Mit ähnlich rasender Geschwindigkeit wie das Coronavirus sich ausbreitet, hat der Begriff der „Triage“ einen Spitzenplatz in der Rangliste der Lieblingsthemen strafrechtswissenschaftlicher Publikationen errungen. Die Zahl der Aufsätze, in denen über die strafrechtliche Behandlung der „ex ante“-, „ex post“- und „präventiven“ Triage informiert wird, ist beachtlich. Über vieles herrscht Konsens, z.B. die Relevanz der „Pflichtenkollision“ für die „ex ante“-Triage. Deutlich sind inzwischen auch die Akzente der kontroversen Debatte um die „ex post“-Triage“ herausgearbeitet. Eher ein Schattendasein fristet die „präventive“ Triage. Der vorliegende Beitrag setzt Bekanntes weitgehend voraus und möchte der Diskussion einige Denkanstöße hinzufügen, die nach meiner Beobachtung noch nicht (genügend) thematisiert wurden.

Jüngst hat der BGH zu der Frage Stellung genommen, ob Garantenstellungen i. S.v. § STGB § 13 StGB zur Fussnote 1 „besondere persönliche Merkmale“ sind und bei Beteiligung mehrerer an einem unechten Unterlassungsdelikt folglich § STGB § 28 StGB zu beachten ist. Der BGH hat diese Frage bejaht. Nicht dazu soll hier ein Diskussionsbeitrag geliefert werden, sondern zu einem Teil der Entscheidung, der nicht strittig zu sein scheint: die Erfüllung von Mordmerkmalen gemäß § STGB § 211 Abs. STGB § 211 Absatz 2 StGB durch eine Tat, die ein unechtes Unterlassungsdelikt ist. Für die Leser einer Fachzeitschrift mit dem Fokus „Straßenverkehr“ könnte das Thema interessant sein, weil sich der Fall im Straßenverkehr ereignete und das entscheidungsgegenständliche Verhalten ein Akt der Teilnahme am Straßenverkehr war.
"Angriffsprovokation" ist die Bezeichnung für eine Fallgruppe der sog. sozialethischen Notwehreinschränkungen. Dieses Thema ist extrem prüfungsrelevant und wegen seiner Komplexität bei Studierenden wahrscheinlich gefürchtet. Rechtsprechung und Literatur dazu sind nahezu uferlos. Eine spezielle Konstellation lauerte aber bis jetzt im Verborgenen, weil Lehrbücher über sie hinweggehen und die Rechtsprechung noch keine Gelegenheit hatte, zu ihr Stellung zu nehmen: die „Nothilfeprovokation“. Nunmehr liegt eine BGH-Entscheidung vor, in deren Mittelpunkt dieses Thema steht. Wahrscheinlich werden Verfasser von Prüfungsaufgaben sich davon gern inspirieren lassen. Leser der folgenden Abhandlung sollten solchen „Prüferattacken“ furchtlos entgegensehen können.
Am 11.6.2021 hat der Deutsche Bundestag das „Gesetz über die unternehmerischen Sorgfaltspflichten in Lieferketten“ verabschiedet. Das Gesetzgebungsprojekt war von Anfang an umstritten und der Gesetzestext, der jetzt vom Parlament mit der Mehrheit der Regierungskoalition beschlossen wurde, stellt auch nicht jeden zufrieden. Klärungsbedarf bringt die Einbeziehung des Ordnungswidrigkeitenrechts in dieses Gesetz mit sich. Dazu sollen hier einige Bemerkungen gemacht werden.
