Online-Nutzer begegnen regelmäßig unterschwelligen manipulativen Designstrategien von Anbietern digitaler Produkte, welche sie zu rechtsgeschäftlich relevanten Entscheidungen bewegen sollen, die sie womöglich nicht - oder zumindest nicht so - beabsichtigt haben. Man spricht in diesem Zusammenhang von (vielgestaltig denkbaren) „Dark Patterns“ (dt. „dunkle Muster“). Der Beitrag geht der Frage nach, inwiefern diese insbesondere lauterkeitsrechtlich zulässig sind.
Wie ist der „gute Ruf“ von Unternehmen und Einzelpersonen im Umfeld von Online-Bewertungsplattformen geschützt? Das Werk erforscht, ob und inwieweit das geltende Recht einen adäquaten und lückenlosen Schutz für die unternehmerische und personelle Reputation gewährleitstet. Die Systematisierung und Untersuchung des bestehenden Regelungsgefüges konzentriert sich auf das Lauterkeitsrecht und das allgemeine Deliktsrecht unter besonderer Berücksichtigung der rechtlichen Innovationen auf nationaler (UWG-Reform 2022) und europäischer (New Deal for Consumers, Digital Services Act) Ebene.
Die Dissertation wurde für den ›Justizpreis Berlin-Brandenburg – Carl Gottlieb Svarez 2024‹ vorgeschlagen.
Am 23. und 24. Juni 2023 fand die 8. Tagung der „GRUR Junge Wissenschaft – Kolloquium zum Gewerblichen Rechtsschutz, Urheber- und Medienrecht“ zum Thema „Plattformen – Grundlagen und Neuordnung des Rechts digitaler Plattformen“ in Potsdam statt. Die Organisatorinnen und Organisatoren, Prof. Dr. Johannes Buchheim (Phillips-Universität Marburg), Dr. Victoria Kraetzig (Goethe-Universität Frankfurt/M.), Prof. Dr. Juliane Mendelsohn (Technische Universität Ilmenau) und Prof. Dr. Björn Steinrötter (Universität Potsdam) begrüßten die rund 120 Teilnehmerinnen und Teilnehmer in den Räumlichkeiten der Universität Potsdam am Campus Griebnitzsee.

Die Anforderungen an Unternehmen, die Waren als Hersteller produzieren, importieren oder auf dem Markt bereitstellen, werden immer komplexer. Sie müssen nicht nur Rechtsvorschriften einhalten, sondern auch zahlreiche produktrelevante und technische Vorgaben beachten. Product Compliance ist damit zu einer grundlegenden Aufgabe produzierender Betriebe, importierender Unternehmen und von Händlern geworden. Die Schriftenreihe „Product Compliance“ nimmt sich der produktrechtlichen Fragestellungen rechtsgebietsübergreifend an und dient als Forum für herausragende Monographien und Sammelbände.
Aktenvortrag – Zivilrecht

In materieller Hinsicht ist in diesem Aktenvortrag der praxisgerechte Umgang mit dem Deliktsrecht und dem zivilrechtlichen Nachbarrecht zu bewerkstelligen. Prozessual bietet der Sachverhalt Möglichkeit zur Bearbeitung examensklassischer Problemkreise. Es handelt sich um eine sehr umfangreiche Aufgabe. Um die vorgegebene Bearbeitungszeit einzuhalten, kann der Vortrag kaum in allen Punkten so ausführlich gehalten werden wie die hier vorgeschlagene Lösung. Das wird aber für eine gute Bewertung auch nicht erforderlich sein. Vielmehr kommt es, wie stets, auf eine überzeugende Schwerpunktsetzung an.
Jan Ole Flindt befasst sich mit Fallkonstellationen, in denen ein rechtlich unzutreffender Name tatsächlich geführt oder eine unwirksame Ehe oder ein rechtlich nicht bestehendes Eltern-Kind-Verhältnis wirklich gelebt wird. Im Mittelpunkt der Untersuchung steht die Frage nach Bestand und Reichweite von Vertrauensschutz im deutschen statusorientierten Recht. Statusrecht und Vertrauensschutzgedanke werden zunächst grundlegend beleuchtet, bevor der Autor das einschlägige Fallmaterial systematisch aufbereitet und punktuell bestehende Lösungsansätze des geltenden Rechts zusammenträgt. Letztere reichen von einer statusrechtlichen Heilung über einen (partiellen) schuldrechtlichen Ausgleich bis hin zu einer Versagung jeglichen Vertrauensschutzes. Die Dekonstruktion der Lösungsansätze offenbart statusübergreifende Gemeinsamkeiten, aber auch methodische Schwächen und unbillige Ergebnisse im Einzelfall. Dies nimmt Jan Ole Flindt zum Anlass, einen statusübergreifenden Heilungsansatz im Sinne einer allgemeinen Statusersitzung zur Diskussion zu stellen.

Art. 1 Abs. 2 Buchst. b der RL 93/83/EWG des Rates vom 27. September 1993 zur Koordinierung bestimmter urheber- und leistungsschutzrechtlicher Vorschriften betreffend Satellitenrundfunk und Kabelweiterverbreitung ist dahin auszulegen, dass ein Satellitenbouquet-Anbieter, der verpflichtet ist, für eine Handlung in Form der öffentlichen Wiedergabe über Satellit, an der er mitwirkt, die Zustimmung der Inhaber der betreffenden Urheberrechte und verwandten Schutzrechte einzuholen, diese Zustimmung – entsprechend der dem betreffenden Sendeunternehmen erteilten Zustimmung – nur in dem Mitgliedstaat einholen muss, in dem die programmtragenden Signale in die zum Satelliten führende Kommunikationskette eingegeben werden.
1. Es ist zweifelhaft, ob die Dateien, die beim Abrufen einer Internetseite an den Nutzer übermittelt werden, Computerprogramme im Sinne von § URHG § 69a UrhG sind.
2. Bei Nutzung eines Adblockers erfolgt keine unberechtigte Vervielfältigung im Sinne von § URHG § 69c Nr. URHG § 69C Nummer 1 UrhG, da die HTML-Dateien und weitere Elemente mit Zustimmung des Seitenbetreibers in den Arbeitsspeicher des Nutzer geladen werden.
3. Bei Nutzung eines Adblockers erfolgt auch keine Umarbeitung der im Arbeitsspeicher gespeicherten Daten, da der Adblocker lediglich Auswirkungen auf den Programmablauf hat, nicht aber in die Programmsubstanz eingreift. (Leitsätze der Redaktion)
Verträge über nicht-personenbezogene Daten werden seit dem Data Act immer wichtiger. Gleichwohl ist deren rechtliche Qualifikation immer noch nicht abschließend geklärt. Auch wenn klar ist, dass Daten in aller Regel keinem geistigen Eigentumsrecht unterliegen, nur in seltenen Fällen Know-how sind und an ihnen kein Sacheigentum bestehen kann, benötigen die Verträge eine hinreichende rechtliche Grundlage ihres Gegenstands. Der Beitrag plädiert für eine geringfügige Anpassung, jedenfalls in der Technologiegruppenfreistellungsverordnung.
Künstliche Intelligenz (KI) und Robotik sind in aller Munde. Dabei erscheinen manche der diskutierten Anwendungsfälle noch als reine Theorie. Anders ist dies in der Medizin. Das Werk befasst sich mit den drängendsten juristischen Fragen, blickt dabei aber auch über den Tellerrand, indem medizinisch-technische sowie ethisch-philosophische Aspekte nicht ausgeklammert bleiben.
Der Data Act

Der Data Act bildet den vorläufigen Schlussstein der EU-Datenregulierung. Die verschiedenen Instrumente der Verordnung tarieren vor allem die Beziehungen der Datenökonomie mit Datenzugangsrechten, weitreichenden Regelungen zu Datenverträgen und Cloud-Services sowie mit spezifischen Interoperabilitätsvorgaben neu aus. Der Beitrag gibt – mit einem Schwerpunkt im Datenwirtschaftsrecht – einen Überblick über die Neuregelungen, zeigt übergreifende Weichenstellungen auf und benennt strukturelle Herausforderungen.
