§ 217 StGB reiht sich in andere kriminalpolitische Projekte des Gesetzgebers ein, die sich dem Einwand des fehlenden Rechtsgutsbezugs ausgesetzt sehen.
Die Untersuchung zeigt auf, dass der Gesetzgeber mit der Einführung des § 217 StGB den Zweck des Strafrechts als „ultima-ratio“ des Rechtsgüterschutzes verfehlt hat. Auch wenn er mit der Norm den Schutz von Leben und Autonomie bezweckt hat, ist ihm die Umsetzung des Schutzes dieser Rechtsgüter nicht gelungen. Die Vorschrift dient vielmehr dem Zweck der Verhinderung einer Suizidkultur. Nach der systemkritischen Rechtsgutslehre kann ein solcher „moralischer“ Zweck jedoch kein strafrechtlich zu schützendes Rechtsgut darstellen.
Da eine Aufhebung der Vorschrift durch das Bundesverfassungsgericht wenig wahrscheinlich erscheint, schließt sich der Rechtsgutsdiskussion eine praxisorientierte Auslegung der Norm unter dem Gesichtspunkt des überindividuellen Zwecks, der Verhinderung einer Suizidkultur, an.

Mittels hochauflösender, kompakter Kameras bedienten sich Voyeure beim sprichwörtlichen „Blick unter den Rock“ lange eines digitalen Auges zur ungesühnten Stillung ihrer Gelüste. Damit wird in absehbare Zeit Schluss sein. Die Literatur und Politik befinden sich nunmehr im Rahmen einer lebendigen Debatte auf der Suche nach der rechtsdogmatisch zutreffenden Einordnung einer geeigneten Strafnorm.
§ 219a StGB

„Und damit ist der Gesetzentwurf angenommen“, heißt es am Freitag den 24. Juni 2022 um 10:33 Uhr im Deutschen Bundestag. Unter Zustimmung der Fraktionen Die Linke, SPD, Bündnis 90/Die Grünen und FDP wurde soeben die Streichung des § 219a StGB beschlossen. § 219a StGB stellte es bis dahin unter Strafe, wenn Ärzt:innen frei zugänglich Informationen zum Schwangerschaftsabbruch etwa auf ihrer Website zur Verfügung stellten. Der vorliegende Beitrag gibt einen chronologischen Überblick über diese nun historische Norm von deren Entstehung bis zu ihrer jüngst beschlossenen Abschaffung.
Eine vollumfängliche Beleuchtung des § 219a StGB ist insbesondere aufgrund der divergierenden Ansichten zur Geschichte der Norm, des Normcharakters und der mit der Abschaffung einhergehenden weiteren Reformbestrebungen lohnenswert.
