»Dolus alternativus« und »Anstiftung« sind zwei Begriffe des materiellen Strafrechts, die zum Stoff des juristischen Studiums und der ersten juristischen Prüfung gehören. Die »Tatsachenalternativität« ist ein spezielles Ergebnis der Beweisaufnahme in der strafgerichtlichen Hauptverhandlung, das eine besondere Herausforderung für die gerichtliche Urteilsfindung darstellt. Es handelt sich also um ein strafprozessuales Phänomen, mit dem der angehende Jurist in seinem Studium meistens in Gestalt der »Wahlfeststellung« konfrontiert wird. Zwar haben die Themen »dolus alternativus« und »Wahlfeststellung« in der juristischen Prüfung eher periphere Bedeutung, sollten aber bei der Vorbereitung auf das Examen nicht vernachlässigt werden. Da der Aspekt der Alternativität beiden Gegenständen ihre spezifische Prägung verleiht, bestehen Ähnlichkeiten und somit auch Verwechslungsgefahr. Deswegen wird beides hier in einem Text behandelt. Die Anstiftung wurde hinzugefügt, weil die Komplexität der dolus-alternativus-Fälle dadurch erhöht wird. Zudem wird dieser Aspekt in der Literatur zum dolus alternativus bislang nicht berücksichtigt.
