Der Artikel gibt einen Überblick über die verschiedenen Phasen von siebzig Jahren christlich-jüdischer Dialog und blickt in die Zukunft. Akzeptieren Christen die Konsequenzen, die aus der Immanenz des Judentums in ihrer Religion folgen? Vor allem in zentralen Handlungsfeldern der systematischen Theologie bleibt viel Raum für Entwicklung, allen voran der Christologie.

Einleitung

Ethik-Komitees gehören zum festen Bestandteil des Ethikmanagements und der Organisationsethik in klinischen Einrichtungen des Gesundheitswesens. Entsprechende Ethikstrukturen und die damit verbundenen Angebote stoßen hinsichtlich ihrer Wirksamkeit allerdings an ihre Grenzen. Ihre Arbeitsweisen sind häufig reaktiv und eine Verankerung in den entsprechenden Organisationsebenen fehlt. Ausgehend von diesen Limitationen der klinischen Ethikberatung hat sich die multiprofessionelle „Arbeitsgruppe Ethik“ am Universitätsklinikum Tübingen (UKT) um die Konzeption und Implementierung eines neuen Ansatzes zur nachhaltigen Integration von ethischen Reflexions- und Entscheidungsprozessen auf den Stationen des UKT bemüht. Mit dem Tübinger Modell der Ethikbeauftragten der Station verfolgt sie ein Pilotprojekt, das speziell geschulte Pflegekräfte aus allen Stationen des UKT als AnsprechpartnerInnen für ethische Fragen einsetzt. Damit stellen die Ethikbeauftragten eine Erweiterung zu etablierten Strukturen der Ethikberatung dar und ergänzen vorhandene Top-Down-Strategien. Der vorliegende Beitrag stellt die Zielsetzungen des Tübinger Modells dar und schildert erste Erfahrungen in der Umsetzung. Neben der Einbettung in organisationale Strukturen der Ethikberatung werden die stationsinternen und stationsübergreifenden Aufgaben der Ethikbeauftragten dargestellt. Zudem wird das Qualifikationsprogramm für Ethikbeauftragte (Basis- und Aufbauschulung) sowie ein Train-the-Trainer-Konzept vorgestellt, welche eine vertiefende Entwicklung von pflege- und medizinethischer Kompetenzen unterstützen und Sicherheit in den stationsbezogenen Reflexions- und Entscheidungsprozessen vermitteln.
Religion und Geschlecht sind zentrale Wissenskategorien für die Entwicklung und Ausprägung jüdischer Identität in ihrer Selbst- und Fremdwahrnehmung. Gemäß Pierre Bourdieu lassen sich entsprechende Prozesse der Identitätsbildung als Habitualisierung verstehen, an welcher auch Jugendliteratur einen Anteil haben kann. Der Artikel legt anhand der Jugendromane Bella und das Mädchen aus dem Schtetl (2015) und Dunkles Gold (2019) exemplarisch dar, mit welchen Methoden und Fragestellungen Geschlechtlichkeit und geschlechtlich markierte Sozialisationsangebote innerhalb religionsaffiner Kontexte jüdischer Jugendliteratur untersucht werden können.
Hintergrund
Lungenkrebsbetroffene sind besonders stark durch psychischen Stress belastet. Gleichzeitig sind die Inanspruchnahmeraten von psychoonkologischer Unterstützung relativ gering. Es ist wenig über die Gründe der (Nicht‑)Inanspruchnahme bekannt.
Fragestellung
Welche emotionalen Herausforderungen erleben Menschen mit Lungenkrebs? Was sind ihre Gründe für die (Nicht‑)Inanspruchnahme psychoonkologischer Unterstützung?
Material und Methode
Es wurden qualitative Interviews mit 20 Lungenkrebsbetroffenen ausgewertet, die im Rahmen der CoreNAVI-Studie durchgeführt wurden.
Ergebnisse
Die Befragten erleben psychischen Stress in Form von Unsicherheiten und Zukunftsängsten. Auch den Druck, schnell von einer Behandlung in die nächste gehen zu müssen und keine Zeit für sich zu haben, nehmen die Betroffenen als belastend wahr. Das offene Sprechen, ohne das persönliche Umfeld belasten zu müssen, sowie konkrete Ratschläge erleben die Nutzer*innen der Psychoonkologie als große Hilfestellung. Die Nichtinanspruchnahme wird durch fehlenden Bedarf und mangelnde Kapazitäten begründet. Zudem werden Vorbehalte gegenüber psychologischer Unterstützung deutlich.
Schlussfolgerung
Betroffene mit Lungenkrebs erleben psychische und emotionale Belastungen auch durch die Vielzahl und Dichte an Therapien. Daraus resultierende fehlende Kapazitäten könnten eine Erklärung für die geringe Inanspruchnahme von psychoonkologischer Unterstützung sein. Eine stärkere Gewichtung der Psychoonkologie gegenüber aufwendigen medizinischen, oft nur geringfügig lebensverlängernden Therapien sowie der Abbau von Vorbehalten gegenüber psychologischer Hilfe sollten in der Versorgungspraxis verstärkt in den Fokus rücken.
Das neue Hinweisgeberschutzgesetz verlangt neben der Einrichtung unternehmens- bzw. behördeneigener interner Meldestellen auch den Aufbau externer Meldestellen. Diese wurden zur Vermeidung zusätzlicher Bürokratie bei bestehenden Bundesbehörden angesiedelt. System und Wirkungsweise der externen Meldestellen sollen nachfolgend erörtert werden. Zugleich bieten die Ausführungen Anlass, gesetzgeberische Verbesserungen zu erwägen.
Online-Nutzer begegnen regelmäßig unterschwelligen manipulativen Designstrategien von Anbietern digitaler Produkte, welche sie zu rechtsgeschäftlich relevanten Entscheidungen bewegen sollen, die sie womöglich nicht - oder zumindest nicht so - beabsichtigt haben. Man spricht in diesem Zusammenhang von (vielgestaltig denkbaren) „Dark Patterns“ (dt. „dunkle Muster“). Der Beitrag geht der Frage nach, inwiefern diese insbesondere lauterkeitsrechtlich zulässig sind.
Der Beitrag beleuchtet die Perspektiven von DaF und DaZ im Kontext von Mehrsprachigkeit.
Zunächst wird ein Verständnis von ‚Mehrsprachigkeitʻ erarbeitet und diskutiert. Anschließend wird gezeigt, wie sich DaZ, DaF und die Forschung zu Varietäten des Deutschen im Ausland im Rahmen dieses Verständnisses von Mehrsprachigkeit positionieren lassen.
Der Beitrag schließt mit einem Plädoyer für ein neues, integratives Konzept von ‚Deutsch im Mehrsprachigkeitskontextʻ.
Lokalisierung des Erfolgsorts bei Vermögensdelikten („Vereniging van Effectenbezitters/BP plc“)

Mit Spannung wird die Entscheidung des BVerfG zu § 362 Nr. 5 StPO erwartet. Die Verfassungsbeschwerde des Beschuldigten, der vor Jahrzehnten vom Vorwurf des Mordes rechtskräftig freigesprochen worden war und der nun befürchten muss, auf der Grundlage des § 362 Nr. 5 StPO wegen derselben Tat verurteilt zu werden, hat die verfassungsrechtliche Überprüfung der Vorschrift veranlasst. Zuvor waren bereits in zahlreichen Texten von Rechtswissenschaftlern Argumente für und gegen die Regelung ausgetauscht worden. Verständlicherweise steht dabei Art. 103 Abs. 3 GG im Vordergrund. Wer § 362 Nr. 5 StPO ablehnt, begründet das in erster Linie mit einer Verletzung des ne-bis-in-idem-Grundsatzes. Nicht wenige Befürworter der erweiterten Wiederaufnahmemöglichkeit verweisen – gefühlsgeleitet − auf „materielle Gerechtigkeit“ sowie auf „schlechterdings unerträgliche Ergebnisse“. Unbefriedigend ist das für Menschen, die es weder ungerecht noch unerträglich finden, dass ein Tatverdächtiger nach rechtskräftigem Freispruch bis an sein Lebensende als „unschuldig“ gilt und zwar auch, wenn auf Grund neuer Beweismittel aus dem Freigesprochenen ein zu lebenslanger Freiheitsstrafe Verurteilter werden könnte. Dass das Festhalten am rechtskräftigen Freispruch richtig ist, dafür gibt es starke juristische Gründe. Auch für die Durchbrechung des Strafklageverbrauchs in den von § 362 Nr. 5 StPO erfassten Fällen gibt es gewiss beachtliche Gründe. Sie sind meines Erachtens jedoch nicht gewichtig genug. Im vorliegenden Text soll die verfassungsrechtliche Dimension außen vor bleiben. Eine neue Vorschrift, mit der das geltende Strafprozessrecht verändert wird, muss auch eine Prüfung am Maßstab des geltenden Strafprozessrechts durchlaufen, um akzeptiert werden zu können. § 362 Nr. 5 StPO fällt bei dieser Prüfung durch und sollte deshalb aufgehoben werden.
Der Ruf nach gesetzgeberischen Reparaturmaßnahmen am unbestrittenermaßen missglückten § STGB § 142 StGB ist ein kriminalpolitischer Dauerbrenner. Neu sind recht konkrete Vorschläge aus dem Bundesministerium der Justiz zu einer Reduktion des objektiven Tatbestandes, durch die ein beträchtlicher Anteil der Anwendungsfälle künftig in das Ordnungswidrigkeitenrecht verlagert werden soll. Unfälle, die „reine Sachschäden“ verursachen, sollen eine nur noch bußgeldbewehrte Warte- und Feststellungsermöglichungspflicht auslösen. Die im Vorstadium eines Gesetzesentwurfs publizierten ministeriellen Ideen haben ein geteiltes Echo – Zustimmung und Ablehnung – ausgelöst. Der Beitrag befasst sich nicht mit der umstrittenen kriminalpolitischen Vernünftigkeit der Pläne, zeigt aber einige strafrechtsdogmatische Aspekte auf, die bei der Neufassung des Gesetzeswortlauts zu beachten sein werden.
Der untenstehende Text ist eine recht spontane Reaktion auf Bemerkungen, die jüngst von den Kollegen Armin Engländer und Christian Rückert zu einem Kodifizierungsvorschlag für die Regelungsthemen Notwehr, Notwehrexzess und subjektives Rechtfertigungselement in der Zeitschrift „Goltdammer’s Archiv für Strafrecht“ präsentiert wurden. Den Entwurfstext hat eine – kleine – Gruppe von Strafrechtslehrern erarbeitet. Er wurde letztes Jahr mittels eines Aufsatzes von Elisa Hoven und Wolfgang Mitsch – ebenfalls im „Goltdammer’s Archiv“ − vorgestellt und erläutert. Engländer und Rückert äußern stellenweise Zustimmung, üben aber auch zu vielen Punkten des Entwurfs und seiner Begründung Kritik. Da der hiesige Verfasser sowohl an der Entwicklung des Entwurfstextes als auch an dem genannten GA-Aufsatz als Ko-Autor beteiligt war, möchte er − im Folgenden: ich − zu einigen der Kritiken Stellung nehmen.
Illegales Wettrasen auf öffentlichen Straßen beschäftigt Staatsanwaltschaften und Strafgerichte, wenn dieses Ereignis stattgefunden und oftmals auch schwere Schäden verursacht hat. Jeder hat noch das Verfahren um das tödliche Geschehen auf der Berliner Tauentzienstrasse im Gedächtnis und vor Augen. Naturgemäß geht einer solchen Aktion stets eine – wenn auch nur kurze und evtl. nonverbale (z. B. Kopfnicken, Handzeichen) – Verständigung der Teilnehmer voraus. Praktisch mag die Frage keine Bedeutung haben, theoretisch interessant ist sie aber schon: Ist bereits diese Kommunikation in der Anbahnungsphase möglicherweise strafbares Verhalten? Praktisch würde sich die Möglichkeit der Strafverfolgung darauf beschränken, wenn aus irgendeinem Grund das Rennen dann doch nicht stattgefunden hat. Daher sollen hier – weil das nach meiner Beobachtung noch nirgends geschehen ist – zu diesem Thema ein paar klärende Ausführungen gemacht werden.
BtMG § 30 a Abs. 1
Der Anbau von Betäubungsmitteln in Form der Aufzucht umfasst sämtliche gärtnerischen oder landwirtschaftlichen Bemühungen, um Wachstum von in den Anlagen I bis III zum Betäubungsmittelgesetz genannten Pflanzen zu erreichen. Hierzu zählen namentlich das Bewässern, das Düngen und das Belichten

Entscheidungen über die vorläufige Entziehung der Fahrerlaubnis nach § STPO § 111 a StPO rücken in der Regel nicht in das Licht der Öffentlichkeit. Sie müssen schon aus tatsächlichen oder rechtlichen Gründen eine Besonderheit darstellen, um über die Medien einem breiteren (Fach-)Publikum bekannt gemacht zu werden und auf diesem Weg ein großes Quantum Aufmerksamkeit auf sich zu ziehen. Dies gelang einem Beschluss des LG Oldenburg, über den Interessierte z. B. via „Juristischer Flurfunk“ oder „LTO“ im Dezember 2022 informiert worden sind. In der Begründung dieser Beschwerdeentscheidung bemerken die Richter beiläufig, dass ein E-Scooter von mehreren Benutzern gleichzeitig „in einer Art Mittäterschaft“ geführt werden könne. Der Verfasser des Beschlusses war sich wohl unsicher, ob die beiden E-Scooter-Fahrer in dem konkreten Fall wirklich Mittäter im Sinne des § STGB § 25 Abs. STGB § 25 Absatz 2 StGB waren oder nicht. Die Formulierung „Art Mittäterschaft“ klingt wie die Antwort „jein“ auf diese Frage. Sachverhalt und Entscheidung sind interessant und inspirieren zum Nachdenken darüber, ob und wie die Deliktstatbestände § STGB § 316 StGB und § STVG § 24 a StVG verwirklicht werden können, wenn nicht eine Person allein das Fahrzeug führt, sondern auf dessen Fortbewegung von mehreren Nutzern eingewirkt wird. Im Folgenden sollen über den aktuellen verfahrensgegenständlichen Sachverhalt hinaus weitere Varianten eines solchen Geschehens gewürdigt werden.
Notwehr gegen »Klimakleber«?

Die verständliche Verärgerung über die Behinderung des fließenden Straßenverkehrs durch Menschen, die ihre Hände mit Sekundenkleber auf der Fahrbahn fixieren, hat Diskussionen über die (straf-)rechtliche Bewertung dieser Aktionen und möglicher Gegenmaßnahmen angeregt. Ein umstrittenes Thema ist die Selbsthilfe aufgehaltener Autofahrer, die sich freie Bahn dadurch verschaffen, dass sie die festgeklebten Menschen mit physischer Gewalt von der Fahrbahn entfernen, was erhebliche Verletzungen an den festgeklebten Händen zur Folge haben kann. Der Beitrag dreht sich um die bisher nur unvollständig erörterte Frage einer Rechtfertigung solcher Selbsthilfehandlungen gemäß § 32 StGB.
Der in diesem Beitrag vorgestellte Entwurf eines neu formulierten Notwehrrechts war Gegenstand und Grundlage einer lebhaften Diskussion, die im Rahmen einer Online-Tagung stattgefunden hat. Neben den Mitgliedern des Kriminalpolitischen Kreises, die zum Teil an der Erstellung des Gesetzesentwurfes mitgearbeitet hatten, waren weitere Experten und Interessierte beteiligt. Daraus resultierten wertvolle kritische Anmerkungen, die von der Arbeitsgruppe dankbar aufgenommen und umgesetzt wurden.
Dass unser geltendes Strafrecht eine „Verschlankung“ vertragen könnte, ist nun auch im Bundesjustizministerium bemerkt worden. Aus dem Besonderen Teil sollen Vorschriften entfernt werden, die aus unterschiedlichen Gründen nicht (mehr) benötigt werden. Als weitere Maßnahme der Entkriminalisierung steht möglicherweise die punktuelle Senkung von Strafrahmen auf der Agenda. Dies hat nicht nur eine Reduzierung des Sanktionsniveaus zur Folge, sondern kann dort, wo infolge der niedrigeren Strafrahmenuntergrenze aus Verbrechen Vergehen werden, Straflosigkeit bewirken. Das betrifft § 30 StGB, eine Vorschrift, die Anlass für die Überlegungen sein kann, nicht nur im Besonderen Teil, sondern auch im Allgemeinen Teil des StGB nach entbehrlichen Normen zu suchen. § 30 StGB ist aktuell anwendbar in Kombination mit den Tatbestandsvarianten des § 184b StGB, die Verbrechenscharakter haben. Welche strafrechtlichen Ergebnisse daraus resultieren können, ist in der Debatte um die Strafbarkeit von Kinderpornographie bislang nicht erörtert worden. Dasselbe gilt für den praktisch selten zur Anwendung kommenden § 16 Abs. 2 StGB, der neuerdings in Verbindung mit § 184b StGB und § 184c StGB in Erscheinung getreten ist. Aus der Betrachtung der Zusammenhänge dieser Vorschriften lassen sich einige Empfehlungen an die Gesetzgebung ableiten.
Mit Urteil vom 31. Oktober 2023 hat der 2. Senat des BVerfG die im Dezember 2021 durch „Gesetz zur Herstellung materieller Gerechtigkeit“ eingeführte Vorschrift § 362 Nr. 5 StPO für mit dem Grundgesetz unvereinbar und deshalb nichtig erklärt. Erwartungsgemäß waren die Reaktionen auf diese Entscheidung nicht nur zustimmende. Die vorliegende Anmerkung wendet sich nicht gegen das Ergebnis, setzt sich aber − auch kritisch − mit einigen Teilen der Entscheidungsbegründung sowie den Erwiderungen der beiden abweichend votierenden Senatsmitglieder auseinander.

Die Privatsphäre prominenter Personen wird häufig durch eine auf Sensationsgier ausgerichtete Presseberichterstattung gefährdet. Während sich die Presse dabei vordergründig auf ein öffentliches Interesse an solchen Berichten beruft, kann die Reputation der Betroffenen in der Öffentlichkeit stark und dauerhaft beeinträchtigt werden. Jedoch folgen aus dem Allgemeinen Persönlichkeitsrecht mehrere Ansprüche, mit denen diese Rechtsverletzungen abgewehrt und mögliche Schäden kompensiert werden können.
Die Schulinspektion evaluiert Schulen mit dem Ziel der Qualitätssicherung von Unterrichts- und Schulqualität.
Dies gilt insbesondere für Schulen, an denen „erheblicher Entwicklungsbedarf“ festgestellt wurde.
Diese Schulen bekommen zusätzliche Unterstützung, erfahren aber auch zusätzlichen Druck durch diese Einordnung.
Die weitere Entwicklung dieser Schulen ist bisher kaum erforscht. Diese Studie untersucht mit Daten der Schulinspektion, der amtlichen Statistik und Leistungsdaten von 333 Berliner Grundschulen Veränderungen in Indikatoren der Unterrichts- und Schulqualität, der Schulleistung, und der Zusammensetzung der Schülerschaft (SES und Anteil mit nicht-deutscher Herkunftssprache) nach der Diagnose „erheblicher Entwicklungsbedarf“.
Die empirischen Analysen zeigten, dass sich bei diesen Schulen die Unterrichts- und Schulqualität nur geringfügig veränderte, sich der Leistungsabstand zu allen anderen Grundschulen nicht statistisch signifikant verringerte, und sich die Zusammensetzung der Schülerschaft hinsichtlich des sozioökonomischen Status (SES) nicht veränderte. Jedoch erhöhte sich der Anteil von Kindern mit nicht-deutscher Herkunftssprache statistisch signifikant.

In materieller Hinsicht ist in diesem Aktenvortrag der praxisgerechte Umgang mit dem Deliktsrecht und dem zivilrechtlichen Nachbarrecht zu bewerkstelligen. Prozessual bietet der Sachverhalt Möglichkeit zur Bearbeitung examensklassischer Problemkreise. Es handelt sich um eine sehr umfangreiche Aufgabe. Um die vorgegebene Bearbeitungszeit einzuhalten, kann der Vortrag kaum in allen Punkten so ausführlich gehalten werden wie die hier vorgeschlagene Lösung. Das wird aber für eine gute Bewertung auch nicht erforderlich sein. Vielmehr kommt es, wie stets, auf eine überzeugende Schwerpunktsetzung an.
Gegenstand des Beitrags ist schwerpunktmäßig das im Jahr 2016 mit den §§ 155b , 155c FamFG geschaffene Rechtsbehelfssystem der Beschleunigungsrüge und Beschleunigungsbeschwerde. Bevor Grund und Grenze der Verfahrensbeschleunigung in Kindschaftssachen unter besonderer Berücksichtigung des Gedankens der Verfahrensökonomie ausgelotet werden, geht der Verfasser auf das Verhältnis zwischen Beschleunigungsgrundsatz und Prozessökonomie in gebotener Kürze ein. Anschließend liegt der Fokus auf dem Beschleunigungsgrundsatz; zunächst in familiengerichtlichen Verfahren im Allgemeinen und sodann im kindschaftsrechtlichen Verfahren im Speziellen. In Bezug auf Letzteres wird ferner aufzuzeigen sein, dass Verfahrensökonomie die kindeswohldienliche Anwendung des Beschleunigungsgrundsatzes bedeutet. Dieser Anwendungsbefehl soll abschließend am Beispiel des einleitend angesprochenen, relativ neuen Rechtsbehelfsverfahrens exemplifiziert werden, um der Frage nachzugehen, ob das Kindschaftsverfahrensrecht mehr Effektivität verträgt.
The aim of the paper is to defend the project of transforming philosophy carried out in my book 'Vernunft und Temperament. Eine Philosophie der Philosophie'.
In section 1, I distinguish between five philosophical genres in which transformation plays a role: 1. academic texts in which transformation is simply a topic; 2. texts meant to adequately articulate through their form the transformative experiences of their authors; 3. texts aiming to enable the reader to transform herself; 4. texts on other texts; 5. manifestos defending the project of transforming philosophy.
Section 2 is such a manifesto. Its main thesis is: "What makes somebody - anybody - a good philosopher is that she is a real human being. " Many of the remaining 16 theses of the manifesto are elaborations on this main thesis. One example is the thesis that the philosophical activity is essentially a becoming - the development of an individual human being.

Der Beitrag behandelt die Bewältigung positiver Kompetenzkonflikte im Europäischen Zivil-, Straf- und Verwaltungsprozessrecht. Hierzu werden zunächst einige theoretische Grundlagen der Verfahrenskoordination und der Rechtsvereinheitlichung erörtert. Hierauf aufbauend erfolgt jeweils eine Bestandsaufnahme zur Verfahrenskoordination in den jeweiligen Teildisziplinen, von der ausgehend aktuelle Probleme aufgezeigt und zukünftige Entwicklungsperspektiven ergründet werden. In methodischer Hinsicht werden insbesondere die Potentiale (interdisziplinär-)vergleichender und damit allgemein-prozessualer Forschung unterstrichen.
Die anspruchsvolle Klausur behandelt zunächst Körperverletzungs- und Tötungsdelikte, wobei der Schwerpunkt auf schwierigen Zurechnungsproblemen aus dem Allgemeinen Teil liegt. Anschließend werden im Kontext von Vermögens- und Anschlussdelikten komplexe und wenig bekannte Beteiligungsfragen thematisiert, die zu eigenständiger Argumentation herausfordern.
Dieser Beitrag vergleicht die kommunale Verwaltungsdigitalisierung in Deutschland, Österreich und der Schweiz (DACH-Länder) als Vertreter der kontinentaleuropäisch-föderalen Verwaltungstradition bei zugleich unterschiedlichen Digitalisierungsansätzen und -fortschritten. Basierend auf Interviews mit 22 Expert*innen und Beobachtungen in je einer Kommune pro Land sowie Dokumenten-, Literatur- und Sekundärdatenanalysen untersucht die Studie, wie Verwaltungsdigitalisierung im Mehrebenensystem organisiert ist und welche Rolle dabei das Verwaltungsprofil spielt sowie welche Innovationsschwerpunkte die Kommunen im Hinblick auf die Leistungserbringung und die internen Prozesse setzen. Die Ergebnisse zeigen, dass der hohe Grad lokaler Autonomie den Kommunen ermöglicht, eigene Akzente in der Verwaltungsdigitalisierung zu setzen. Zugleich wirken die stark verflochtenen komplexen Entscheidungsstrukturen und hohen Koordinationsbedarfe in verwaltungsföderalen Systemen, die in Deutschland am stärksten, in Österreich etwas schwächer und in der Schweiz am geringsten ausgeprägt sind, als Digitalisierungshemmnisse. Ferner weisen die Befunde auf eine unitarisierende Wirkung der Verwaltungsdigitalisierung als Reformbereich hin. Insgesamt trägt die Studie zu einem besseren Verständnis dafür bei, welche Problematik die Verwaltungsdigitalisierung für föderal-dezentrale Verwaltungsmodelle mit sich bringt.
Art. 1 Abs. 2 Buchst. b der RL 93/83/EWG des Rates vom 27. September 1993 zur Koordinierung bestimmter urheber- und leistungsschutzrechtlicher Vorschriften betreffend Satellitenrundfunk und Kabelweiterverbreitung ist dahin auszulegen, dass ein Satellitenbouquet-Anbieter, der verpflichtet ist, für eine Handlung in Form der öffentlichen Wiedergabe über Satellit, an der er mitwirkt, die Zustimmung der Inhaber der betreffenden Urheberrechte und verwandten Schutzrechte einzuholen, diese Zustimmung – entsprechend der dem betreffenden Sendeunternehmen erteilten Zustimmung – nur in dem Mitgliedstaat einholen muss, in dem die programmtragenden Signale in die zum Satelliten führende Kommunikationskette eingegeben werden.

Verträge über nicht-personenbezogene Daten werden seit dem Data Act immer wichtiger. Gleichwohl ist deren rechtliche Qualifikation immer noch nicht abschließend geklärt. Auch wenn klar ist, dass Daten in aller Regel keinem geistigen Eigentumsrecht unterliegen, nur in seltenen Fällen Know-how sind und an ihnen kein Sacheigentum bestehen kann, benötigen die Verträge eine hinreichende rechtliche Grundlage ihres Gegenstands. Wir nehmen eine vergleichende Untersuchung der Nominierten und Preisträger:innen von sieben Buchpreisen im deutschsprachigen Raum vor, die mit einer vorab veröffentlichten Long- und/oder Shortlist arbeiten. Dazu vergleichen wir die Preise in Bezug auf soziodemographische Faktoren der Autor:innen (Geschlecht, Alter und Muttersprache), deren Bekanntheit zum Zeitpunkt der Nominierung (Aufrufe auf Wikipedia), die Anzahl vorheriger Nominierungen der Autor:innen für den gleichen Buchpreis, die ›Qualität‹ der ausgezeichneten Bücher (Anzahl der Rezensionen des nominierten Buches, positive bzw. negative Beurteilung in Rezensionen sowie die Einigkeit der Rezensent:innen darüber), das Ansehen der Verlage und die Geschlechterzusammensetzung der Jurys. Der Analysezeitraum umfasst 15 Jahre. Unser Datensatz beinhaltet Informationen zu 428 Autor:innen mit insgesamt 627 zwischen den Jahren 2005 und 2020 nominierten Büchern und 2.469 Rezensionen zu diesen Büchern. Der Datensatz wurde mittels mehrerer Methoden (z. B. Web-Scraping, Hand-Kodierung, Expert:innenbewertungen) aus verschiedenen Quellen (z. B. Web-Daten, Bibliothekskataloge, Expert:innenbewertungen) zusammengestellt. Auf diese Weise können wir unter anderem zeigen, dass für alle untersuchten Preise überwiegend deutsche Muttersprachler:innen mit gut rezensierten Büchern aus renommierten Verlagen nominiert werden und die Preise gewinnen.

Der Data Act bildet den vorläufigen Schlussstein der EU-Datenregulierung. Die verschiedenen Instrumente der Verordnung tarieren vor allem die Beziehungen der Datenökonomie mit Datenzugangsrechten, weitreichenden Regelungen zu Datenverträgen und Cloud-Services sowie mit spezifischen Interoperabilitätsvorgaben neu aus. Der Beitrag gibt – mit einem Schwerpunkt im Datenwirtschaftsrecht – einen Überblick über die Neuregelungen, zeigt übergreifende Weichenstellungen auf und benennt strukturelle Herausforderungen.

In Immobilienkaufverträgen finden sich nicht selten Vertragsklauseln, welche die Maklerprovision auf den anderen Beteiligten abwälzen sollen. Die rechtliche Ausgangssituation hat sich für diese sog. Maklerprovisionsklauseln durch die Novellierung des Maklerrechts (§§ 656a–656d BGB) im Zuge des Gesetzes über die Verteilung der Maklerkosten bei der Vermittlung von Kaufverträgen über Wohnungen und Einfamilienhäuser (BGBl. 2020 I 1245) grundlegend verändert. An diese Entwicklung knüpft die vorliegende Klausur an. Sie behandelt Grundfragen des Textformerfordernisses bei Abschluss eines Maklervertrags (§ 656a, § 126b BGB) sowie die Möglichkeiten und Grenzen der Provisionsabwälzung auf einen Verbraucher. Im Mittelpunkt des Falls steht eine Maklerprovisionsklausel aus der Kautelarpraxis. Damit dient der nachfolgende Beitrag nicht nur der Vermittlung des examensrelevanten neuen Maklerrechts, sondern auch der Förderung vertragsgestalterischer Fähigkeiten.

The paper addresses an under-researched chapter in the history of the Jewish Reform movement which is at the same time a commonly overlooked period in the biography of Leopold Zunz (1794–1886), one of the founding members of Wissenschaft des Judentums. By placing his eight-month appointment as a preacher to the Reform synagogue in Prague in its socio-political and biographical contexts, the article sheds new light at Zunz’s commitment for the religious renewal of Judaism. A schematic comparison between the development of the Reform movement in the German lands and the Habsburg Monarchy, at the beginning of the nineteenth century highlights the role of state involvement into internal Jewish affairs. Finally, the analysis of Zunz’s Synagogenordnung from 1836, according to the original manuscript from the National Library of Israel, allows a re-evaluation of the (Reform) synagogue as an institution for social disciplining of its members.

Die ›Klage der Kunst‹ Konrads wird auf dem Hintergrund und in Bezug zur Sangspruchdichtung sowie der Textfamilie allegorischer Erzählungen in der ersten Person untersucht. Während Strophik, Sangbarkeit und kunst-Thematik das Werk in den Kontext der Sangspruchdichtung rücken, stellt es sich durch seinen Umfang, seine Narrativität und das Erzähltempus, das die Handlung zwar nicht dominiert, aber rahmt, an die Seite erster früher Erzählexperimente, die Dialog, Streit oder Rede als erlebte Erfahrung eines Ich präsentieren wie das ›Frauenbuch‹ Ulrichs von Liechtenstein, das aber – ähnlich wie Konrads ›Klage der Kunst‹ – zu seiner Zeit offenbar nur mäßig erfolgreich, jedenfalls nur unikal überliefert, ist. Konrad scheint der erste zu sein, der in der höfischen Literatur das Erzählen in der ersten Person mit Allegorizität verknüpft. Er nutzt dieses neue und in der späteren Literatur so überaus fruchtbare Erzählformat geschickt, um seine eigene literarische Meisterschaft unter anderem in den Gestalten von wildekeit und kunst unter Beweis zu stellen, zu thematisieren und szenisch zu verhandeln.

Durch psychologische Sicherheit am Arbeitsplatz lässt sich vieles erreichen. Sie senkt den Krankenstand, schafft Bindung zum Arbeitgeber, ermöglicht tiefere kollegiale Beziehungen und erleichtert es, voneinander zu lernen. Dabei wird aus der Perspektive des Individuums auf die Organisation geschaut und ihre personellen Vertreter, die Leader. Dieser Beitrag betont hingegen die Bedeutung der Organisation und der Grenzen, welche diese setzt. Führungskräfte können tatsächlich für psychologische Sicherheit sorgen. Allerdings nutzen sie dafür oft die falschen Mittel.

Die digitale Transformation hat einen massiven Einfluss auf die Aus- und Umgestaltung von Organisationen und Strukturen. Dies gilt nicht nur für Unternehmen, sondern auch für die öffentliche Verwaltung. Dort laufen die Fragen der Digitalisierung auf und sollen in Entscheidungen übersetzt werden. Digitalisierungsthemen fügen sich allerdings
nicht in das typische Schema von Ministerien, Ressorts und Abteilungen ein: Sie können nur ressortübergreifend und unter Mitwirkung zahlreicher politischer, zivilgesellschaftlicher und wirtschaftlicher Akteure bearbeitet werden.
Dies widerspricht dem klassischen Zuständigkeitsprinzip in der Verwaltung, das eine gemeinsame Erarbeitung von Themen grundsätzlich nicht vorsieht.
Um Mitarbeitende langfristig ans Unternehmen zu binden und das Engagement in Teams hochzuhalten, fokussieren sich viele Maßnahmen zur Verbesserung des Betriebsklimas oder der Zufriedenheit auf die Motivation der Mitarbeitenden. Meist ist es jedoch lohnenswerter, die Zumutungen der organisationalen Struktur zuerst anzufassen. Häufig liegen dort die größten Motivationskiller - und somit auch die Hebel mit dem größten Potenzial für mehr Zufriedenheit.
In Krisenzeiten ist der Ruf nach Führung besonders populär. Dabei ist gerade Führung selbst eines der unsichersten Mittel, die der Organisation zur Verfügung stehen. Hingegen wird das Potenzial von Strukturen zu wenig gesehen. Wenn in unsicheren Situationen der Wunsch nach Orientierung und Klarheit groß ist, können häufig strukturelle Entscheidungen die notwendigen Sicherheiten vermitteln.
Reform als Zumutung

Zwar mag ein Reformwille der Verwaltung in Reden und Konzeptpapieren beschworen werden; häufig findet sich jedoch keine Realität, die dieser «Poesie der Reform» (Luhmann, 2000) entspricht. Sicher ist diese Darstellung etwas überspitzt. Verwaltungen von heute unterscheiden sich deutlich von denen vor 20, 40 oder 60 Jahren. Gleichwohl sind Reformen und Innovationen für Verwaltungen eine besondere Herausforderung und Zumutung. In diesem Artikel wollen wir herausarbeiten, worin dieser Zumutungsgehalt besteht: Warum tun sich Verwaltungen mit Innovationen oft schwer? Hierzu werden wir zentrale Besonderheiten herausarbeiten, welche die Verwaltung als Organisationstyp auszeichnen. In einem zweiten Schritt wird es dann möglich sein, danach zu fragen, unter welchen Bedingungen Innovationen gleichwohl gelingen können - oder ihr Gelingen mindestens wahrscheinlicher wird.

Das Anliegen, Theologie dialogisch zu betreiben, durchzieht das wissenschaftliche Schaffen und das kirchliche Engagement Bernd Oberdorfers. Dialogizität, Geselligkeit, Freundschaft und Partnerschaftlichkeit bilden nicht nur Themen in seinem Denken, sondern zeichnen auch seine Persönlichkeit aus.
Davon angeregt verfolgt der Sammelband verschiedene Ebenen und Felder menschlichen Zusammenlebens: von Nahbeziehungen in der Partnerschaft und Freundschaft bis hin zu nationalen und globalen Dialogen zwischen Kirchen und Diskursformen in der Gesellschaft. Schwerpunkte liegen auf den Themen Partnerschaft, Geselligkeit und Disput, interdisziplinären Begegnungen mit Literatur, Kultur und Ethik, Friedensethik und Frieden der Religionen und Dogmatik und weltweite Ökumene im Dialog zwischen Theorie und Praxis.
Wer Religion im mittelalterlichen und frühneuzeitlichen Europa untersuchen will, ist mit ähnlichen Schwierigkeiten konfrontiert wie bei der Anwendung des Begriffs in außereuropäischen Kontexten. Die Menschen damals verfügten allenfalls über vergleichbare, nicht aber identische Konzepte. In meinem Artikel werde ich drei dieser möglichen äquivalenten Religionskonzepte vorstellen und auf ihre Anschlussfähigkeit diskutieren: fides, lex und natio. Um diese Begriffe besser einordnen zu können, wird es zunächst darum gehen, einige grundsätzliche Unterschiede der Rolle von Religion im späten Mittelalter und der Frühen Neuzeit im Gegensatz zur Moderne in den Blick zu nehmen.
Das Risiko, durch einen Suizid im Gefängnis zu versterben, ist erhöht. Während der COVID-19-Pandemie wurden zum Infektionsschutz zahlreiche Maßnahmen, die beispielsweise eine deutliche Minderung der Kontakt- und Behandlungsangebote zur Folge hatten, eingeführt. Im Rahmen eines Kohortenvergleichs der Suizide und ausgewählter Merkmale der Suizident:innen in den Zeiträumen vom April 2017 bis zum Dezember 2019 sowie vom April 2020 bis zum Dezember 2022 wird untersucht, ob es eine Veränderung der Suizide während der Pandemie gab. Im Ergebnis zeigen sich eine Zunahme der Suizide während der Pandemie, insbesondere in den ersten 14 Tagen der Haft, und eine Zunahme der Suizide von Suizident:innen mit erhöhter Vulnerabilität. Keine Unterschiede wurden in den allgemeinen Risikomerkmalen für Suizide im Gefängnis festgestellt. Es ergeben sich Hinweise auf eine suizidpräventive Wirkung der Kontakt- und Behandlungsangebote. Daraus ergibt sich die Notwendigkeit, intensivere Präventionsangebote für Gefangene mit erhöhter Vulnerabilität bzw. geringerer Resilienz anzubieten.
Eine indifferente Gemengelage unterschiedlicher Erwartungen ist im Coaching nicht selten. Jeder will etwas anderes - was genau, weiß man häufig nicht. Oftmals ist man sich noch nicht einmal sicher, was man selbst will. Das führt zu Stress und Blockaden. Und die Optionen und Handlungsmöglichkeiten geraten aus dem Blick. Diese Situation ist auch vielen Führungskräften wohlbekannt.

Der Artikel analysiert aus organisationssoziologischer Perspektive wie die Bundeswehr Gleichstellungsrecht umsetzt. Das zentrale Argument lautet, dass die Bundeswehr das Gleichstellungsrecht managerialisiert, indem sie institutionalisierte Praktiken adaptiert, die es erlauben, das Gleichstellungsrecht für den Zweck der Personalgewinnung auszudeuten. Die Adaption dieser Praktiken wird maßgeblich dadurch begünstigt, dass sich das Gleichstellungsrecht als Lösung mit dem Problem der zukünftigen Personalgewinnung verknüpfen lässt, nachdem die Bundesregierung die Wehrpflicht aussetzte und beschloss, die Bundeswehr wieder zu vergrößern. Der beschriebene Prozess führt auch dazu, dass die Bundeswehr in der Umsetzung des Gleichstellungsrechtes zunehmend großen Unternehmen ähnlicher wird. Insgesamt leistet die vorliegende Studie einen Beitrag zur Analyse der Beziehung staatlicher Organisationen zu ihrer rechtlichen Umwelt.
Die Mehrheit aktueller Studien schätzt das Transformationspotenzial digitaler Technologien für Organisationen hoch ein. In Auseinandersetzung mit dieser Einschätzung entwickelt der Artikel eine konzeptionelle organisationssoziologische Perspektive auf das Verhältnis von Organisation und digitalen Technologien. Wir nutzen diese Perspektive, um den Fall des Predictive Policing in Deutschland zu betrachten und die Entscheidung zur Adaption der Technologie, ihre organisationale Situierung sowie die Rolle des Organisationstyps zu diskutieren. Unsere Perspektive führt zu einem zurückhaltenden Urteil über das Transformationspotenzial dieser digitalen Technologie, die wir daher als Reform unter anderen Reformen begreifen. Insgesamt argumentieren wir dafür, Digitalisierung stärker als bisher als heterogenen Prozess zu verstehen.
Informatische Bildung spielt eine immer zentralere Rolle in der Bildung einer Gesellschaft des 21. Jahrhunderts. Für den Chemieunterricht ergeben sich daraus zwei Aspekte: Einerseits können Konzepte der informatischen Bildung dabei helfen, chemie- und naturwissenschaftsspezifische Denk- und Arbeitsweisen zu fördern. Andererseits kann der Chemieunterricht einen Beitrag für die informatische Bildung leisten. Dieser Artikel geht auf beide Aspekte ein und versucht die gegenseitigen Vorteile der informatischen Bildung und der naturwissenschaftlichen Bildung im Chemieunterricht darzustellen.
Ausgehend von der Debatte um die Genderaspekte der Digitalisierung der Arbeit untersuchen wir den Zusammenhang zwischen der Nutzung digitaler Technologien und der Entwicklung von Geschlechterungleichheiten empirisch. Die Ergebnisse zeigen, dass Frauen in Branchen mit hohem Digitalisierungsgrad unterrepräsentiert sind und dass sich diese Dimension der Geschlechtersegregation in den letzten Jahren verstärkte. Die Unterrepräsentation von Frauen in Branchen mit hohem Digitalisierungsgrad geht mit Nachteilen bei den Verdiensten einher. Die Ergebnisse zeigen zudem, dass der Gender Pay Gap in Branchen mit hohem Digitalisierungsgrad tendenziell größer ist und über die Zeit weniger zurückging als in Branchen, in denen weniger digitale Technologien genutzt werden.
Der Beitrag behandelt eine Marginalie der strafrechtlichen Fallbearbeitung, die "Vorprüfung“ bei der Erörterung von Versuchsstrafbarkeit. Fehler sind hier selten, kommen aber in der Universitäts- und Examensrealität vor. Zu ihrer Vermeidung gibt der vorliegende Beitrag einige Ratschläge und Hinweise.

Der Beitrag in der Zeitschrift GIO beschäftigt sich mit der Frage nach den Schwierigkeiten von Digitalisierungsreformen in öffentlichen Verwaltungen. Der Blick wird dafür auf Verwaltungen als Organisationen gerichtet, deren formale Strukturen die Digitalisierungsreform erschweren, da steile Hierarchien und Dienstwegeregelungen mit netzwerkartigen Projektstrukturen konfligieren, agile Arbeitsweisen der Orientierung an rechtlich legitimierten Verfahren zuwiderlaufen und das Personal nicht mit den nötigen Kompetenzen ausgestattet wird. Der organisationssensible Fokus erlaubt es, nicht nur die Probleme der Strukturen zu betrachten, sondern auch deren Funktionen für den Systembestand von Verwaltungen zu berücksichtigen. So wird gezeigt, dass etwa Dienstwegeregelungen demokratische Prozesse gewährleisten und Verantwortungsdiffusion verhindern, ihre Rechtsorientierung den Verwaltungen Legitimation und Autonomie verschafft und das Personal durch seine Regeleinhaltung funktionierende Verfahren und Objektivität gewährleistet. Diese Spannungsfelder berücksichtigend, wird daher der Vorschlag gemacht, in Reformen nicht nur ihre Optimierungsfunktion zu sehen, sondern sie als Werkzeug für ein besseres Verständnis der vorherrschenden Strukturen zu nutzen. Der Beitrag gibt abschließend Fragen an die Hand, wie man sich diesem Verständnis nähern kann.
New work – old problem?

Die Nutzung digitaler Kollaborationstools wird als Vorausset-
zung für eine postbürokratische New Work-Welt erachtet. Organisationale Digita-
lisierungsprojekte zur Einführung solcher Kollaborationssoftware sind selbst post-
bürokratisch strukturiert, d. h. sie arbeiten in crossfunktionalen und selbstorgani-
sierten Teams. Während der Kooperation mit anderen Organisationseinheiten treten
Konflikte auf, die sich dadurch verschärfen, dass sie nicht von der Hierarchie ge-
löst werden können, sondern im Sinne von New Work demokratisch ausgehandelt
werden müssen. In der Folge bedarf es alternativer formaler Strukturen, die diese
Herausforderung bewältigen.
„Gender-Ideologie“ und „Gender-Wahn“– diese Begriffe entstammen einem antifeministischen Diskurs, der ohne Bedrohungsszenarien nicht funktioniert. Feministische Errungenschaften – wie die Ehe für alle – werden zur Ursache persönlicher Nachteile umgedeutet. Seine Vertreter*innen verbreiten ihre (oft gewaltvollen) Narrative sowohl auf der Straße als auch im Internet. Antifeministische Bewegungen weisen zudem vielfältige Querverbindungen mit konservativen, nationalistischen, fundamentalreligiösen und faschistischen Diskursen auf.
