This study is analysing the transformation of Slovak administration in the telecommunication sector between 1989 and 2004. The dynamic telecom sector forms a good example for the transition problems of post-socialist administration with special regard to the regulation regime change. After describing briefly the role of the telecom sector within economy, the Slovak sectoral policy is analysed. The focus is layed on telecom legislation (including the regulation framework), liberalization of the telecom market and privatisation of the former state owned telecom operator. The transformation of the organizational structure of the "Slovak telecommunication administration" is analysed in particular at the level of the ministry and the regulating agency.
The development of the Polish telecommunications administration in the years 1989/90 to 2003 is marked by the processes of liberalisation and privatisation the telecommunications sector underwent during that period. The gradual liberalisation of the Polish telecommunications sector started as early as 1992. In the beginning, national strategies were pursued. The most important of these was the creation of a bipolar market structure in the local area networks. In the second half of the 1990ies the approaching EU membership accelerated the process of liberalisation and consequently the development of a framework of regulations. EU standards are more directed towards setting out a legal framework for regulation than prescribing concrete details of administrative organisation. Nevertheless, the independent regulatory agencies typical for Western Europe served as a model for the introduction of a new regulatory body responsible for the telecommunications sector in Poland. The growing influence of EU legislation changed telecommunications policy as well as administrative practices. There has been a shift of responsibilities from the ministry to the regulatory agency, but the question remains, if the agency gained enough power to fulfil its regulatory function. In the following the legislative framework created by the EU in telecommunications policy will be described and the model of independent regulatory agencies, as it is typical for most EU countries, will be introduced. Some categories for the analysis of the Polish regulatory system will be deduced from the discussion on the regulations of telecommunication in the established EU-Nations (see Böllhoff 2002 and 2003, Thatcher 2002a and 2002b, Thatcher/Stone Sweet 2002). Subsequently the basic features of Polish telecommunication policies in the 1990ies and its effects on the telecommunications sector will be outlined. In the third chapter the development of organisational structures on the ministerial level and within the regulatory agency will be examined. In the forth chapter I will look at the distribution of power and the coordination of the various authorities responsible for telecommunication regulations. The focus of this chapter is on the Polish regulatory agency and its relationships with the ministry, with the anti-monopoly office and with the Broadcasting and Television Council. In a conclusion, the main findings will be summed up.
Ethik, Integrität und Korruption : Neue Herausforderungen im sich wandelnden öffentlichen Sektor?

Im öffentlichen Sektor hat, wie wir wissen, in den letzten 10-20 Jahren ein erheblicher Wandel stattgefunden. Die staatlichen Strukturen haben sich immer mehr ausdifferenziert und öffentliche Leistungen werden in sehr unterschiedlichen Erledigungsformen erbracht. Ein beachtlicher Teil der Leistungen ist auf private Dritte ausgelagert oder ganz privatisiert worden. Zudem haben sich verschiedene Muster von öffentlich-privaten Kooperationen herausgebildet. Verwaltungen und öffentliche Unternehmen wurden unter verstärkten Leistungsdruck und Wettbewerb gesetzt. All das führte zu einer weithin wahrnehmbaren Ökonomisierung und „Managerialisierung“ des öffentlichen Sektors, die verständlicherweise auch Werte und Verhaltensweisen der öffentlich Beschäftigten beeinflusst hat. Daraus ergeben sich ohne Zweifel erhebliche Konsequenzen für die Integrität der Akteure im öffentlichen Sektor sowie für deren Korruptionsanfälligkeit. Das Personal stellt zweifellos ein Erfolgspotenzial dar. Es verkörpert eine wertvolle Ressource. Angesichts der Tatsache, dass viele Aufgaben komplexer und dynamischer werden, ist zu bedenken, dass diese eben nur von Menschen erledigt werden können und technische Hilfsmittel letztlich Selbstzweck sind. Ganz gleich, ob in der Privatwirtschaft oder in öffentlichen Unternehmen.
This diploma thesis deals with the process of political and administrative decentralisation in the Kingdom of Lesotho. Although decentralization in itself does not automatically lead to development it became an integral part of reform processes in many developing countries. Governments and international donors consider efficient decentralized political and administrative structures as essential elements of “good governance” and a prerequisite for structural poverty alleviation. This paper seeks to analyse how the given decentralization strategy and its implementation is affecting different features of good governance in the case of Lesotho. The results of the analysis confirm that the decentralisation process significantly improved political participation of the local population. However, the second objective of enhancing efficiency through decentralisation was not achieved. To the contrary, in the institutional design of the newly created local authorities and in the civil service recruitment policy efficiency considerations did not matter. Additionally, the created mechanisms for political participation generate relevant costs. Thus it is impossible to judge unambiguously on the contribution of decentralisation to the achievement of good governance. Different subtargets of good governance are influenced contrarily. Consequently, the adequacy of the concept of good governance as a guiding concept for decentralisation policies can be questioned. The assessment of the success of decentralisation policies requires a normative framework that takes into account the relations between both participation and efficiency. Despite the partly reduced administrative efficiency the author’s overall impression of the decentralisation process in Lesotho is positive. The establishment of democratically legitimised and participatory local governments justifies certain additional expenditure. However, mistakes in the design and the implementation of the decentralisation strategy would have been avoidable.
Im Rahmen der fünften Erweiterungswelle der EU um zwölf neue Mitgliedsstaaten setzte die EU-Kommission erstmals auf das Instrument der Verwaltungspartnerschaften. Das sogenannte Twinning umfasst Projekte, bei denen Behördenmitarbeiter aus Verwaltungen der EU-Mitgliedsstaaten in Partnerbehörden der Beitrittsländer entsandt werden, um diese bei der Umsetzung des EU-Rechtsbestandes zu beraten. Im Gegensatz zur bisherigen Forschungsliteratur, die sich vor allem auf die Europäisierung der Beitrittsländer konzentriert, geht die Autorin dieser Forschungsarbeit davon aus, dass Twinning-Projekte auch zur Europäisierung der beteiligten deutschen Verwaltungen beitragen. Mithilfe neo-institutionalistischer Ansätze entwickelt die Autorin die These, dass Twinning-Projekte den Handlungsspielraum der involvierten Akteure innerhalb der europäischen Dimension erheblich erweitern. Inwieweit diese Akteure die von der EU-Kommission im Rahmen des PHARE-Programms zur Verfügung gestellten materiellen und immateriellen Ressourcen tatsächlich genutzt haben, wurde für vier deutsche Bundesressorts (BMWi, BMU, BMI, BMG) vergleichend untersucht. Als Ergebnis kann festgehalten werden, dass Effekte vertikaler Europäisierung stark von der Unterstützung nationaler Entscheidungsträger abhängen. Effekte horizontaler Europäisierung in den deutschen Ministerialverwaltungen werden hingegen vom Engagement der einzelnen Akteure bestimmt. Hier entstehen neue Kontakte und Netzwerke, die auf Formen neuartigen Regierens in der EU hinweisen (European Governance).
Die vorliegende Arbeit untersucht am Beispiel der Stadtstaaten Berlin und Hamburg konkrete Handlungsoptionen des strategischen Personalmanagements angesichts unausgewogener Altersstrukturen in der Landesverwaltung unter den Rahmenbedingungen des öffentlichen Dienstes. Vor dem Hintergrund einer abnehmenden Erwerbsbevölkerung und der sinkenden Attraktivität des öffentlichen Dienstes als Arbeitgeber wird das Thema „Personal“ als die Schlüsselressource für die Leistungsfähigkeit der deutschen Verwaltung identifiziert. Die Untersuchung zeigt auf, wie eine absehbare Überalterung des Personalkörpers die Leistungserbringung der öffentlichen Verwaltung beeinträchtigen wird. Sie weist nach, dass sich beide Stadtstaaten bereits heute mit punktuellem Fachkräftemangel in technischen und Spezialisten-Berufen, aber auch bei Lehren und Ärzten, konfrontiert sehen. Diese Herausforderungen werden sich durch massive Altersabgänge ab dem Jahr 2015 und eine Alterung des bleibenden Personalkörpers noch erheblich verstärken. Die Untersuchungsergebnisse zeigen jedoch, dass die hamburgische Verwaltung, aufbauend auf einer langen Modernisierungshistorie und erleichtert durch Akteurszentralismus und eine ressortübergreifend abgestimmte quantitative und qualitative Personalbedarfsplanung, über einen gut institutionalisierten und gelebten Strategiekreislauf verfügt. Dies lässt den Schluss zu, dass die Hansestadt mit ihrem strategischen Personalmanagement gut für die Bewältigung der demografischen Herausforderungen aufgestellt ist. Dagegen wird beleuchtet, wie der Umgang mit dem Thema Personal in Berlin noch immer von chronischen Sparzwängen und einem Pluralismus der Akteure geprägt ist. Die daraus resultierende, hauptsächlich quantitativ agierende Personalwirtschaft und das Fehlen einer auch nur mittelfristigen Personalstrategie werfen erhebliche Bedenken bezüglich der zukünftigen Leistungsfähigkeit der Berliner Verwaltung auf.
In den vergangenen Jahren gewannen in der Personalwirtschaft Begriffe wie War for Talent und Fachkräftemangel immer mehr an Bedeutung. Unternehmen der Privatwirtschaft betreiben daher gezielt Personalmarketing - öffentliche Verwaltungen bisher kaum. Obwohl die Kombination aus einer überalterten Belegschaft, sinkenden Schulabsolventenzahlen und einem weitgehend unattraktiven Arbeitgeberimage insbesondere für öffentliche Verwaltungen die Gefahr eines eklatanten Mangels qualifizierter Nachwuchskräfte birgt. Die vorliegende Arbeit geht der Frage nach wie Personalmarketing in öffentlichen Verwaltungen bereits erfolgreich betrieben wird und welche Erfolgsfaktoren sich daraus für den Einsatz in anderen Verwaltungen ableiten lassen. Mit Hilfe der Analyse eines Best Practice-Ansatzes und auf der Basis der für die Privatwirtschaft bereits identifizierten Erfolgsfaktoren werden diese für den erfolgreichen Einsatz von Personalmarketing in der öffentlichen Verwaltung herausgearbeitet. Der Fokus des Praxisbeispiels liegt dabei auf der Rekrutierung von Nachwuchskräften für den mittleren und gehobenen allgemeinen nicht-technischen Verwaltungsdienst. Als Best Practice-Beispiel dient das Ausbildungsmarketing der Freien und Hansestadt Hamburg. Im Ergebnis decken sich die grundsätzlichen Erfolgsfaktoren mit denen der Privatwirtschaft. Dazu gehören u. a. das Vorhandensein eines strategischen Konzepts, die Formulierung klarer und messbarer Ziele sowie das systematische Überprüfen der Effektivität und Effizienz des Personalmarketing sowie einzelner Instrumente. Für öffentliche Verwaltungen ist es zudem besonders wichtig das Arbeitgeberimage zu verbessern. Dies sollte bei der Ansprache von Nachwuchskräften mit Hilfe moderner Medien, durch Einblicke in Verwaltungsaufgaben und die Einbindung von Eltern und Schulen geschehen.
