Transitional Justice

This publication deals with the topic of transitional justice. In six case studies, the authors link theoretical and practical implications in order to develop some innovative approaches. Their proposals might help to deal more effectively with the transition of societies, legal orders and political systems.
Young academics from various backgrounds provide fresh insights and demonstrate the relevance of the topic. The chapters analyse transitions and conflicts in Sierra Leone, Argentina, Nicaragua, Nepal, and South Sudan as well as Germany’s colonial genocide in Namibia. Thus, the book provides the reader with new insights and contributes to the ongoing debate about transitional justice.
Der Band enthält die Vorträge einer Konferenz vom November 2009 in Potsdam. Die Texte untersuchen anhand ausgewählter Beispiele die Entwicklungen der zurückliegenden zwanzig Jahre im Zivilrecht, Strafrecht und öffentlichen Recht. Die Bundesrepublik Deutschland sieht sich seit der Wiedervereinigung und dem Ende des Kalten Krieges in einer ganz neuen Situation. Dies gilt für den völkerrechtlichen Rahmen ihrer Außenpolitik, für den Wettbewerb der Rechtsordnungen, für die mit erhöhter Dynamik fortschreitende europäische Einigung und ihre Konsequenzen. Die bei der Grundrechtsinterpretation im Mehrebenensystem auftauchenden Divergenzen und die Auswirkungen technischer Neuerungen auf das Sozialverhalten prägen Rechtswirklichkeit und Rechtsdogmatik.
Transitional Justice bezeichnet staatliche Anstrengungen um vergangene Menschenrechtsverletzungen am Ende von Represionen aufzuarbeiten. Reparationszahlungen an die Opfer, die eines der Hauptinstrumente staatlicher Aufarbeitung darstellen können, blieben in der Transitional Justice-Literatur vergleichweise unerforscht. Dieses Buch versucht diese Lücke zu schließen und fragt, warum manche Staaten solche Programme eingeleitet haben, während andere junge Demokratien darauf verzichteten. Dabei setzt sie Reparationszahlungen in den Kontext anderer Transitional Justice-Maßnahmen und greift gleichzeitig zwei Haupterklärungsansätze für gerichtliche Verfahren und Wahrheitskommissionen auf. In diesem Zusammenhang ist die Frage, inwieweit Transitional Justice aus moralischer Überzeugung oder aus taktischem Kalkül der neuen Eliten eingeleitet wurde. In dem die Arbeit diese Frage am Beispiel der Zahlung von Entschädigungsleistungen diskutiert, kann sie auch Aussagen darüber machen, wie valide die bestehenden Erklärungsansätze für Transitional Justice sind. Anhand der südamerikanischen Regimewechsel in den 1980ern wird aufgezeigt, dass Reparationszahlungen oft zur Legitimation von Amnestien verwendet wurden. Wenn Täter und Opfer relativ starkes Drohpotential besaßen, versuchten Regierungen den Opfern durch Entschädigung entgegenzukommen um Amnestien für die Täter bei gleichzeitiger Anerkennung der Taten zu rechtfertigen. Entschädigungszahlungen wurden somit oft aus strategischen Erwägungen geleistet, was man bei der normativen Bewertung dieser Programme berücksichtigen sollte.
Between 2002 and 2006 the Colombian government of Álvaro Uribe counted with great international support to hand a demobilization process of right-wing paramilitary groups, along with the implementation of transitional justice policies such as penal prosecutions and the creation of a National Commission for Reparation and Reconciliation (NCRR) to address justice, truth and reparation for victims of paramilitary violence. The demobilization process began when in 2002 the United Self Defence Forces of Colombia (Autodefensas Unidas de Colombia, AUC) agreed to participate in a government-sponsored demobilization process. Paramilitary groups were responsible for the vast majority of human rights violations for a period of over 30 years. The government designed a special legal framework that envisaged great leniency for paramilitaries who committed serious crimes and reparations for victims of paramilitary violence. More than 30,000 paramilitaries have demobilized under this process between January 2003 and August 2006. Law 975, also known as the “Justice and Peace Law”, and Decree 128 have served as the legal framework for the demobilization and prosecutions of paramilitaries. It has offered the prospect of reduced sentences to demobilized paramilitaries who committed crimes against humanity in exchange for full confessions of crimes, restitution for illegally obtained assets, the release of child soldiers, the release of kidnapped victims and has also provided reparations for victims of paramilitary violence. The Colombian demobilization process presents an atypical case of transitional justice. Many observers have even questioned whether Colombia can be considered a case of transitional justice. Transitional justice measures are often taken up after the change of an authoritarian regime or at a post-conflict stage. However, the particularity of the Colombian case is that transitional justice policies were introduced while the conflict still raged. In this sense, the Colombian case expresses one of the key elements to be addressed which is the tension between offering incentives to perpetrators to disarm and demobilize to prevent future crimes and providing an adequate response to the human rights violations perpetrated throughout the course of an internal conflict. In particular, disarmament, demobilization and reintegration processes require a fine balance between the immunity guarantees offered to ex-combatants and the sought of accountability for their crimes. International law provides the legal framework defining the rights to justice, truth and reparations for victims and the corresponding obligations of the State, but the peace negotiations and conflicted political structures do not always allow for the fulfillment of those rights. Thus, the aim of this article is to analyze what kind of transition may be occurring in Colombia by focusing on the role that transitional justice mechanisms may play in political negotiations between the Colombian government and paramilitary groups. In particular, it seeks to address to what extent such processes contribute to or hinder the achievement of the balance between peacebuilding and accountability, and thus facilitate a real transitional process.
Für den Umgang post-autoritärer Gesellschaften mit den Tätern von Menschenrechtsverletzungen der Vorgängerregime gibt es zahlreiche Möglichkeiten. Neben der legalen Strafverfolgung haben sich seit Mitte der 1970er Jahre vor allem Wahrheitskommissionen als Form gegenseitiger Versöhnung zwischen Tätern und Opfern etabliert. Die vorliegende Studie gibt aus der Perspektive der vergleichenden Politikfeldforschung eine Antwort auf die Frage, welche politischen Faktoren der Wahrheitskommissionen in Uruguay, Panama und Ghana zu einer Verzögerung bei den Aufarbeitungsprozessen nach der Transition führen. Dazu werden aus der Theorie von Transitional Justice Hypothesen zur Machtverteilung, dem Ausmaß der Menschenrechtsverletzungen und den zivil-militärischen Reformen für verspätete Wahrheitskommissionen abgeleitet, welche zur Plausibilisierung der Verzögerung beitragen. Im empirisch-analytischen Teil der Arbeit wird in der Untersuchungs- und Kontrollgruppe deutlich, dass im Vergleich zu transitionsnahen Wahrheitskommissionen ein niedrigeres Niveau an Menschenrechtsverletzungen den politischen Druck für die Aufarbeitung hemmt und die Täter als demokratisch gewählte Machthaber nach der Transition kein Interesse an der Wahrheit haben (Ghana und Panama) bzw. mit den neuen Machthabern paktierten (Uruguay). Zudem zeigt die Studie, dass zivil-militärische Reformen keinen Einfluss auf die Aufarbeitung der Wahrheit haben, wie in der Literatur argumentiert wird. Auch wird angezweifelt, dass sich die politische Machtverteilung bei der Einsetzung von Wahrheitskommissionen im Gleichgewicht befindet.
Hugo Grotius: Mare Liberum

Im März 1609 erschien die Schrift „Mare Liberum“. Das aus diesem Anlaß durchgeführte Podiumsgespräch „Hugo Grotius: Mare Liberum – Zur Aktualität eines Klassikertextes“ erörterte zunächst den Typus des Klassikertextes und untersuchte Aspekte der Grotius-Rezeption. Danach wurde erörtert, inwieweit der Protestant Grotius von Ideen des Katholiken de Vitoria beeinflußt war und was dies für die Webersche Einordnung des Kapitalismus bedeutet. Abschließend stellte das Podiumsgespräch dann den Bezug zur heutigen Situation her und behandelte die Bedrohung der Freiheit der Meere durch Piraterie und setzte sich mit den Gegenmaßnahmen der Europäischen Union auseinander. Die Publikation enthält die ersten drei Beiträge aus der Feder von Markus Kotzur, Johannes Thumfart und Norman Weiß. Kotzur entwickelt den Begriff des Klassikertexts und macht an den verschiedenen Kategorien – literarische Texte, philosophische, staats- und gesellschaftstheoretische Entwürfe, politische Texte und spezifische Rechtstexte – die jeweiligen Wirkungsmöglichkeiten anschaulich. Er schildert sodann die Besonderheit der spezifisch juristischen Wirkweisen aller Kategorien von Klassikertexten in der völkerrechtlichen Theorie und Praxis gleichermaßen. Weiß schildert die Entstehungshintergründe von „Mare liberum“ und geht darauf ein, wie und warum ein für den konkreten Einzelfall entstandenes Parteigutachten bereits nach wenigen Jahren zum allgemein bedeutsamen Rechtstext werden konnte. In einem zweiten Schritt wird kurz angerissen, wie sich die Rezeption dieses Klassikertexts im zwanzigsten Jahrhundert darstellt. Thumfart unternimmt es, die These Max Webers, der Kapitalismus sei durch den Protestantismus begünstigt worden, um die eigene These zu ergänzen, auch die katholische Religion habe sich förderlich erwiesen: Grotius habe seine Idee eines universalen, natur- und gottgewollten Rechts auf Freihandel in Abhängigkeit von dem katholischen Missionsgedanken entwickelt, wie er knapp sechzig Jahre vor Grotius von dem spanischen Dominikaner Francisco de Vitoria formuliert wurde.
Die Apartheid in Südafrika war ein Unrechtssystem. Zu den Grausamkeiten des Regimes zählten Massaker, Folter, Mord, Freiheitsberaubung, Zwangsumsiedlung, ökonomische Benachteiligung und alltägliche Diskriminierung. Was nach dem Ende eines solchen Unrechtssystems bleibt, ist die Frage nach dem Umgang mit der Vergangenheit. Die drei grundlegenden Möglichkeiten der Vergangenheitsbewältigung sind die rein justiziare Aufarbeitung, eine Generalamnestie oder ein drittes Modell, das zum Ziel hat, die Vorteile der beiden anderen Strategien zu vereinen. In Südafrika versuchte man, auch als Kompromiss aller Beteiligter, diesen dritten Weg mit der Einrichtung der Wahrheits- und Versöhnungskommission, die mittlerweile weltweit zum Sinnbild dieser Form der Vergangenheitsbewältigung geworden ist. Das Ziel der Studie war dabei zu klären: War die Wahrheits- und Versöhnungskommission in Südafrika als Strategie der Vergangenheitsbewältigung erfolgreich? Im Einzelnen widmete sich die TRC in drei Hauptausschüssen (Menschenrechtsausschuss, Amnestieausschuss und Wiedergutmachungsausschuss) den folgenden Zielen: Aufklärung der Menschenrechtsverletzungen, Klärung des Verbleibs verschwundener Personen, Klärung dessen, was während der Apartheid und der Übergangsphase zerstört wurde um die Verbrechen zu verschleiern, Wiedergutmachung für die Opfer und Amnestierung der Täter bei politisch motivierten Taten. Dieser letzte Punkt war jedoch an die völlige Offenlegung der Tat und ein öffentliches Eingeständnis gebunden. Zum einen zeigt die Analyse die großen Erfolge der Wahrheits- und Versöhnungskommission in Südafrika. Sie hat mehr und vor allem genauere Informationen über die Apartheid zusammengetragen, als je eine andere Untersuchung es geschafft hat. Mit der starken Beteiligung der Bevölkerung am Prozess der Aufklärung konnte sie einen Prozess in Gang bringen, der zur Entstehung einer neuen Menschenrechtskultur beitrug und auch einen Anstoß zur Versöhnung gab. Durch die intensive Aufarbeitung der Vergangenheit in einem gesamtgesellschaftlichen Prozess schaffte es die TRC auch, eine politische Kultur anzuregen, die unentbehrlich ist, will man nach einem Unrechtssystem eine demokratische Zukunft aufbauen. Das Verständnis oder zumindest eine Ahnung von dem was Menschenrechtsverletzungen bedeuten, wurde in dieser Zeit tief im Bewusstsein der meisten Südafrikaner verankert. Es wurde eine „operative Wahrheit“ geschaffen, die, wenn auch unter Protesten aller Parteien, letztlich anerkannt wurde und somit ein zukünftiges Leugnen der Apartheidsverbrechen unmöglich machte. Aber auch die Befreiungsbewegungen mussten brutale Verbrechen eingestehen. Zum anderen wird ebenso deutlich, dass die gestellten Anforderungen bei weitem zu hoch waren. Obwohl große Bereiche der alltäglichen Apartheid komplett unberücksichtigt blieben. Bei der Wahrheitsfindung wurde deutlich, dass die drei Ausschüsse weit von einer wirklichen Aufklärung der Untaten der Apartheid entfernt blieben. Auch in Bezug auf die Täter erreichte die Kommission nur zum Teil ihre Ziele. Verglichen mit den aufgeklärten Verbrechen, beantragte nur ein Bruchteil der Täter Amnestie. Die Logik, durch den Anreiz der Straffreiheit eine rege Beteiligung der Täter am Aufklärungsprozess zu erreichen, ging nicht auf. Bei der Wiedergutmachung zeigte sich, dass es einer der größten Konstruktionsfehler der TRC war, die Umsetzung der Entschädigungen dem Parlament und der Regierung zu überlassen. Der Wiedergutmachungsausschuss erarbeitete lediglich Vorschläge an den Präsidenten. Die wurden jedoch nie in dieser Form umgesetzt und stellten damit die TRC als Ganze bei Teilen der schwarzen und farbigen Bevölkerung in Frage. Einen direkten Zusammenhang zwischen der TRC und einer Befriedung der Bevölkerung herzustellen, wäre vermessen. Noch immer ist Südafrika ein gespaltenes Land. Ähnliches gilt bei der Legitimierung und Konsolidierung der neuen demokratischen Ordnung. Auch hier ist die Kommission ein Baustein, auf den nicht verzichtet werden konnte. Ihr diesen Erfolg, und es ist ein Erfolg im heutigen Südafrika, alleine zuzuschreiben, wäre eine extreme Überschätzung ihrer Möglichkeiten. Unterm Strich bleibt: Die TRC konnte nicht all ihre Ziele erreichen, aber sie hat sich gerade unter den Voraussetzungen des Übergangsprozesses als eine sinnvolle Form der Vergangenheitsbewältigung erwiesen, die grundlegend wichtige Ergebnisse erarbeiten konnte. Sie kann somit trotz der Berücksichtigung einer Vielzahl von Problemen als Erfolg gewertet werden.
