Der Bereich der grenzüberschreitenden Daseinsvorsorge ist eines der zentralen Potentialfelder in der Grenzüberschreitenden Zusammenarbeit. Grenzüberschreitende Daseinsvorsorge kann ein wesentliches Element zur Verbesserung der Lebensverhältnisse in Grenzregionen sein.
Bei der Umsetzung von Projekten im diesem Bereich sind – sofern der politische Wille hierfür vorhanden ist – erhebliche rechtliche Hürden zu überwinden: Zwar existieren passend ausgerichtete europäische Fördermittelprogramme als Anreiz, andererseits scheinen die europarechtlichen und nationalrechtlichen Rahmenbedingungen vielfach hochgradig komplex und können auch mit europarechtlichen Instrumenten, etwa dem Europäischen Verbund für territoriale Zusammenarbeit (EVTZ), kaum überwunden werden.
Der vorliegende Text analysiert am Beispiel der deutsch-polnischen die rechtlichen Schwierigkeiten, aber auch die Möglichkeiten zur Umsetzung grenzüberschreitender Projekte in diesem Bereich.
Alexander von Humboldt war in Polen bereits im ausgehenden 18. Jahrhundert berühmt geworden. Er reiste mehrmals nach Polen und unterhielt Kontakte zu polnischen oder polnischstämmigen Wissenschaftlern. Aus den 30er und 40er Jahren stammen die meisten schriftlichen Belege, die von Beziehungen Humboldts zu solchen Persönlichkeiten wie Ludwik Zejszner, Józef Waraszkiewicz oder Filip Neryusz Walter zeugen. Nicht nachweisbar ist heute dafür Humboldts Kontakt zu Wincenty Pol sowie zu Ignacy Domeyko. Humboldt inspiriert nicht nur polnische Wissenschaftler, sondern auch führende polnische Dichter der Romantik. Viele polnische Exilanten verdanken dem deutschen Gelehrten wertvolle Kontakte, Empfehlungsschreiben und Gesuche bei damaligen Machthabern.
Polens Sicht auf die Ukrainekrise ist von dessen geopolitischer Lage geprägt. Als Teil der EU und NATO grenzt das Land unmittelbar an die Krisenregion. Sowohl die Parteien als auch die öffentliche Meinung in Polen verteidigen übereinstimmend die territoriale Integrität der Ukraine und halten deren staatliche Unabhängigkeit für einen unentbehrlichen Faktor der politischen Ordnung in Europa. Vor allem die Frage nach den künftigen Möglichkeiten einer weiteren Ostausdehnung der EU steht daher aus Warschauer Sicht auf der Agenda.
Das wichtigste Motiv des polnischen Diskurses zur wirtschaftlichen Zukunft der Europäischen Union bleibt zweifelsohne die Übernahme des Euro, wozu sich Polen im Jahr 2004 bei seinem EU-Beitritt verpflichtet hat.1 Der Beitritt zur letzten Etappe der Wirtschafts- und Währungsunion bringt zahlreiche Vorteile mit sich, ist aber auch mit Kosten verbunden.
Polen trat am 1. Mai 2004 der Europäischen Union bei. Artikel 4 der Akte über die Bedingungen des Beitritts bestimmt, dass jeder neue Mitgliedstaat ab dem Tag seines Beitritts als Mitgliedstaat, für den eine Ausnahmeregelung im Sinne des Artikels 139 AEUV1 gilt, an der Wirtschafts- und Währungsunion teilnimmt. Das bedeutet für Polen langfristig die Notwendigkeit, die Gemeinschaftswährung Euro zu übernehmen.
In Meinungsumfragen äußern zwei Drittel der Polen ihre Angst vor einem Beitritt ihres Landes zur Eurozone. Die damit verbundenen Befürchtungen sind vielfältig und durch die europäische Wirtschaftskrise noch verstärkt worden. Allerdings hat sich Polen im EU-Beitrittsvertrag zur Mitgliedschaft in der Eurozone verpflichtet, sobald die entsprechenden Voraussetzungen vorliegen.
