Behandelte Themen sind: 1. Menschenrechte gelten während bewaffneter Konflikte grund sätzlich fort. Sie gelten damit gleichzeitig und nicht alternativ zum humanitären Völker recht. 2. Hoheitsgewalt und damit die Anwendbarkeit der genannten Menschen rechts verträge kann grundsätzlich auch bei Kampfeinsätzen vorliegen. 3. Das Verhältnis beider Rechtsgebiete ist eines wechselseitiger Ergänzung. 4. Mögliche Widersprüche zwischen den beiden Rechtsgebieten können überwiegend durch Auslegung oder mittels vorhandener Notstands klauseln ausge räumt werden. 5. Können Widersprüche nicht durch Auslegung oder Derogation ausgeräumt werden, gehen im Einzelfall die Normen des humanitären Völkerrechts als speziellere vor (lex specialis derogat legi ge nerali). 6. Die komplexe und umfangreiche Materie beider Rechtsgebiete läßt sich auf ein solches „Destillat“( bringen, das sich in Ausbildung und Training ver mitteln läßt und auch für die sich im Feld oder auf See befindlichen Truppen praktikabel ist.
Das vorliegende Heft 13 der Reihe Studien zu Grund- und Menschenrechten enthält die überarbeitete Fassung einer Arbeit, die der Autor im Jahr 2005 für das Deutsche Institut für Menschenrechte erstellt hat. Im Vordergrund stand dabei die Frage, inwiefern das Verhältnis zwischen Menschenrechten und humanitärem Völkerrecht geklärt ist oder ob es noch weiteren Klärungsbedarf hierzu gibt. Der Autor kommt zu dem Ergebnis, dass das Verhältnis im Einzelnen und viele der damit zusammenhängenden Fragen weiterhin kontrovers diskutiert werden und ein Abschluss dieser Diskussion derzeit nicht absehbar ist. Die Studie fasst die Hauptproblemfelder des Verhältnisses dieser beiden Rechtsgebiete, einschließlich der Frage der exterritorialen Geltung von Menschenrechtsverträgen, in sehr gelungener Weise zusammen und weist auf weitere wichtige Fragen hin. Wir freuen uns, dass es möglich ist, diese wichtige Studie in der Schriftenreihe des MenschenRechtsZentrums der Universität Potsdam, an dem der Verfasser derzeit tätig ist, publizieren zu können.
Aus dem Vorwort: Vor wenigen Wochen ist im Heft 13 der „Studien zu Grund- und Menschenrechten“ eine Arbeit von Herrn Schäfer mit dem Titel „Zum Verhältnis Menschenrechte und humanitäres Völkerrecht“ erschienen. Wir haben inzwischen nicht nur zahlreiche faktische Situationen, in denen dieses Verhältnis von Menschenrechten und humanitärem Völkerrecht relevant ist, sondern es gibt zunehmende Äußerungen rechtlicher Instanzen (Internationaler Gerichtshof, Jugoslawien-Tribunal, Menschenrechtsausschüsse), die sich diesem Problem gewidmet haben, von Stimmen aus der Wissenschaft ganz zu schweigen. Herr Schäfer wird versuchen, eine Zwischenbilanz zu ziehen. In vielen Fällen, nämlich stets bei Auslandseinsätzen von Streitkräften, hängt die Frage, wie das Verhalten von Menschenrechten zu Regeln des humanitären Völkerrechts zu beurteilen ist, auch davon ab, ob die menschenrechtlichen Verpflichtungen eines Staates ihn auch dann begleiten, wenn er außerhalb seines Territoriums agiert. Herr Dr. Weingärtner wird sich dieser zentralen Frage stellen, die nicht erst, aber vor allem auch nach der Banković- Entscheidung des Europäischen Gerichtshofs für Menschenrechte aus dem Jahr 2001 vielfach erörtert wird. Die Bundesrepublik Deutschland selbst wurde etwa vom Menschenrechtsausschuß der Vereinten Nationen bei der Diskussion ihres letzten periodischen Berichts mit dieser Frage direkt konfrontiert. An die Einsätze in Afghanistan, Kongo und nun auch vor der libanesischen Küste ist zu erinnern. Gern nehme ich diesen Zusammenhang zum Anlaß, auch auf die Arbeit von Dirk Lorenz „Der territoriale Anwendungsbereich der Grund- und Menschenrechte“ hinzuweisen, die im Jahr 2005 als Band 25 in der vom MRZ herausgegebenen Schriftenreihe erschienen ist. Frau PD Dr. Schmahl behandelt ein Thema, das im engen Zusammenhang mit den beiden vorangegangenen steht. Können Menschenrechtsverletzungen oder Verletzungen von Normen des humanitären Völkerrechts zu individuellen Schadenersatzansprüchen führen? Stichworte wie Zwangsarbeiter, Distomo und vor allem – da die Nachkriegszeit betreffend – Varvarin verweisen auf die gerade auch Deutschland angehende Brisanz dieser Problematik. <img src="http://vg00.met.vgwort.de/na/74333508f5104deb4553" width="1" height="1" alt="">
Gaza und das Völkerrecht

Ist Israel eine Besatzungsmacht und haben die Palästinenser ein Recht auf Widerstand? Politische Debatten über den Nahen Osten sind zahlreich. Doch wie sieht die juristische Dimension aus? Der Rechtswissenschaftler Norman Paech untersucht den Konflikt in Gaza mit Blick auf die völkerrechtliche Legitimation Israels, Krieg zu führen, und auf das international geltende Recht während kriegerischer Auseinandersetzungen.
Der Staat im Recht – getragen vom und gebunden durch das Recht, orientiert an Gemeinwohl und Individualrechten gleichermaßen – ist Gegenstand und Ziel des wissenschaftlichen Wirkens von Eckart Klein.
Eckart Klein, dessen 70. Geburtstag Anlass zu dieser Festschrift ist, hat sich als Rechtswissenschaftler dem Öffentlichen Recht in seiner ganzen Bandbreite gewidmet, wobei die Tätigkeit am Heidelberger Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht und die Zeit als wissenschaftlicher Mitarbeiter am Bundesverfassungsgericht seine Interessen nachhaltig geprägt und fokussiert haben. Wichtige Themen seiner Publikationstätigkeit während seiner gesamten wissenschaftlichen Laufbahn sind dementsprechend das Verfassungsprozessrecht, das allgemeine Völkerrecht, das Recht der internationalen Organisationen und der internationale Menschenrechtsschutz.
Nach einer Station an der Johannes Gutenberg-Universität in Mainz wechselte er an die Universität Potsdam. Hier gründete er auch das MenschenRechtsZentrum der Universität Potsdam, dem er als Direktor vorstand. Der Jurist ergänzte seine Tätigkeit als Hochschullehrer durch die Wahrnehmung von Richterämtern an den Oberverwaltungsgerichten in Koblenz und Frankfurt (Oder) sowie am Staatsgerichtshof in Bremen. Außerdem war er Mitglied des Menschenrechtsausschusses der Vereinten Nationen und wirkte mehrfach als deutscher Ad-hoc-Richter an Verfahren vor dem Europäischen Gerichtshof für Menschenrechte mit. Dass bei alldem die akademische Lehre nicht zu kurz kam, war für Eckart Klein oberstes Gebot.
Schüler und Weggefährten haben in dieser Festschrift Beiträge aus den Bereichen des Völkerrechts, des Europarechts und des nationalen Rechts versammelt, um die Position des Staates im Recht aus unterschiedlichen Blickwinkeln auszuloten, Grenzen staatlichen Handelns zu markieren und nach Maßstäben für hoheitliche Entscheidungen zu fragen.
Heute sind die Themen Frauen und Frieden auf der Ebene der Sicherheitspolitik der Vereinten Nationen als Resultat von Resolution 1325 (2000) eng miteinander verbunden. Welche rechtlichen und tatsächlichen Konsequenzen haben sich aus dieser Entwicklung einerseits für die Arbeit der Vereinten Nationen selbst, andererseits für die Mitgliedstaaten ergeben und wie steht es um ihre Umsetzung? Die Studie zeichnet die WPS-Agenda nach und diskutiert die diesbezüglichen Aktivitäten der Vereinten Nationen. Die Umsetzungsmaßnahmen Deutschlands werden im Anschluss untersucht und bewertet.
Since 2015, the European Union has struggled to deal with the influx of refugees coming into its territories. The number of institutions involved in designing a competent response approach, com-bined with the unilateral and uncoordinated state reactions, have left unclear where to look for when searching for answers and new alternatives. Can the United Nations High Commissioner for Refugees (UNHCR) take a leading role in solving this and future crises? After a brief recapitulation of the crisis, an analysis of UNHCR’s statue, relationship to international law, and doctrine will put this question to the test while exploring options that are not only available but also feasible in a system where politics trump both legality and morality. If UNHCR is to play an active role in fu-ture refugee policies and become the lead agency it once was, a new daring and innovative approach has to emerge in order to readapt to the power relations that prevail in the twenty-first century.
