Institute
The Women, Peace and Security Agenda (WPSA) is an international framework addressing the disproportionate impact of armed conflict on women and girls and promoting their meaningful participation in peacebuilding efforts. The Security Council called on Member States to develop National Action Plans (NAPs) to operationalize the four pillars of the Agenda. This study looks at the relevant steps undertaken by both Germany and the European Union. The author calls for improvements on either level and makes four recommendations.

Dieser Jahresbericht umfasst den Berichtszeitraum 2023, in dem Forschung und Lehre wieder in Präsenz stattfinden konnten. Begegnung und Austausch in Hörsaal und Seminarraum, auf Konferenzpaneln und während Kaffeepausen sind wieder möglich, aber die Möglichkeiten von Homeoffice und Onlinekommunikation bleiben weiter bestehen, wie die Erfahrung zeigt.
Das MenschenRechtsZentrum als interdisziplinär arbeitende, zentrale wissenschaftliche Einrichtung der Universität Potsdam hat es im Berichtszeitraum erneut unternommen, juristische, philosophische, geschichts- und kultur- sowie politikwissenschaftliche Perspektiven auf das Thema Menschenrechte in Forschung und Lehre miteinander zu verbinden.
Die Wissenschaftler*innen des MenschenRechtsZentrums lehren an den Fakultäten, denen sie angehören. Hier werden daher nur diejenigen Aktivitäten angeführt, die einen Bezug zur Arbeit des MenschenRechtsZentrums sowie zu menschenrechtlichen Fragestellungen haben; weitergehende Informationen finden sich auf den Homepages der jeweiligen Personen.
Thus far, research into reservations to treaties has often overlooked reservations formulated to both European Social Charters (and its Protocols) and the relevant European Committee of Social Rights practices. There are several pressing reasons to further explore this gap in existing literature. First, an analysis of practices within the European Social Charters (and Protocols) will provide a fuller picture of the reservations and responses of treaty bodies. Second, in the context of previous landmark events it is worth noting the practices of another human rights treaty monitoring body that is often omitted from analyses. Third, the very fact that the formulation of reservations to treaties gives parties such far-reaching flexibility to shape their contractual obligations (à la carte) is surprising. An important outcome of the research is the finding that, despite the far-reaching flexibility present in the treaties analysed, both the States Parties and the European Committee of Social Rights generally treat them as conventional treaties to which the general rules on reservations apply. Consequently, there is no basis for assuming that the mere fact of adopting the à la carte system in a treaty with no reservation clause implies a formal prohibition of reservations or otherwise discourages their formulation.
In the past decades, scholars and courts have paid considerable attention to the extraterritorial applicability of human rights treaties. By contrast, the extraterritorial application of constitutional rights has received comparable scholarly attention only in the United States. Specifically, there is a paucity of comparative research in this area, which contributes to the prevailing view that human rights law provides the proper framework under which domestic courts should examine extraterritoriality questions under constitutional law.
This article argues that domestic constitutional regimes and their judicial enforcers can and should provide an important counterweight to the deadlocked extraterritoriality debate at the international level. Using two case studies from Germany and the United States, it shows that domestic constitutional courts are sometimes better suited than treaty bodies to guard the normative values of human dignity and universality in an extraterritoriality context. This is most apparent in the case of Germany, which has a long tradition of integration into international multi-level governance systems and "bottom-up" resistance based on fundamental rights within such systems. Recent cases from the Federal Constitutional Court (Bundesverfassungsgericht) about the extraterritorial application of the Basic Law (Grundgesetz) to foreign intelligence gathering and climate change support this theory. However, an independent constitutional approach can also achieve some normative effects in domestic systems that are more isolated from the international human rights system. Thus, the US Supreme Court likewise used domestic constitutional doctrine to sidestep the American government's strictly territorial interpretation of the ICCPR and employ a functional approach to the extraterritorial applicability of fundamental rights in the case of detention of suspected terrorists in the Guantánamo Bay naval base.
The study of these two examples does not purport to be comprehensive or even representative of the world’s diverse array of constitutions and their relationships with international human rights law. However, the independent power of constitutional frameworks in these two disparate cases should all the more provide an impetus for increased comparative research into constitutional extraterritoriality regimes and their value for the project of human rights.

Ziele: Die Autorin konzentriert sich auf die Betrachtung des ethischen Berufskodex der Sozialen Arbeit und untersucht Schlüsselthemen (professionelle Haltung, systemimmanente Dilemmata, Gewalt und Machtmissbrauch) in der Praxis der Kinder- und Jugendhilfe und des Kinderschutzes in Ungarn und Deutschland.
Methoden: Kurzdarstellung einer standardisierten Online-Befragung von Fachkräften im System der Kinder- und Jugendhilfe sowie des Kinderschutzes, die in Ungarn und Deutschland durchgeführt wurde. Der bereinigte Datensatz beläuft sich auf insgesamt 122 Fragebögen (Deutschland N=89, Ungarn N=33 aus Ungarn). Einige kinderrechtliche Herausforderungen in Bezug auf Institutionen der stationären Kinder- und Jugendhilfe und des Kinderschutzes in Ungarn werden darüber hinaus in einem Dialog vertiefend erörtert.
Ergebnisse: Der ethische Rahmen der Profession ist weitgehend bekannt, aber die Bedingungen in der Praxis müssen so verbessert werden, dass professionsethisch korrektes Handeln möglich ist. Die Ergebnisse der Studie zeigen, dass in der täglichen Praxis Verstöße gegen die Berufsethik vorkommen. Besonders besorgniserregend sind die Ergebnisse bezüglich Gewalt und Missbrauch gegenüber Adressat*innen.
Implikationen für die Sozialarbeit: Die Profession der Sozialen Arbeit als Menschenrechtsprofession ist unweigerlich in normative Fragen der gesellschaftlichen Macht- und Dominanzverhältnisse verstrickt. Professionelles Handeln erfordert zum einen Kenntnisse der Kinder- sowie Menschenrechte, das Bewusstsein für moralische Normen, Standards und Werte, zum anderen die Fähigkeit zur ethischen Urteilsbildung, Selbstreflexion sowie Intervention.
Diskriminierungsverbote gehören zu den Grundpfeilern des internationalen Menschenrechtsschutzes. Es gibt sie in unterschiedlichen Ausprägungen: Manche schützen nur vor einer Ungleichbehandlung bei der Inanspruchnahme eines Freiheitsrechts (sog. akzessorische Diskriminierungsverbote), andere schützen demgegenüber vor einer Ungleichbehandlung in sämtlichen Rechtskontexten. Ein allgemeines und umfassendes Diskriminierungsverbot, welches in allen Rechtskontexten gilt, findet sich in Artikel 1 des 12. Zusatzprotokoll zur EMRK. Dieses Zusatzprotokoll wurde von vielen europäischen Staaten - darunter auch Deutschland - bisher nicht ratifiziert. Der Beitrag möchte die menschenrechtlichen Potenziale und Mehrwerte dieses Zusatzprotokolls aufzeigen und nimmt dabei auch umfassend Bezug auf die Lernerfahrungen des UN-Zivilpakts, welcher mit Art. 26 UN-Zivilpakt eine strukturanaloge Regelung kennt.
Die Knappheit medizinischer Ressourcen im Verlauf der COVID-19-Pandemie machte die Überlegung notwendig, wie und an wen medizinische Güter, besonders COVID-19-Impfstoff, verteilt werden sollen. Dafür wurden sowohl national als auch international Priorisierungskonzepte zur Impfstoff-Allokation entwickelt. Neben verschiedenen moralphilosophischen Grundsätzen und nationalstaatlicher Gesetzgebung sollten auch die Menschenrechte bei der Etablierung von Allokationssystemen berücksichtigt werden. Möglichkeiten zur praktischen Umsetzung sind etwa die Priorisierung vulnerabler Gruppen sowie die Gewährleistung von Diskriminierungsfreiheit und Chancengleichheit bei der Inanspruchnahme von Gesundheitsleistungen. Ein intersektionaler, menschenrechtsbasierter Ansatz kann dazu beitragen, einen ganzheitlichen Blick auf die Gesundheitsversorgung der Gesellschaft zu werfen und neben den direkten medizinischen Problemen auch die sozialen Determinanten von Gesundheit und die Interdependenz aller zu schützenden Menschenrechte zu adressieren. Welche Rolle die Menschenrechte im Kontext der Ressourcenverteilung spielen, wird anhand der Verteilung von COVID-19-Impfstoff in Deutschland analysiert, wobei exemplarisch der besondere Schutz Älterer betrachtet wird.

Der Jahresbericht des MenschenRechtsZrentrums der Universität Potsdam (MRZ) informiert über die Aktivitäten im Berichtszeitraum 2021 und 2022. Das MRZ ist eine zentrale wissenschaftliche Einrichtung der Universität Potsdam; seine Mitglieder sind in Forschung und Lehre aktiv, wobei die Lehre an der Philosophischen und an der Juristischen Fakultät angeboten wird.
Zu den bearbeiteten Themen gehören Fragen der Gerechtigkeit, u.a. mit Blick auf die Folgen der Covid-19-Pandemie, der Verhältnis von Menschenrechten und Humanitärem Völkerrecht, der Schutz geflüchteter Personen und das Lieferkettensorgfaltspflichtengesetz.
Spätestens seit dem Brand einer Textilfabrik in Karatschi, Pakistan, deren Hauptabnehmer das deutsche Textilunternehmen KiK war, ist die Frage nach der zivilrechtlichen Justiziabilität von Menschenrechtsverletzungen im Ausland auch in der Bundesrepublik angekommen. Parallel hierzu hatte bereits der Einsturz des Rana Plaza, einem Fabrikgebäude in Dhaka, Bangladesch, das zahlreiche Zulieferfirmen der europäischen sowie u.s.-amerikanischen Bekleidungsindustrie beherbergte, traurige Berühmtheit erlangt. Beide Vorfälle hatten in den Industriestaaten des globalen Nordens eine nachhaltige Debatte darüber ausgelöst, welche Verantwortung inländischen Abnehmerunternehmen für die Einhaltung internationaler Menschenrechtsstandards entlang der global angelegten Lieferkette zukommt. An deren vorläufigem Ende steht eine Reihe von Spezialgesetzen, die heimischen Betrieben ausdifferenzierte Sorgfalts- und Überwachungspflichten bezüglich der Arbeitsbedingungen in den – häufig im globalen Süden gelegenen – Produktionsstätten auferlegen.
Als Folge dieses geostrategischen Nord-Süd-Konfliktes wohnt in Deutschland erhobenen Menschenrechtsklagen im Regelfall ein grenzüberscheitendes Moment inne, weshalb sich die Rechtsverfolgung individuell Betroffener mit den Fragen des Internationalen Privatrechts nach der gerichtlichen Zuständigkeit sowie des anwendbaren Sachrechts konfrontiert sieht. Dass ein Verfahren bereits auf dieser Ebene scheitern kann, verdeutlicht auf paradigmatische Weise das eingangs erwähnte Verfahren gegen KiK vor dem LG Dortmund, in welchem das ungünstige pakistanische Verjährungsrecht zur Anwendung gelangte.
Rechtspolitisch wird die Funktion des Rechtsgebietes indes unterschiedlich beurteilt. Während ein Ansatz gleichsam auf materieller Ebene die Entwicklung spezieller Sorgfaltsnormen für Unternehmen in Abnehmerstaaten verfolgt („Verantwortungslösung“), führt eine andere Auffassung den Kern der Problematik nicht auf das – oftmals durchaus funktionale – Produktionslandrecht, sondern vielmehr auf dessen strukturelle Durchsetzungsdefizite zurück („Kognitionslösung“).
Der Beitrag vollzieht die Implikationen beider Ansätze für Zivilprozesse in Deutschland nach. Hierfür wird die Menschenrechtsklage zunächst in das deutsche Verfahrensrecht eingeordnet (I.) bevor die Rolle des Internationalen Privatrechtes erörtert werden kann (II.). Anschließend werden sowohl die Sorgfaltsregime in den Abnehmerstaaten (III.) als auch Rechtsbehelfe in den Produktionsländern am Beispiel Bangladeschs (IV.) in den Blick genommen.

Der Beitrag führt die Berichterstattung des MenschenRechtsZentrums über die Arbeit des Menschenrechtsausschusses der Vereinten Nationen fort. Er thematisiert insbesondere die im Jahr 2022 erfolgten obligatorischen Staatenberichtsverfahren nach Art. 40 des Zivilpakts. Im Staatenbericht wird dargelegt, welche Maßnahmen die Vertragsstaaten zur Gewährleistung der Rechte des Zivilpaktes getroffen haben. Im anschließenden Verfahren werden im Rahmen eines konstruktiven Dialogs mit dem betreffenden Staat Fragen zu Problemen (List of Issues) erörtert. Die Ergebnisse des Berichtsverfahrens fasst der Ausschuss in seinen Abschließenden Bemerkungen (Concluding Observations) zusammen. Am Ende seiner Abschließenden Bemerkungen stellt der Ausschuss einige Punkte heraus und fordert den Staat dazu auf, über Fortschritte in diesem Bereich nunmehr innerhalb von drei Jahren zu berichten (sog. Follow-up-Verfahren). Im Berichtszeitraum 2022 setzte sich der Ausschuss während seiner drei Sitzungen mit der Menschenrechtslage in 17 Vertragsstaaten auseinander. Thematische Schwerpunkte, die Gegenstand des Follow-up-Verfahrens wurden, bildeten Fälle von Gewalt gegen Frauen, insbesondere ein Anstieg an Fällen häuslicher Gewalt, die Einschränkungen der Meinungs- sowie der Versammlungsfreiheit und rechtsstaatliche Versäumnisse. Darüber hinaus wurden vielerorts die Bedingungen in Hafteinrichtungen und die Situation von Arbeitsmigrant:innen thematisiert.
Das Vorsorgeprinzip ist ein mittlerweile weit verbreiteter und etablierter Grundsatz des internationalen und europäischen Umweltrechts. Demnach sollen auch in Situationen wissenschaftlicher Unsicherheit präventive Maßnahmen ergriffen werden, um schwerwiegende Umweltschäden zu vermeiden. Dieser Beitrag untersucht die Rolle des Vorsorgeprinzips im Zusammenhang mit menschenrechtlichen Klimaklagen, die aufgrund langsamer politischer Fortschritte und erfolgreicher Gerichtsentscheidungen zunehmend an Popularität gewinnen.
Zunächst wird ein Überblick über die Entwicklung und den materiellen Gehalt des Vorsorgeprinzips im internationalen und europäischen Recht gegeben. Obwohl das Vorsorgeprinzip seit den 1980er Jahren ein fixer Bestandteil des internationalen Umweltrechts ist, bestehen über dessen genauen Inhalt und Rechtsnatur nach wie vor Kontroversen. Im Unionsrecht wurde das Vorsorgeprinzip insbesondere durch die Rechtsprechung des EuGH konkretisiert.
Im nächsten Teil des Beitrags wird beleuchtet, welche Bedeutung der EGMR dem Vorsorgeprinzip in umweltrechtlichen Fällen bisher zugemessen hat. Hierbei steht die Entscheidung Tǎtar gegen Rumänien im Mittelpunkt. Gegenstand dieser Entscheidung war der Goldabbau in der rumänischen Stadt Baia Mare, der unter anderem unter dem Einsatz von Natriumzyanid erfolgte und zu wesentlichen Schadstoffbelastungen führte. Der EGMR bejahte unter Verweis auf das Vorsorgeprinzip eine Verletzung von Art. 8 EMRK, obwohl der Beschwerdeführer die Kausalität zwischen der Schadstoffbelastung und der behaupteten Schädigung nicht nachweisen konnte. Eine Analyse der nachfolgenden Entscheidungen veranschaulicht jedoch, dass sich das Vorsorgeprinzip noch nicht als fixer Bestandteil in der Rechtsprechung des EGMR etablieren konnte.
Abschließend wird gezeigt, welchen Beitrag das Vorsorgeprinzip zu der bisher wohl erfolgreichsten Klimaklage „Urgenda“ leistete. Das Vorsorgeprinzip wurde vom niederländischen Höchstgericht in diesem Fall insbesondere herangezogen, um Schutzpflichten aus Art. 2 und Art. 8 EMRK abzuleiten und den staatlichen Ermessenspielraum einzuschränken.
The last years have been affected by Covid-19 and the international emergency mecha-nism to deal with health-related threats. The effects of this period manifested differ-ently worldwide, depending on matters such as international relations, national policies, power dynamics etc. Additionally, the impact of this time will likely have long-term effects which are yet to be known. This paper gives a critical overview of the Public Health Emergency of International Concern (PHEIC) mechanism in the context of Covid-19. It does so by explaining the legal framework for states of emergency, specifically in the context of a PHEIC, while considering its restrictions and limitations on human rights. It further outlines issues in the manifestation of global protections and limitations on human rights during Covid-19. Lastly, considering the likelihood of future PHEICs and the known systemic obstructions, this paper offers ways to im-prove this mechanism from a holistic, non-zero-sum perspective.
In Vorbereitung der Allgemeinen Bemerkung Nr. 36 zum Recht auf Leben vollzieht der Menschenrechtsausschuss der Vereinten Nationen eine begriffliche Wendung: Fortan wird der Ausschuss nicht mehr von “vulnerable persons”, sondern von “persons in situations of vulnerability” sprechen. Zugleich scheint in der Wendung ein geändertes Verständnis von Vulnerabilität zu liegen, welches strukturelle Ungleichheiten und äußere Umstände, die Verwundbarkeit erzeugen, begrifflich erfasst. Das neue Verständnis scheint damit auch die Problematik der Zuschreibung von Verwundbarkeit zu entschärfen, die ihrerseits zu Marginalisierung betroffener Individuen führen kann. Der Beitrag vollzieht die Debatte um das neue Verständnis von Vulnerabilität im Menschenrechtsausschuss nach, und kontextualisiert diese innerhalb der aktuellen Spruchpraxis des Ausschusses. Besondere Aufmerksamkeit gilt dabei den Klimafällen, welche, so wird argumentiert, in besonderer Weise äußere, vulnerabilitätsproduzierende Umstände adressieren. Schließlich werden die potenziellen Stärken und Schwächen der begrifflichen Wendung reflektiert.
Dieser Beitrag beschäftigt sich mit einer problematischen Seite der Samen- und Eizellenspende. Konkret konzentriert er sich auf die Anonymität im Rahmen dieses Verfahrens, die in manchen europäischen Staaten als eine gesetzliche Bedingung festgelegt ist. Es geht um eine Konsequenz der unklaren Regulierung auf EU-Ebene, die es ermöglicht, nationale Vorschriften nach individuellen Präferenzen des Gesetzgebers zu konzipieren. Trotzdem muss auch der menschenrechtliche Kontext berücksichtigt werden, weil die Anonymität des:der Spender:in dazu führt, dass das Kind de facto keine Chancen hat, seine (genetischen oder biologischen) Eltern zu kennen. Im Prinzip verletzt ein solcher Ansatz das Recht des Kindes auf Kenntnis der eigenen Abstammung, das in entsprechenden Menschenrechtskonventionen verankert und in der Judikatur des EGMR interpretiert wurde.

Menschenrechte von LGBTQI+-Personen sind in keinem Vertragswerk ausdrücklich geregelt. Dementsprechend obliegt ihr Schutz der Rechtsprechung, die in den vergangenen Jahren ein ausdifferenziertes Schutzsystem etabliert hat, das sich vor allem auf den allgemeinen Schutz vor Diskriminierung, aber auch auf etwa das Recht auf Achtung des Privat- und Familienlebens stützt. Der Beitrag stellt die historische Entwicklung dieser LGBTQI+-Menschenrechte dar und trägt die aktuellen Rechtsquellen sowie die wichtigsten Entscheidungen zusammen, die weltweit und insbesondere in Europa diese Rechte gestärkt haben. National und international begegnen rechtliche Probleme dort, wo immer spezifischere Fragestellungen auf weltweit politische Instabilität trifft. Dazu zählen etwa die Stigmatisierung von sog. Konversionsmaßnahmen und die Eintragung von Trans*personen ins Geburtenregister.
Die Entscheidung des Menschenrechtsausschusses der Vereinten Nationen im Fall Billy et al. gegen Australien zum Schutz der Beschwerdeführenden vor den Folgen des Klimawandels wurde als bedeutsamer Erfolg gefeiert. Der Ausschuss bewertet allerdings nur die Adaptationsmaßnahmen Australiens als unzureichend. Der Artikel untersucht, ob die Entscheidung einen Beitrag zur Weiterentwicklung des Klimaschutz- und Klimaanpassungsrechts auf Menschenrechtsebene leistet. Eine nähere Analyse der Entscheidungsgründe zeigt, dass sie weniger progressiv sind als teilweise angenommen. Dennoch stellt die Entscheidung einen Präzedenzfall dar, der angesichts der zunehmenden Bedeutung der Klimaanpassung, auch für nationale Gerichte und regionale Menschenrechtsgerichtshöfe wegweisend ist.
Der russische Angriffskrieg auf die Ukraine hat auch die Europäische Menschenrechtsarchitektur ins Wanken gebracht. Der Europarat reagierte schnell und beendete die Mitgliedschaft der Russischen Föderation. Aus diesem Anlass blickt der Beitrag zurück auf die wechselvolle Geschichte der Mitgliedschaft Russlands im Europarat. Seit dem Beitritt vor 26 Jahren haben Konfrontationen die – oftmals kurzen– Phasen der Kooperation überschattet. Das wirft die Frage auf, inwieweit die „Politik des Dialogs“ gegenüber der Russischen Föderation geeignet war, die Menschenrechtslage in Russland zu verbessern. Der Beitrag legt zudem die rechtlichen Grundlagen von Beitritt und Ende der Mitgliedschaft dar und untersucht, wie sich der Ausschluss auf die Anwendbarkeit der Europäischen Menschenrechtskonvention (EMRK) auswirkt. Der Ausschluss Russlands stellt einen Wendepunkt dar. Zwar wird damit ein potenziell gefährlicher Präzedenzfall geschaffen. Jedoch entsteht durch die geschlossene Reaktion der restlichen Mitgliedstaaten auch ein Momentum für Reformen und eine Rückbesinnung auf das Gründungsziel des Europarates – die kollektive Durchsetzung der Menschenrechte.
The question of whether the monitoring bodies have competence concerning reservations is at the centre of the discussion of reservations to human rights treaties that has occupied many international legal scholars over the last few decades. The Istanbul Convention’s treaty monitoring body, GREVIO, is the only human rights treaty monitoring body with a direct competence concerning reservations. However, as practice to date shows, it does not make much use of this power. This is a big disappointment considering all the efforts of other bodies in the past and the doctrinal positions of various scholars. The main aims of this article are threefold to: present GREVIO’s practice to date concerning reservations, provide a brief historical overview of how other human rights treaty bodies have approached their role concerning reservations, and finally, attempt to explain why GREVIO has abandoned a more proactive position on reservations.
Back in 1949, and thus only one year after the 1948 Universal Declaration of Human Rights, the four Geneva Conventions were adopted, providing a strong signal for a new world order created after 1945 with the United Nations at their centre and combining as their goals both the maintenance of peace and security and the protection of human rights, but also recognising, realistically, that succeeding generations had so far not yet been saved from the scourge of war. Hence, the continued need for rules governing, and limiting, the means and methods of warfare once an armed conflict has erupted. At the same time, the international community has unfortunately not been able so far to fully safeguard individual human rights, its efforts to that effect and the continuous development of international human rights law over the years notwithstanding.

This chapter consists of three parts. In the first part, I will give a short overview about the integration of the protection of the environment into German constitutional law. This section will start with the presentation of the relevant provision, Art. 20a BL. Then, I will elaborate on its legal character. In the second part, I will make some brief remarks on the practical implications of Art. 20a BL. Finally, I will present some preliminary conclusions.
