Wilhelm von Humboldts 'Ideen zu einem Versuch die Grenzen der Wirksamkeit des Staats zu bestimmen' sind hierzulande erst in jüngerer Zeit verstärkt rezipiert worden, obwohl sie seit jeher zu den klassischen Schriften des politischen Liberalismus zählen. Humboldts Ideen haben insbesondere John Stuart Mill bei seinem Essay über die Freiheit maßgeblich beeinflusst. Die vorliegende Schrift unternimmt daher nicht nur den Versuch einer rechtsphilosophischen Einordnung, sondern stellt auch Bezüge zur angloamerikanischen Rechtsphilosophie dar.
Albert Hirschman hat sein schmales, aber überaus gehaltvolles Werk über ‚Leidenschaften und Interessen‘ mit einer nachdenkenswerten Bemerkung beschlossen, die veranschaulicht, warum die Beschäftigung mit der Ideen- und Geistesgeschichte auch aus heutiger Sicht noch lohnenswert ist: „Das ist wohl das einzige, was man vom Studium der Geschichte, insbesondere der Theorie- und Geistesgeschichte erwarten darf: Nicht, dass die Streitfragen entschieden, sondern dass das Niveau der Auseinandersetzung über sie gehoben wird.“
Die im vorliegenden Band abgedruckten Beiträge wurden in den 25 Jahren zwischen 1997 und 2022 in unterschiedlichen Zeit- und Festschriften veröffentlicht und für die vorliegende Zusammenstellung behutsam überarbeitet.
Die vorliegende Abhandlung bereitet erstmals systematisch das Verhältnis von Rechtsordnung und Wirtschaftsordnung nach der Theorie der Interdependenz der Ordnungen von Walter Eucken auf.
Die meisten Juristen werden Walter Eucke noch mit dem Ordoliberalismus in Verbindung bringen, manche der Freiburger Schule zuordnen, die wenigsten jedoch seine 'Grundsätze der Wirtschaftspolitik' oder gar seine juristisch nicht minder gehaltvollen 'Grundlagen der Nationalökonomie' gelesen haben. Gerade die ersteren jedoch – sein nachgelassenes Hauptwerk – bilden nicht nur für Ökonomen, sondern auch für Juristen eine überaus anregende Lektüre.
Jedem Juristen, vor allem jedem Wirtschaftsrechtler, sollte eine beiläufige Beobachtung zu denken geben, die Walter Eucken in seinen 'Grundlagen der Nationalökonomie' angestellt hat: „Werden der Wissenschaft in zwei Jahrtausenden nur unsere wichtigsten Rechtsnormen bekannt sein, so wird sie von unserer Wirtschaftsordnung kein wirkliches Bild gewinnen".
