Die Privatisierungseuphorie der vergangenen Jahrzehnte ist heute weitgehend verflogen. Nicht nur die Finanz- und Wirtschaftskrise hat das Vertrauen in die Leistungsfähigkeit der Märkte erschüttert. Auch haben bei weitem nicht alle Privatisierungsmaßnahmen die in sie gesetzten Erwartungen erfüllt. Daher war schon vor vielen Jahren eine Trendwende weg von der Privatisierung und hin zu dem gegenläufigen Prozess der Rekommunalisierung zu beobachten. Die Rückkehr zum Öffentlichen beschränkt sich aber nicht auf den kommunalen Bereich, sondern ist längst auch auf Landes-, Bundes-, EU- und sogar globaler Ebene zu beobachten. Ebenenübergreifend lässt sich dieser Trend zu Rekommunalisierung und Rückverstaatlichung mit dem neuen Begriff der „Publizisierung“ erfassen. Freilich ist die Trendwende „hin zum Öffentlichen“ kein durchgängiges Phänomen. Vielmehr gibt es daneben auch Bestrebungen, die auf künftige Privatisierungen abzielen – etwa im Infrastrukturbereich.
An diesen gegenläufigen Entwicklungstendenzen setzt der vorliegende Tagungsband an. Er dokumentiert den Gedankenaustausch zwischen polnischen und deutschen Verwaltungsrechtswissenschaftlern auf einer Tagung, die im Juni 2017 an der Uniwersytet im. Adama Mickiewicza (Adam-Mickiewicz-Universität, UAM) in Poznań stattgefunden hat. Dieses Symposium ist Teil einer Kooperation zwischen der UAM und dem Kommunalwissenschaftlichen Institut (KWI) der Universität Potsdam, die sich mit dem umfassenderen Programm einer „Modernisierung des Gemeinwesens“ beschäftigt und dabei den Fokus insbesondere auf die beiden Modernisierungsansätze „Privatisierung“ und „Publizisierung“ richtet.
Mehr Privat statt Staat! Diese Kampfformel galt vielen noch vor kurzem als Schlüssel zur erfolgreichen Entlastung der angespannten kommunalen Haushalte. Immer mehr Kommunen beschritten den vermeintlichen Königsweg. So vielfältig wie die Gegenstände sind auch die in der Verwaltungspraxis zu beobachtenden Erscheinungsformen der Privatisierung: Vermögensprivatisierung, Organisationsprivatisierung, Aufgabenprivatisierung mit facettenreichen Mischformen namentlich der Public Private Partnerships. Zwar brachte der „Verkauf des Tafelsilbers“ den Kommunen kurzzeitig einen Geldsegen. Doch haben bei weitem nicht alle Privatisierungsmaßnahmen die in sie gesetzten Erwartungen erfüllt und es setzt sich zunehmend die Einsicht durch, dass die Privatwirtschaft nicht zwangsläufig besser, effizienter und kostengünstiger arbeitet als die Öffentliche Hand. Inzwischen deutet sich im kommunalen Bereich eine klare Trendumkehr in Richtung Rekommunalisierung an. Die 17. Fachtagung des Kommunalwissenschaftlichen Instituts (KWI) der Universität Potsdam greift in diese anlaufende Grundsatzdebatte ein und nimmt aktuelle Bestrebungen der Rekommunalisierung lokaler Aufgaben auf. Im Vordergrund stehen erste praktische Erfahrungen, Implementationsprobleme und nicht zuletzt die rechtlichen Rahmenbedingungen und normativen Direktiven für Rekommunalisierungen namentlich in Segmenten der öffentlichen Daseinsvorsorge.
Obwohl Privatisierung in den letzten Jahren und Jahrzehnten ein Kernthema nicht nur der rechtswissenschaftlichen Debatte gewesen ist, wurde der Bereich der Privatisierung des Maßregelvollzugs nach §§ 63, 64 StGB, § 7 JGG sowie der Aufgaben nach §§ 81, 126a StPO insoweit vernachlässigt. Vor dem Hintergrund hauptsächlich fiskalischer Erwägungen und den Möglichkeiten einer Flucht aus dem Beamten- und dem Haushaltsrecht geraten zunehmend auch solche Bereiche in den Blickpunkt von Privatisierungsüberlegungen, die bisher selbstverständlich dem Bereich staatlicher Tätigkeit zugerechnet werden. Der Staat versteht sich zunehmend als Gewährleistungsstaat, der staatliche Aufgaben nicht mehr eigenhändig erfüllt, sondern sich hierfür der Leistung Dritter bedient. Bislang wurden der Maßregelvollzug nach §§ 63, 64 StGB und § 7 JGG sowie die Unterbringung zur Beobachtung des Beschuldigten nach § 81 StPO und die einstweilige Unterbringung nach § 126a StPO durch den Staat in den (staatlichen) Landeskliniken vollzogen. Auf der im Jahr 2004 eingeführten Rechtsgrundlage des § 36 Abs. 3 S. 2 und S. 5 BbgPsychKG entwickelte das Land Brandenburg ein Modell, um die Durchführung der genannten Aufgaben zu privatisieren, und gliederte die Landeskliniken im Jahr 2006 aus der Landesverwaltung aus. Der Autor untersucht die verfassungsrechtliche Zulässigkeit dieses Privatisierungsvorhabens in formeller und materieller Hinsicht. Eine Besonderheit der Veröffentlichung besteht darin, dass die Arbeit konkrete Aussagen zur Ausgestaltung des Regel-Ausnahme-Verhältnisses des Funktionsvorbehalts nach Art. 33 Abs. 4 GG enthält. Daran fehlte es bislang. Daneben untersucht der Autor einfachgesetzliche Grenzen für Privatisierungen des Maßregellzugs nach §§ 63, 64 StGB, § 7 JGG und der Aufgaben nach §§ 81, 126a StPO sowie solche Privatisierungsgrenzen, die sich aus internationalen Menschenrechtsstandards ergeben.
Ausgehend von der These, dass kommunale Unternehmen gerade in strukturschwachen Regionen eine besondere politische und wirtschaftliche Bedeutung besitzen, wird die Entwicklung der kommunalen Wirtschaft im Land Brandenburg untersucht. Die Autoren bereiten dazu in einer Längsschnittanalyse nicht unmittelbar dazu abrufbare Daten der öffentlichen Statistik auf und untersetzen die statistische Analyse durch eine Einzelfallstudie. Im Ergebnis wird deutlich, dass Entscheidungen über Privatisierungen oder Kommunalisierungen keinen „Sachgesetzlichkeiten“ folgen, sondern politisch in Abhängigkeit von Situationsinterpretationen, Denkstilen, Macht- und Interessenkonstellationen getroffen werden. Die Offenheit der Entscheidung über die Zukunft der kommunalen Wirtschaft verweist damit auf politischen Handlungsspielraum und die politische Verantwortung für Ausbau, Erhalt oder Privatisierung kommunaler Unternehmen.
Einerseits führt in Entwicklungsländern die Privatisierung von Wasserbetrieben zu Kostensenkungen. Andererseits verändert sie bisherige Möglichkeiten der Teilnahme. Diese wiederspruchsvollen Entwicklungen diskutiert die Autorin an Beispielen aus Südamerika und Südafrika. Künftige Privatisierungen im Bereich Wasser sollten dauerhafte Formen der Mitwirkung ermöglichen.
1. Problemstellung Die Liberalisierung von Netzindustrien stellt eine volkswirtschaftliche Problematik dar, die einerseits eine Vielzahl theoretisch ungelöster Fragen aufwirft und für die andererseits nunmehr auch in Deutschland wirtschaftspolitische Erfahrungen vorliegen. Die Ursachen der ökonomischen Probleme sind dabei nicht nur in bestimmten Branchenbesonderheiten der Netzindustrien zu suchen, sondern auch in einer verfehlten ordnungspolitischen Sonderbehandlung der netzgebundenen Wirtschaftsbereiche in der Vergangenheit. Entgegen den für eine marktwirtschaftliche Ordnung charakteristischen Prinzipien Wettbewerb und Privateigentum wurden Netzindustrien traditionell als wettbewerbliche Ausnahmebereiche behandelt und zumeist in Form öffentlicher Unternehmen geführt. Die Folge dessen waren (staatliche) Monopole, die eine relativ hohe Ineffizienz aufwiesen. Die ordnungspolitische Konsequenz dieses Befundes lautete daher Liberalisierung von Netzindustrien durch Privatisierung und Marktöffnung, d. h. ein Abbau von Marktzutrittsschranken durch Deregulierung. Wettbewerb stößt in Netzindustrien jedoch an Grenzen, weil die zur Produktion netzgebundener Dienstleistungen erforderliche Infrastruktur typischerweise ein nicht-angreifbares, natürliches Monopol darstellt, das sich in der Hand eines im Markt eingesessenen, vertikal integrierten Anbieters befindet. Daraus ergeben sich weitreichende Möglichkeiten zur Diskriminierung von Konkurrenten, die wettbewerbspolitischen Handlungsbedarf nach sich ziehen. Diesen gilt es in der vorliegenden Arbeit zu analysieren und alternative Lösungsansätze der Diskriminierungsproblematik zu diskutieren. 2. Besonderes Forschungsziel Die vorliegende Dissertation widmet sich der Liberalisierung von Netzindustrien aus ökonomischer Sicht, wobei insbesondere die Interdependenzen zwischen der Eigentums- und der Diskriminierungsproblematik berücksichtigt werden. Gleichwohl bildet die wettbewerbliche Öffnung der Märkte für netzgebundene Dienstleistungen aus volkswirtschaftlicher Sicht das Kernproblem und somit auch den zentralen Untersuchungsgegenstand dieser Arbeit. Die theoretische Analyse bleibt dabei nicht auf einen Forschungsansatz beschränkt, sondern es werden mehrere Facetten der Liberalisierung von der Ordnungs- über die Netzökonomik bis hin zur politischen Ökonomie betrachtet. In empirischer Hinsicht haben die in Deutschland in verschiedenen Netzindustrien realisierten Marktöffnungen bislang zu unterschiedlich intensiven Wettbewerbsprozessen geführt. Daher wird ein problemorientierter, intersektoraler Vergleich der Reformen und eine wettbewerbs-politische Beurteilung anhand der drei Marktmerkmale Marktstruktur, Marktverhalten und Marktergebnis vorgenommen, um die Liberalisierung in einzelnen Netzindustrien zu bewerten. Die Telekommunikation gilt dabei als Musterbeispiel für eine erfolgreiche Liberalisierung, weil die Deregulierung hier durch eine sektorspezifische Marktmachtkontrolle begleitet wird, wofür eigens eine Regulierungsbehörde geschaffen wurde. Vor diesem Hintergrund wird der mangelnde Wettbewerb in der Strom- und vor allem in der Gasversorgung sowie im Schienenverkehr häufig auf das Fehlen solcher Institutionen zurückgeführt. Aufgrund dessen werden hier die Eisenbahn, die Telekommunikation im Festnetz und die leitungsgebundene Energieversorgung als empirische Analyseobjekte ausgewählt, um die im Laufe der Untersuchung gewonnenen theoretischen Erkenntnisse exemplarisch an diesen Netzindustrien aufzuzeigen und die im Folgenden formulierte Arbeitshypothese zu überprüfen. 3. Methodik Die Arbeit gliedert sich in einen theoretischen und einen empirischen Teil. Die theoretisch zu untersuchende Frage bei der Liberalisierung von Netzindustrien lautet: Welcher institutionellen Arrangements bedarf es in Netzindustrien, um vormals monopolistisch organisierte in kompetitive Märkte zu überführen und darin nachhaltig einen effektiven Wettbewerb zu etablieren? Auf der Grundlage der erarbeiteten ordnungs- und wettbewerbsökonomischen Erkenntnisse wird nach allgemeingültigen Kriterien gesucht, um daraus einen Bewertungsmaßstab für den intersektoralen Vergleich von Liberalisierungsprozessen in verschiedenen Netzindustrien zu entwickeln. Als Arbeitsthese der empirischen Überprüfung im zweiten Teil dient die aus verschiedenen ökonomischen Blickwinkeln gewonnene und theoretisch zu fundierende Vermutung, dass es zur wirksamen Marktöffnung in Netzindustrien einer materiellen Privatisierung sowie einer effektiven und effizienten Marktmachtkontrolle im Bereich des Zugangs zur Netzinfrastruktur bedarf. Anhand dieser These werden die Liberalisierungsprozesse in den Netzsektoren Schienenverkehr, Telekommunikation sowie Energieversorgung in der Bundesrepublik Deutschland aus volkswirtschaftlicher Sicht beurteilt, und es wird auf verbleibenden ordnungspolitischen Reformbedarf hingewiesen. Die theoretischen Ergebnisse sind indes auch auf ähnliche, hier nicht dargestellte Infrastruktursektoren übertragbar.
Ethik, Integrität und Korruption : Neue Herausforderungen im sich wandelnden öffentlichen Sektor?

Im öffentlichen Sektor hat, wie wir wissen, in den letzten 10-20 Jahren ein erheblicher Wandel stattgefunden. Die staatlichen Strukturen haben sich immer mehr ausdifferenziert und öffentliche Leistungen werden in sehr unterschiedlichen Erledigungsformen erbracht. Ein beachtlicher Teil der Leistungen ist auf private Dritte ausgelagert oder ganz privatisiert worden. Zudem haben sich verschiedene Muster von öffentlich-privaten Kooperationen herausgebildet. Verwaltungen und öffentliche Unternehmen wurden unter verstärkten Leistungsdruck und Wettbewerb gesetzt. All das führte zu einer weithin wahrnehmbaren Ökonomisierung und „Managerialisierung“ des öffentlichen Sektors, die verständlicherweise auch Werte und Verhaltensweisen der öffentlich Beschäftigten beeinflusst hat. Daraus ergeben sich ohne Zweifel erhebliche Konsequenzen für die Integrität der Akteure im öffentlichen Sektor sowie für deren Korruptionsanfälligkeit.
