Gegenstand seine vielgepriesene Fragmentarität zeigt, also eine Strafbarkeitslücke aufweist. Angesichts des Bestrafungseifers, mit dem die Politik in den letzten Jahren das Strafrecht vielfältig zur Bekämpfung sexuell konnotierter Übergriffe – z.B. zuletzt „Upskirting“ – ertüchtigt hat, wäre das ein überraschender Befund. Aber die Analyse des geltenden Strafrechts wird bestätigen, dass hier tatsächlich noch eine strafrechtsfreie Nische existiert. Die nunmehr öffentlich wahrgenommene Anstößigkeit des Donaulieds könnte also im wahrsten Sinne des Wortes Anstoß sein zu einer Gesetzgebungsinitiative. Ob es dieser aber wirklich bedarf, sollte gründlich überlegt werden.
