Der bislang in Deutschland und Frankreich sowie auf EU-Ebene geltende Rechtsrahmen ist grundsätzlich geeignet, um den Besonderheiten der Digitalwirtschaft Rechnung tragen zu können. Legislatives Handeln scheint insbesondere dort sinnvoll, wo es zur Effektivierung der Durchsetzung des bestehenden Rechts beiträgt. Dies betrifft unter anderem die Stärkung einstweiliger Maßnahmen, für deren Anwendung Frankreich als Vorbild dienen kann.
In den untersuchten Rechtsordnungen lässt sich ein inkrementeller Politikansatz beobachten: die Säulen des Wettbewerbsrechts werken sukzessive in den Blick genommen und gesetzgeberische Maßnahmen nur schrittweise vorgenommen.
Die in Deutschland und Frankreich geführten Diskussionen und bereits vorgenommenen gesetzgeberischen Maßnahmen deuten derzeit auf eine zunehmende Divergenz zwischen deutschem und französischem Wettbewerbsrecht bei den Antworten auf die Herausforderungen der Digitalwirtschaft hin. Zum einen, weil die in Deutschland vorgenommenen Änderungen der Zusammenschlusskontrolle in Frankreich nicht übernommen werden. Zum anderen, weil die in Deutschland diskutierten Vorschläge zur Reform der Missbrauchsaufsicht kaum auf das französische Recht übertragbar sind.
Das Klimaschutzgesetz hat einen Paradigmenwechsel eingeleitet: den Einstieg in eine CO2-Bepreisung als künftiges Leitinstrument der Klimapolitik. Auf den ersten Blick ist der CO2-Preis unter einer Fülle von Fördermaßnahmen und ordnungsrechtlichen Regelungen verschüttet, deren Wirksamkeit und Kosten höchst unsicher sind. Der CO2-Preis ist aber so angelegt, dass er langfristig das dominante Instrument einer europäisch harmonisierten Klimapolitik werden kann. Der angedeutete Paradigmenwechsel der deutschen Klimapolitik öffnet damit die Tür, die europäische und internationale Kooperation zu stärken. Dazu ist es aber notwendig, neben der europäischen auch die globale Klimapolitik neu auszurichten. Auch dort sollten sich die Verhandlungen statt auf nationale Mengenziele auf CO2-Preise konzentrieren. Die erforderliche Kooperation wird möglich, wenn die Regierungen Transferzahlungen strategisch und reziprok nutzen. So könnte die Effektivität der Klimapolitik erhöht werden und es ließen sich die entstehenden Verteilungskonflikte entschärfen.
Friends or foes?

Energy efficiency measures and the deployment of renewable energy are commonly presented as two sides of the same coin-as necessary and synergistic measures to decarbonize energy systems and reach the temperature goals of the Paris Agreement. Here, we quantitatively investigate the policies and performances of the EU Member States to see whether renewables and energy efficiency policies are politically synergistic or if they rather compete for political attention and resources. We find that Member States, especially the ones perceived as climate leaders, tend to prioritize renewables over energy efficiency in target setting. Further, almost every country performs well in either renewable energy or energy efficiency, but rarely performs well in both. We find no support for the assertion that the policies are synergistic, but some evidence that they compete. However, multi-linear regression models for performance show that performance, especially in energy efficiency, is also strongly associated with general economic growth cycles, and not only efficiency policy as such. We conclude that renewable energy and energy efficiency are not synergistic policies, and that there is some competition between them.
This dissertation investigates the impact of the economic and fiscal crisis starting in 2008 on EU climate policy-making. While the overall number of adopted greenhouse gas emission reduction policies declined in the crisis aftermath, EU lawmakers decided to introduce new or tighten existing regulations in some important policy domains. Existing knowledge about the crisis impact on EU legislative decision-making cannot explain these inconsistencies. In response, this study develops an actor-centred conceptual framework based on rational choice institutionalism that provides a micro-level link to explain how economic crises translate into altered policy-making patterns. The core theoretical argument draws on redistributive conflicts, arguing that tensions between ‘beneficiaries’ and ‘losers’ of a regulatory initiative intensify during economic crises and spill over to the policy domain. To test this hypothesis and using social network analysis, this study analyses policy processes in three case studies: The introduction of carbon dioxide emission limits for passenger cars, the expansion of the EU Emissions Trading System to aviation, and the introduction of a regulatory framework for biofuels. The key finding is that an economic shock causes EU policy domains to polarise politically, resulting in intensified conflict and more difficult decision-making. The results also show that this process of political polarisation roots in the industry that is the subject of the regulation, and that intergovernmental bargaining among member states becomes more important, but also more difficult in times of crisis.
To what extent has the European Union (EU) had a benign or retarding effect on what its member states would have undertaken in the absence of EU climate policies during 2008–2012? A measurement tool for the EU policy’s effect is developed and shows a benign average EU effect with considerable variation across countries. The EU’s policy effectiveness vis-à-vis its member states is explained by the EU’s non-compliance mechanism, the degree of usage of the Kyoto flexible mechanisms, and national pre-Kyoto emission reduction goals. Time-series cross-sectional analyses show that the EU’s non-compliance mechanism has no effect, while the ex-ante plans for using Kyoto flexible mechanisms and/or the ambitious pre-Kyoto emission reduction targets allow member states to escape constraints imposed by EU climate policy.
Die Republik Kosovo stellt einen Beitrittskandidaten sui generis in der Erweiterungsgeschichte der Europäischen Union dar. Die besonderen Beziehungen zwischen der EU und dem "potenziellen" Kandidaten resultieren aus dem ungelösten Territorialkonflikt mit Serbien, dem unvollendeten Staatsaufbau sowie der eingeschränkten Souveränität Kosovos. Diese Einzelfallstudie untersucht Kosovos Integrationsprozess in den Staatenverbund im Kontext der Spezifika des Beitrittsaspiranten, der stockenden EU-Südosterweiterung und der multiplen EU-Krise. Davon ausgehend werden vier Zukunftsszenarien für Kosovos Integrationsverlauf, auch mit Blick auf differenzierte Integrationsoptionen, entwickelt.
Polen in Europa

Bei unseren östlichen Nachbarn werden derzeit mehrere Jubiläen zelebriert: 25 Jahre politischer Umbruch, 15 Jahre Mitgliedschaft in der NATO und 10 Jahre in der EU. WeltTrends nimmt diese geballte Zahlenmagie zum Anlass, Polen zum Thema zu machen. Heft 100 gewährt einen Einblick in die aktuellen außenpolitischen Diskurse in Polen: Sei es zum Verhältnis zur EU, zu den USA oder zu Russland. Natürlich geht es dabei stets auch um das Verhältnis zu Deutschland und ob die Anfang der 1990er Jahre proklamierte „strategische Interessengemeinschaft“ zu einer tatsächlichen Partnerschaft geworden ist.
Norwegen rühmt sich gern seiner „offenen Gesellschaft“: Migranten sind willkommen, vor allem qualifizierte Facharbeiter. Nach den jüngsten Wahlen im Sommer 2013, aus denen die Konservativen als Sieger hervorgingen, könnten nun die Einwanderungsgesetze verschärft werden. Schon jetzt bedient sich Norwegen europäischer Regelungen, die seinem Wunsch nach „effektiver Einwanderung“ entgegenkommen.
Polens Sicht auf die Ukrainekrise ist von dessen geopolitischer Lage geprägt. Als Teil der EU und NATO grenzt das Land unmittelbar an die Krisenregion. Sowohl die Parteien als auch die öffentliche Meinung in Polen verteidigen übereinstimmend die territoriale Integrität der Ukraine und halten deren staatliche Unabhängigkeit für einen unentbehrlichen Faktor der politischen Ordnung in Europa. Vor allem die Frage nach den künftigen Möglichkeiten einer weiteren Ostausdehnung der EU steht daher aus Warschauer Sicht auf der Agenda.
Public debate about energy relations between the EU and Russia is distorted. These distortions present considerable obstacles to the development of true partnership. At the core of the conflict is a struggle for resource rents between energy producing, energy consuming and transit countries. Supposed secondary aspects, however, are also of great importance. They comprise of geopolitics, market access, economic development and state sovereignty. The European Union, having engaged in energy market liberalisation, faces a widening gap between declining domestic resources and continuously growing energy demand. Diverse interests inside the EU prevent the definition of a coherent and respected energy policy. Russia, for its part, is no longer willing to subsidise its neighbouring economies by cheap energy exports. The Russian government engages in assertive policies pursuing Russian interests. In so far, it opts for a different globalisation approach, refusing the role of mere energy exporter. In view of the intensifying struggle for global resources, Russia, with its large energy potential, appears to be a very favourable option for European energy supplies, if not the best one. However, several outcomes of the strategic game between the two partners can be imagined. Engaging in non-cooperative strategies will in the end leave all stakeholders worse-off. The European Union should therefore concentrate on securing its partnership with Russia instead of damaging it. Stable cooperation would need the acceptance that the partner may pursue his own goals, which might be different from one’s own interests. The question is, how can a sustainable compromise be found? This thesis finds that a mix of continued dialogue, a tit for tat approach bolstered by an international institutional framework and increased integration efforts appears as a preferable solution.
Für den Fall seiner Wiederwahl kündigt Cameron ein Referendum an. Verlässt Großbritannien dann die EU? Zwei Jahre vor der nächsten Wahl verhält sich der britische Premierminister David Cameron zwar taktisch klug für sein politisches Überleben, aber zugleich sehr riskant, für sich und für Europa. Seine europhoben Tories fordern den Austritt aus dem Staatenverbund, zumindest aber Verhandlungen über nationale Sonderregelungen. Damit setzt er die EU unter erheblichen (zusätzlichen) Druck. Aber geht Camerons Rechnung auf? Schätzt er die Position Deutschlands richtig ein?
Die EU-Nachbarschaftspolitik als Instrument externer Demokratieförderung : das Beispiel der Ukraine

Seit 2004 versucht die EU mit der Europäischen Nachbarschaftspolitik demokratische Werte in ihre Nachbarländer zu exportieren. Adressaten sind Länder der Mittelmeerunion und Länder des postsozialistischen Europa, die in der Östlichen Partnerschaft zusammengefasst sind. Als außenpolitisches Instrument bietet die Nachbarschaftspolitik eine Alternative zur Erweiterungspolitik. In erster Linie sollen negative Entwicklungen wie illegale Migration, organisierte Kriminalität, grenzübergreifende Umweltzerstörungen und ethnische Konflikte abgewehrt werden. Die Studie analysiert Externalisierung, Sozialisierung und Imitation als Mechanismen des Europäisierungsprozesses und untersucht im Rahmen einer empirischen Prozessanalyse am Beispiel der Ukraine, welche der von der Europäischen Union angewandten Mechanismen den größten Erfolg für eine Normenadaption bedeuten.
Mediale Aufregung wie selten, aber auch intensive Gespräche und Verhandlungen über Investitionsabkommen. So könnte man knapp das jüngste Treffen zwischen der Europäischen Union und der Volksrepublik China Ende September dieses Jahres umreißen. Es gab sehr kritische Worte vom chinesischen Premier Wen Jiabao an die Adresse der EU. Peking kritisierte die Nichtanerkennung als Marktwirtschaft, das Waffenembargo und die Behinderung des Zugangs zum EU-Markt. Brüssel hielt entgegen: Nichteinhaltung individueller Menschenrechte, Raubbau an der Natur und die Tatsache, dass geistiges Eigentum nicht geschützt ist. Neben der Kritik offerierte China eine erste Skizze für ein Handels- und Partnerschaftsabkommens, dass den Beziehungen eine wahrhaft strategische Perspektive geben kann. Der jüngste EU-China-Gipfel zeigte (erneut) das zwiespältige Verhältnis zwischen den „strategischen Partnern“.

Dies sind drängende Fragen der internationalen Politik – und wir liefern Antworten in unserem Themenschwerpunkt: sachlich und pointiert, faktenorientiert und kontrovers. „Neue Weltordnung“ war der Titel der ersten WeltTrends-Ausgabe 1993; „Neue Weltordnung 2.0“ ist der Titel der nunmehr 86. Ausgabe. Auch im 20. Jahrgang bleibt die Zeitschrift ein kritischer, kompetenter Begleiter weltpolitischer Ereignisse – mit Sicherheit!
Europa in der Krise – ganz Europa? Deutschland hat von der Krise scheinbar profitiert, buchstäblich: sowohl wirtschaftlich als auch politisch. Die deutsche Führungsrolle für das angeb- lich schwankende Konstrukt der Europäischen Union gilt vielen Kommentatoren als normal. Die wirtschaftliche Kraft des Landes wird als Grundlage seiner hegemonialen Stellung in Europa anerkannt. Die „deutsche Frage“ stellt sich, im Jahr 2012, neu – und ist kritisch zu diskutieren.

Lange Zeit war die Reaktion der europäischen Politiker auf die Krise der Eurozone eher zurückhaltend bis gespalten. Als es jedoch Ende Oktober 2010 zum EU-Gipfel in Brüssel kam, schien es, also ob die EU nun mit Anspruch und klarer Orientierung handeln würde. Einer der Gründe für diese Veränderung besteht darin, dass nun die meisten Mitglieder - Frankreich eingeschlossen - bereit sind, die bittere Pille einer deutschen Führung zu schlucken.
Selektive Grenzen

Die Grenze - historisches Auslaufmodell? Moralische Zumutung? Unabdingbare Tatsache? Meist ist sie eine Art Limes: Durchlässig für den Austausch bestimmter Waren und Personen, zugleich Schutz gegen das Eindringen unerwünschter Fremder. Vielfach erklärtes Ziel ist ein "grenzenloses Europa". Im Innern der EU sind Schlagbäume verschwunden, an den Rändern wird vielerorts abgeschottet. Die Grenzsortierungen der EU sind Thema der aktuellen WeltTrends. Afghanistan und kein Ende? Die Londoner Konferenz verspricht trotz "neuer Strategie" keinen erfolgreichen Neuanfang. "Es wird zunächst schlimmer", so ein hoher deutscher Militär. Alternativen müssen diskutiert werden: WeltTrends bietet den Raum.

Die Verfasstheit der Europäischen Union nähert sich der Staatlichkeit an: Der Euro ist Ausdruck dessen, dass die Währungshoheit der beteiligten Staaten in Brüssel abgegeben ist; die Militäreinsätze der EU, darunter in Kosovo, Kongo, Tschad und vor der somalischen Küste, zeugen vom Ausbau einer eigenständigen Kriegführungsfähigkeit, die im Vertrag von Lissabon auch völkerrechtlich fixiert ist; die Ernennung von Lady Ashton zur EU-Außenbeauftragten und die Schaffung eines eigenen außenpolitischen Dienstes weisen darauf hin, dass auch das Recht der Außenvertretung schrittweise auf die Unionsebene übergeht.
Reif für die Weltpolitik?

Bereits vor zehn Jahren diskutierten wir über die außenpolitische Reife deutscher Eliten. Das Ergebnis war widersprüchlich, kritisch ernüchternd. Gegenwärtig, 20 Jahre nach der deutschen Einheit, ist es an der Zeit, erneut nachzufragen. Die Welt- und Europapolitik sind im Fieber. Die neokonservative Marktwirtschaft – bis vor Kurzem noch siegessicher – erodiert. Die westliche Welt steckt am Beginn des 21. Jahrhunderts in einer Systemkrise. Hektische Gipfel jagen einander, von Kopenhagen über London und Davos bis nach München. Da ist die Frage erlaubt: Wie steht es in solch turbulenten Zeiten eigentlich um die deutsche Außenpolitik?
