Behandelte Themen sind: 1. Menschenrechte gelten während bewaffneter Konflikte grund sätzlich fort. Sie gelten damit gleichzeitig und nicht alternativ zum humanitären Völker recht. 2. Hoheitsgewalt und damit die Anwendbarkeit der genannten Menschen rechts verträge kann grundsätzlich auch bei Kampfeinsätzen vorliegen. 3. Das Verhältnis beider Rechtsgebiete ist eines wechselseitiger Ergänzung. 4. Mögliche Widersprüche zwischen den beiden Rechtsgebieten können überwiegend durch Auslegung oder mittels vorhandener Notstands klauseln ausge räumt werden. 5. Können Widersprüche nicht durch Auslegung oder Derogation ausgeräumt werden, gehen im Einzelfall die Normen des humanitären Völkerrechts als speziellere vor (lex specialis derogat legi ge nerali). 6. Die komplexe und umfangreiche Materie beider Rechtsgebiete läßt sich auf ein solches „Destillat“( bringen, das sich in Ausbildung und Training ver mitteln läßt und auch für die sich im Feld oder auf See befindlichen Truppen praktikabel ist.

Das vorliegende Handbuch bietet vertiefende Informationen zur Individualbeschwerde nach dem Fakultativprotokoll zum Internationalen Pakt über bürgerliche und politische Rechte. Das Handbuch richtet sich in erster Linie an Praktiker/innen, die in ihrer Arbeit mit Menschenrechtsverletzungen konfrontiert sind, insbesondere Rechtsanwälte und Rechtsanwältinnen sowie Menschenrechtsorganisationen. In umfassender, aber komprimierter Form gibt es zuverlässige Hilfestellung bei der Einlegung einer Beschwerde. Dieser Beitrag gibt einen Überblick über die Arbeit der Vertragsüberwachungsorgane von sechs der auf der Ebene der Vereinten Nationen (UN) verabschiedeten Menschenrechtsverträge im Jahre 2006. Nicht eingeschlossen ist die Arbeit des Menschenrechtsausschusses, der über die Einhaltung der Verpflichtungen aus dem Internationalen Pakt über bürgerliche und politische Rechte1 (Zivilpakt) wacht. Über seine Tätigkeit wird in den Ausgaben des nächsten Jahrgangs des MenschenRechtsMagazins berichtet. Der vorliegende Überblick beruht auf den bereits veröffentlichten Dokumenten der jeweiligen Ausschüsse und den Informationen des Büros der Hohen Kommissarin der Vereinten Nationen für Menschenrechte (OHCHR).
