Während zur Geschichte des Strafrechts in der alten Bundesrepublik bislang lediglich überblicksartige Gesamtdarstellungen und Monographien zu einzelnen Deliktsbereichen existierten, nimmt dieser Band einige prägnante Facetten des Besonderen Teils detailreich in den Blick und setzt damit das Projekt fort, das die Herausgeber 2020 mit dem bereits erschienenen Band zum Allgemeinen Teil begonnen haben. Auch hier interessieren die einzelnen Teilbereiche weniger dogmengeschichtlich als in ihrer Interaktion mit der Strafrechtswissenschaft, -praxis, -politik und gesellschaftlichen Veränderungen. Die individuellen Zugänge, die die Autorinnen und Autoren hierzu gesucht haben, sollen in ihrer methodischen Vielfalt durchaus als Experiment verstanden werden.

Der „Rechtsfolgen der Tat“ (§§ 38–76b StGB) sind ein vergleichsweise wenig erforschtes Feld des Allgemeinen Teils und dabei enorm facettenreich sowie praxisrelevant. Zu diesem Thema diskutieren neun Strafrechtshabilitand:innen aktuelle Fragen aus dogmatischer, kriminologischer oder kriminalpolitischer Sicht.
Die Beiträge behandeln die Gesamtstrafe (Bechtel), das Verbandssanktionenrecht (Großmann), die Systematik des § 46 StGB (Lenk), die Tagessatzhöhe bei Vermögenslosen und sehr Vermögenden (Li), die elektronische Fußfessel (Peters), strafmildernde Umstände bei Beziehungstaten (Preuß), die Strafzumessung in Steuerstrafsachen (Ruppert), die Vermögensabschöpfung (Schweiger) und die Strafmilderung beim Versuch (Stam).

Verfahrensrechtliche Klausuren sind häufig Gegenstand des Pflichtfachstudiums, vor allem aber auch im Schwerpunktbereichsstudium Zivilrechtspflege. Das Buch zeichnet die Wandlungen des Zusammenspiels zwischen Strafrecht und Gesellschaft vom Frühmittelalter bis 1990 nach. Akzentuiert wird das 20. Jahrhundert, namentlich das dem Terror unterstellte NS-Strafrecht, das sozialistische Umerziehungsstrafrecht der DDR und die bundesdeutsche NS-Aufarbeitung. Zielgruppe sind Jurastudierende sowie jeder interessierte Leser.
