Aus der Einleitung: Vor 15 Jahren hat Polen mit dem Transformationsprozess begonnen, der das Land von einer sozialistischen Planwirtschaft mit autoritärem Regime in einen modernen demokratischen Staat marktwirtschaftlicher Ausrichtung verwandelt hat. Seither genießt das polnische Volk nach vielen Jahren der Fremdherrschaft wieder seine eigene Souveränität. Mit dem Ende der sozialistischen Ära begann eine Phase umfangreicher und weit reichender institutioneller, wirtschaftlicher und sozialer Veränderungen. Diese gehen einher mit hoher Arbeitslosigkeit und starker Verunsicherung im Umgang mit den sich neu bildenden Strukturen, was eine große Belastung für die Bevölkerung darstellt. Den Herausforderungen zum Trotz haben es die Polen geschafft, in nur wenigen Jahren ein institutionelles und wirtschaftliches Niveau zu erreichen, das sich an dem Niveau westeuropäischer Staaten orientiert. Diese Leistung wurde u. a. durch die Europäische Kommission anerkannt, indem 1998 zunächst die Beitrittsverhandlungen mit Polen eröffnet wurden und das Land im Mai 2004 zur Europäischen Union (EU) beitrat. Während die alten Mitgliedsstaaten der Europäischen Union eine lang andauernde Phase wirtschaftlichen Abschwungs erleiden, findet im angrenzenden Polen ein rasanter wirtschaftlicher Aufholungsprozess statt. Wachstumsraten von 5 % und mehr sind hierbei keine Seltenheit. Diese Entwicklung wird von vielen Bürgern der alten EU Mitgliedssaaten in Zeiten steigender Arbeitslosigkeit und sinkender Löhne wahrgenommen und teilweise als Ursache der eigenen Misere identifiziert. Tatsache aber ist, dass sogar bei anhaltender Dynamik der polnischen Wirtschaft ein Erreichen des westeuropäischen Standards, wenn überhaupt, erst in mehreren Jahrzehnten als realistisch erscheint. Ebenso wie im wirtschaftlichen Bereich stellt sich die institutionelle Diskrepanz zwischen Polen und den Ländern der EU der 15 dar. Zu groß sind die Unterschiede, als dass sie in nur einem Jahrzehnt hätten nachgeholt und ausgeglichen werden könnten. Als zusätzlich Hindernis ist zu werten, dass sich in den letzten Jahren die Berichte der Europäischen Kommission, der Weltbank oder Transparency International mehren, Korruption in Polen bedrohe sämtliche Sphären des öffentlichen und privaten Lebens und die junge „alte“ Demokratie somit durch hausgemachte Probleme ins Strudeln geraten könnte. Innerhalb der Europäischen Kommission scheint man sich des Problems der Korruption in Polen bewusst zu sein und befürchtet diese in Form eines trojanischen Pferdes importiert zu bekommen (Vgl. Dehley 2002: 4). Andere Organisationen wie GRECO1 zeichnen ein düstereres Szenario, da sie der Korruption in Polen attestieren, die demokratischen Institutionen auszuhöhlen.

Two decades after the introduction of the punctuated equilibrium model, information processing theory now offers one of the most comprehensive analytical perspectives on decision making in public administration and policy research. This article applies information processing analysis to the decision making process in the European Union (EU). Towards this end, the article inquires into the organizational foundations of information processing at successive levels of administrative and legislative decision making and shows how this analytical perspective can be used to gain a better understanding of policy dynamics at the supranational level. The article argues that information processing in the EU is likely to produce distinct policy dynamics in key respects. It identifies promising avenues for future research and discusses some of the issues this evolving theoretical framework should address in order to allow for a more comprehensive exploration of this analytical perspective in the context of the EU.
Agricultural landscapes safeguard ecosystem services (ES) and biodiversity upon which human well-being depends. However, only a fraction of these services are generally considered in land management decisions, resulting in trade-offs and societally inefficient solutions. The TEEB Study (The Economics of Ecosystems and Biodiversity) spearheaded the development of assessments of the economic significance of ES and biodiversity. Several national TEEB follow-ups have compiled case studies and derived targeted policy advice. By synthesizing insights from "Natural Capital Germany - TEEB DE" and focusing on rural areas, the objectives of this study were (i) to explore causes of the continued decline of ES and biodiversity, (ii) to introduce case studies exemplifying the economic significance of ES and biodiversity in land use decisions, and (iii) to synthesize key recommendations for policy, planning and management. Our findings indicate that the continued decrease of ES and biodiversity in Germany can be explained by implementation deficits within a well-established nature conservation system. Three case studies on grassland protection, the establishment of riverbank buffer zones and water-sensitive farming illustrate that an economic perspective can convey recognition of the values of ES and biodiversity. We conclude with suggestions for enhanced consideration, improved conservation and sustainable use of ES and biodiversity. (C) 2017 Elsevier B.V. All rights reserved.

An keinem anderen Ort wird die besondere Bedeutung der Vereinigten Staaten von Amerika für Deutschland so deutlich wie in Berlin. In rund 80 Einträgen versammelt der Band eine Vielzahl US-amerikanischer Persönlichkeiten und stellt Orte vor, an denen sie in Berlin gelebt und gewirkt haben oder noch wirken. Die Berliner Erlebnisse von Diplomaten, Intellektuellen, Wissenschaftlern, Sportlern oder berühmten Künstlerinnen aller Sparten machen die Geschichte der deutsch-amerikanischen Beziehungen von den Anfängen 1776 bis heute anschaulich und lebendig. Ausklappbare Karten, Infokästen, ein farbiges Orientierungssystem und zahlreiche historische sowie aktuelle Fotos eröffnen die Möglichkeit, den Spuren von Mildred Harnack, Martin Luther King, Angela Davis, Iggy Pop, Georg Bush, Daniel Liebeskind, Jonathan Franzen und vielen anderen in der deutschen Hauptstadt zu folgen.

Der vorliegende Beitrag untersucht das Potential und die Bedingungen alternativer Regulierungsformen vor dem Hintergrund von Better Regulation in Deutschland. Nahezu alle EU- und OECD-Staaten betreiben heute umfassende politische Reformprogramme zur Modernisierung der Regulierungsarchitekturen, die unter dem Label Better Regulation subsumiert werden. Die Zielsetzung dieser Programme besteht zum einen in der wirtschaftsfreundlichen Reduktion von Regulierungskosten und zum anderen in der Effektivitätssteigerung von Regulierung durch Vermeidung unintendierter Nebeneffekte. Better Regulation ist ein Toolkit verschiedener metaregulativer Policy-Instrumente, deren programmatische Zusammensetzung vom nationalen politischen Kontext abhängt. Im Rahmen der parallel verlaufenden Reformagenden werden überdies alternative Regulierungsformen von verschiedenen Advokaten besserer Regulierung thematisiert, und als Alternative zur rein staatlichen, hierarchischen Command-and-Control-Regulierung (CaC-Regulierung) promotet, jedoch weder näher auf deren Bedingungen noch deren Konsequenzen einzugehen. Den optimistischen Vorstellungen eines evidenzbasierten Regulatory Managements folgend, erfolgt die Prüfung und Analyse alternativer Regelungsformen im Zuge der Gesetzesfolgenabschätzung (GFA; Regulatory Impact Assessment RIA). Bisher fristen alternative Regulierungsformen allerdings ein Dasein im Schatten von Standardkosten-Modell, RIA und Co. und werden von den Policy-Makern nicht systematisch in Betracht gezogen oder eingesetzt. CaC-Regulierung ist und bleibt das dominante Steuerungsinstrument des Staates. Es existieren jedoch zahlreiche diskursive Anknüpfungspunkte einschließlich zahlreicher Kritiken an der hierarchisch-regulativen Steuerung, welche die Auseinandersetzung mit alternativen Regulierungsformen begründen. Ziel dieses Papieres ist es daher, die in der Kritik stehende CaC-Regulierung Modellen alternativer Regulierungsformen entgegenzustellen, wobei alternative Regulierung mit den Konzepten Selbstregulierung, Koregulierung und regulierter Selbstregulierung eng definiert wird, und nur jene Konstellationen betrachtet werden, die kooperativ zwischen Regierung und Wirtschaft operieren. Ebenso wird der Versuch unternommen, die mannigfaltigen Konzepte und Erscheinungsformen alternativer Regulierung zu definieren und zu kategorisieren. Im Anschluss an den theoretischen Part erfolgt im nächsten Schritt die Identifikation der Einsatz- und Erfolgsbedingungen alternativer Regulierung. Dies geschieht anhand zweier empirischer Fallbeispiele aus den Politikfeldern Berufsbildungspolitik („der Ausbildungspakt der deutschen Wirtschaft“) sowie Umweltpolitik („die Mehrwegquotenverpflichtung“), wobei gezielt ein erfolgreiches und gescheitertes Beispiel alternativer Regulierung verglichen werden und Erfolgsfaktoren abgeleitet werden. Das Ergebnis ist, dass alternative Regulierung gewisse Potentiale und Anreize für staatliche wie privatwirtschaftliche Akteure bietet, aber der Einsatz dieser Steuerungsformen höchst voraussetzungsvoll ist und nur in wenigen Politikfeldern möglich und zu empfehlen ist. So besteht das Potential alternativer Regulierungsformen vor allem in der ganzheitlichen Senkung von Regulierungskosten (Befolgungs- und Vollzugskosten) und in der Erhöhung der Steuerbarkeit der Adressaten. Allerdings sind die korporativen Akteure auf beiden Seiten zum einen nicht immer hinreichend auf diese Form indirekter Steuerung vorbereitet. Zum anderen wird alternative Regulierung durch die Fragmentierung und Schwäche von Wirtschaftsverbänden sowie durch Interessengegensätze unter den Regelungsadressaten gehindert, die in Trittbrettfahrertum und dem letztlichen Scheitern selbstregulativer Verpflichtungen münden. Als entscheidende, aber anspruchsvolle Erfolgskomponente erweisen sich die politische Kommunikation und die Durchsetzbarkeit staatlicher Sanktionen sowie die Erfolgskontrolle, um die Regelungseinhaltung durch die Wirtschaft zu gewährleisten. Generell ist zu konstatieren, dass alternative Regulierungsformen dort zustande kommen, wo sich konzentrierter Widerstand auf Seiten der Adressaten gegen geplante, autoritative Steuerung abzeichnet, eine gewisse Pfadabhängigkeit bzw. eine Historie sektoraler Selbstregulierung vorliegt und eine Win-Win-Situation bei der Kooperation für Politik und Wirtschaft ersichtlich ist. In der Konsequenz zeigen die Ergebnisse, dass alternative Regulierung nicht nach einem synoptisch-rationalen Modell politischer Prozesse entsteht, sondern ein ursprünglich nicht intendiertes Produkt Garbage Can-artiger Verhandlungen mit einem hohen Konfliktniveau darstellt. Folglich ist das Resultat für die Vorstellung einer „Rational Regulatory Choice“ induzierenden Better Regulation-Agenda desillusionierend.

Zunehmend komplexe Herausforderungen und Aufgaben lassen sich nicht mehr mit den bisherigen Strukturen, Methoden und Prozessen der klassischen Verwaltung bewältigen. Vielmehr gewinnen Ansätze und Methoden des New Work im öffentlichen Sektor angesichts der sich stetig ändernden und dynamischen Arbeitswelt eine immer größere Bedeutung. Umso mehr besteht die Notwendigkeit, sich in der Verwaltung agil aufzustellen. Unter Agilität wird hierbei die Fähigkeit einer Organisation verstanden, sich schnell verändernden Rahmenbedingungen flexibel und dynamisch anzupassen.
Im Fokus dieser Arbeit steht der Einfluss von Agilität auf die Führungskräfte-Mitarbeiter-Beziehung. Mittels einer halbstandardisierten Online-Befragung im Landesamt für Flüchtlingsangelegenheiten und im Bezirksamt Neukölln von Berlin wird zunächst der vorliegende Agilitätsgrad mit dem Fokus auf agile Organisationsstrukturen, agile Organisationskultur und agile Führung ermittelt und sodann anhand der Qualität der dyadischen Arbeitsbeziehung von Führungskraft und Mitarbeiter (LMX-Qualität) überprüft, inwiefern die agile Arbeitsweise im Vergleich zu einer nicht-agilen Arbeitsumgebung die Beziehung beeinflusst.
Im Ergebnis der Untersuchung zeigt sich, dass ein positiver Zusammenhang zwischen Agilität und der Führungskräfte-Mitarbeiter-Beziehung besteht. Es stellt sich in beiden Ämtern ein mäßig bis starker Agilitätsgrad heraus, wobei besonders agile Führungseigenschaften zu den wesentlichen Faktoren zählen, die eine hochqualitative Beziehung begünstigen. Während im Bezirksamt ein Zusammenhang zwischen Agilität und hoher LMX-Qualität ermittelt wurde, konnte dieser nicht für die untersuchte Stichprobe des Landesamts festgestellt werden. Dennoch ließ sich in beiden Behörden ein positiver Einfluss von Agilität auf zumindest die Entwicklung einer erfolgreichen Führungskräfte-Mitarbeiter-Beziehung erfassen.

A growing number of local energy conflicts around wind power and power-grid extensions are slowing down the deployment of the German Energiewende. In this paper, a local conflict on wind energy in the state of Baden-Württemberg is analysed in detail. In the little community of Engelsbrand, local opposition against a planned wind park was able to turn around a set of favourable a priori conditions, such as a supporting state government planning process, a local supporter group, a transparent planning process, including a majority vote pro wind energy, and a round table discussion. Distancing itself from the NIMBY-explanation (‘Not In My Back Yard’), the paper applies insights from discourse network analysis and micro-sociology in order to study the local conflict dynamics. Special attention is given to the resource mobilisation strategies of the opponents, including social networks, mass and social media use. The paper ends by drawing some general conclusions for the German Energiewende.
This cumulative dissertation consists of five chapters. In terms of research content, my thesis can be divided into two parts. Part one examines local interactions and spillover effects between small regional governments using spatial econometric methods. The second part focuses on patterns within municipalities and inspects which institutions of citizen participation, elections and local petitions, influence local housing policies.
Developed countries have relied heavily on aid budgets to fulfill their pledges to boost funding for addressing climate change in developing countries. However, little is known about how interaction between aid and other ministries has shaped contributors' diverse approaches to climate finance. This paper investigates intra-governmental dynamics in decision-making on climate finance in seven contributor countries (Australia, Denmark, Germany, Japan, Switzerland, the UK, and the US). While aid agencies retained considerable control over implementation, environment and finance ministries have played an influential and often contrasting role on key policy issues, including distribution between mitigation and adaptation and among geographical regions. Accountability can be conceptualized as institutionalized mechanisms obliging actors to explain their conduct to different forums, which can pose questions and impose sanctions. This article analyses different crises' in immigration policies in Norway, Denmark and Germany along a descriptive framework of five different accountability types: political, administrative, legal, professional and social accountability. The exchanges of information, debate and their consequences between an actor and a forum are crucial to understanding how political-administrative action is carried out in critical situations. First, accountability dynamics emphasize conventional norms and values regarding policy change and, second, formal political responsibility does not necessarily lead to political consequences such as minister resignations in cases of misbehaviour. Consequences strongly depend on how accountability dynamics take place.

The present work is a case study contributing to the major planning project “Suedlink”. It is structured as follows: first, in a theoretical part, mandatory theories of social acceptance (Wüstenhagen et al., 2007), steps of participation (Münnich, 2014), and the governance theory (Benz and Dose, 2011) are elaborated. Secondly, the relevant methods are discussed. Thirdly, in a qualitative analytical part, the information that were gathered from the expert interviews are analyzed with the use of the aforementioned theories. In the fourth place, an empirical quantitative analysis of data regarding the public acceptance towards Suedlink is presented.
In this case study, with the use of qualitative and quantitative methods, two questions are answered: first, which governance aspects were relevant for the priority use of underground cables for the construction of high voltage direct current transmission lines? For this question, intensive document analysis and different expert interviews were conducted. Secondly, the central question of the present work addresses the question whether local or/and individual factors affect the public acceptance towards SüdLink. Here, in particular, it is interesting to analyze if the priority use of underground cables affected the people’s acceptance towards SuedLink. In order to respond to both questions, an online survey was conducted among citizen initiatives, district administrators, and individuals in social media during March till July 2016. Thereafter, the data was analyzed with the use of descriptive quantitative methods. The data shows, that underground cables not necessarily increase public acceptance (see also Menges and Beyer, 2013). On the contrary, individual and local criteria were relevant for the survey respondents. For example criteria such as the quality of participation, distance between home and transmission lines, and the additional financial burden (taxes, higher prices for electricity) were important for the evaluation. In addition, survey respondents who participated in citizen initiatives were more critical against the priority use of underground cables and SuedLink in general. Likewise, residential homeowners rejected every form of transmission lines.
Previous studies on the electoral fortunes of extreme right parties (ERPs) have pointed to the importance of variables of party competition for the success - or failure - of ERPs. These studies vary greatly when it comes to describing the political opportunity structure of the extreme right. Apart from their methodological differences, existing studies differ especially with regard to the assumed underlying dimension of party competition. This article tests the impact of three frequently discussed variables in the political opportunity structure of ERPs (mainstream party convergence, position of the established right and party system polarisation) on the vote share of ERPs in Western Europe. In addition to examining previous studies in this field, it focuses on the interplay between the economic and the cultural dimensions as part of the political opportunity structure. The authors show that a decrease in polarisation with regard to economic questions is accompanied by a growing salience of ERPs' core issues, leading in the end to an increase in ERPs' vote share.
The German Sonderweg thesis has been discarded in most research fields. Yet in regards to the military, things differ: all conflicts before the Second World War are interpreted as prelude to the war of extermination between 1939-1945. This article specifically looks at the Franco-Prussian War 1870-71 and German behaviour vis-a-vis regular combatants, civilians and irregular guerrilla fighters, the so-called francs-tireurs. The author argues that the counter-measures were not exceptional for nineteenth century warfare and also shows how selective reading of the existing secondary literature has distorted our view on the war.
A decade into the proclaimed "global war on terror," states are still struggling with the phenomenon's locus and definition under the effective laws. Remarkably, preventive detention of suspected terrorists fluctuates between various legal regimes: In Europe, criminal law is predominantly used but special security orders are occasionally issued as well; Israel applies in part the law of international armed conflicts; and in the United States, detention under a new war premise has been claimed.
This Article analyzes the response of the U.S. Supreme Court, the Israeli Supreme Court, and the European Court of Human Rights to legislative and executive policies asserting the power of preventive detention in the aftermath of September 11, 2001. The comparison exposes significant differences with regard to the application of international law, and most prominently concerning the underlying question of whether the struggle against terrorism should be considered a "war," or, perhaps more traditionally, a fight against crime.
Despite the substantial discrepancies in these three jurisdictions, this Article argues that the similarities are actually more striking. Whereas no court has accepted any attempt to fight terrorism outside the bounds of law, the judges have not hesitated to stretch and blur the pertinent frameworks by extensive interpretation. Ultimately, it is questionable whether on account of the individual's rights the resulting flexibilities and uncertainties are justifiable.

This note presents results from an experiment studying a two person 4 4 pure coordination game. We explore different strategy labels in an attempt to implement the mixed strategy equilibrium that selects all four strategies with equal probability. Such strategy labels must be free from salient properties that might be used by participants to coordinate. Testing 23 different sets of strategy labels, we identify two sets that produce a distribution of subjects' choices which approximate the uniform distribution quite well. Our results are relevant for studies intending to compare the behavior of subjects who play against a random mechanism with that of participants who play against human counterparts.
Happiness as the ultimate goal of human endeavour is a thread running through theology and philosophy from the ancient Greeks to modern times. Such a claim raises immediately a host of critical objections and problems relating to the idea of cultural relativism. Can the theme of happiness be continuous and how would we know that? One way to overcome this dilemma is to identify ‘regimes of happiness’ – that is, clusters of ideas, practices and institutions that in one way or another connect to broad ideas of human wellbeing, flourishing and satisfaction or Eudaimonia to use the word that dominates Aristotle's Nicomachean Ethics (Contreras- Vejar and Turner, 2018). Contemporary discussions of happiness almost invariably start with Aristotle (Nagel, 1972). However, the methodology here is to some extent borrowed from Michel Foucault to understand the ‘genealogy’ of happiness across different social and cultural formations. In the Western world one could identify an Aristotelian regime of happiness based on the idea of a sound polity and flourishing citizens. There is also a Christian regime of happiness around such figures as St. Augustine and within which there have been radical shifts most notably brought about by Luther and the Protestant Reformation. Regimes of happiness can overlap with each other and their borders are obviously fuzzy. Some regimes may last a long time in various forms. For example, Aristotle's treatment of happiness is one of the most cited versions of happiness across the West. The idea of happiness is, however, not confined to the West. For example, the Vietnamese Constitution that was devised by Ho Chi Minh, an admirer of America society, crafted the 1945 Constitution with three key words as its primary values – Independence–freedom–happiness (or niem hanh phuc). The 2013 version of the Constitution in Article 3 says, ‘The state guarantees […] that people enjoy what is abundant and free for a happy life with conditions for all- round development.’
One further notion behind our discussion of ‘regimes of happiness’ is that in principle we can detect important shifts in regimes that are associated both with specific networks of individual thinkers, and with institutional changes in the location of intellectuals in these networks. In this chapter I am especially interested in the transitions in thinking about happiness from the late eighteenth century and through the nineteenth century.
A new political system model

Semi-parliamentary government is a distinct executive-legislative system that mirrors semi-presidentialism. It exists when the legislature is divided into two equally legitimate parts, only one of which can dismiss the prime minister in a no-confidence vote. This system has distinct advantages over pure parliamentary and presidential systems: it establishes a branch-based separation of powers and can balance the ‘majoritarian’ and ‘proportional’ visions of democracy without concentrating executive power in a single individual. This article analyses bicameral versions of semi-parliamentary government in Australia and Japan, and compares empirical patterns of democracy in the Australian Commonwealth as well as New South Wales to 20 advanced parliamentary and semi-presidential systems. It discusses new semi-parliamentary designs, some of which do not require formal bicameralism, and pays special attention to semi-parliamentary options for democratising the European Union.
Despite the fact that development aid has broadened from economic growth theory to include human and social capital, there is a lack of a general agreement as to its benefits. This critical review and analyses of the development aid academic and institutional discourse identifies some major shortcomings. The dominance of economics at the expense of politics, and the imposition of development aid neoliberal conditionalities act as barriers to socio-economic development in aid recipient countries. An inference is offered to recast development aid through reconciliation within critical frameworks of different sides of the political spectrum.

Zur Jahreswende 1959/60 sorgten Hakenkreuzschmierereien an jüdischen Einrichtungen in Köln und anderswo für Entsetzen und Empörung. Diese Vorkommnisse machten bewusst, was im Verlauf der 1960er Jahre zu einem Politikum für die jüngere Generation werden sollte: Die mangelnde Aufarbeitung der nationalsozialistischen Vergangenheit. Cross-dressing took on new political meanings in Germany's Weimar Republic, with the emergence of organizations and periodicals aimed at promoting the interests of self-identified "transvestites." This new sexological category, developed by Magnus Hirschfeld in 1910, formed the basis for a shared sense of identity and belonging among individuals who identified as members of the "opposite" sex. Drawing on the experiences of the homosexual emancipation movement and discourses of bourgeois respectability, middle-class transvestites came together to demand legal and social recognition, including acknowledgement of "transsexual" desires. Their efforts represent a critical but forgotten moment in the history of transgender political activism.
New forms of communication and greater accessibility of Islamic texts on-line allow Muslims to shape their own religiosity, to become less dependent on established sources of authority, and thereby to become more aware of their own cultural diversity as a community. New practices of transnational Islam, and the growth of new concepts of Muslim identities currently emerging in the on-line community, are relatively free from immediate constraints. This article provides the result of a sociological analysis of three Internet sites in Sydney which deliver on-line fatwas. Even if cyberspace has allowed the Muslim world to be de-territorialised and provides a way for people to distance themselves from traditional communities if they wish, this research points out a variety of approaches, including one case which is aiming at re-localising an Australian Muslim system of values. This case highlights ways in which first generation Muslims are re-territorialising Shari'a in a specific western country.
