On the 20.01.1991 the Latvian people defended the Latvian political elite from the Soviet OMON troops in order to achieve independence. After this impressive sign of civil society the people fell asleep, the level of mobility and the satisfaction with the functioning of democracy therefore is rather weak. The referendum (2008), to gain the right to dissolve the Parliament by the people, initiated by the Trade Unions can be assessed as a sign that there is something on the move. This paper is trying to give an impression of the situation of the civil society in terms of participation in the decision- making process. Hereby the focus lays on NGOs: What is the legal base and which problems do they face. To learn more about the situation interviews were organized with representatives of NGOs from different sectors like community development; Social inclusion; advocating gender issues as well as environment and sustainable development. As a result of the research it can be said that the civil society made some steps forward but it is still struggling with a high level of corruption, lack of interested from the elite and the ordinary people and the insecure financial state.

Dieses Forschungspapier fasst die zentralen Ergebnisse entsprechenden Diplomarbeit zur Steuerverwaltung in Polen zusammen. Die zentrale Fragestellung lautet, wie sich diese spezifische öffentliche Verwaltungsstruktur im Zuge der Transformation und des Beitritts zur Europäischen Union entwickelt hat und inwiefern sie heute europäischen Standards entspricht. Da es der EU in dem Bereich an Kompetenzen mangelt, besteht kein einheitliches europäisches Modell der Steuerverwaltung, an dem die polnische zu messen wäre. Die Autorin nutzt das im Rahmen der Europäisierungsforschung entwickelte Konzept des Europäischen Verwaltungsraums, um die aktuelle Gestalt der polnischen Steuerverwaltung unter Berücksichtigung verbindlicher Vorgaben der EU und deren Aktivitäten im Beitrittsprozess analysieren zu können. Ob es eine spezifisch europäische Steuerverwaltung gibt, wird anhand von Daten der OECD mit einer Clusteranalyse ausgelotet werden. Schließlich wird Polens Verortung in den differenzierten Steuerverwaltungswelten ermittelt. Desweiteren analysiert die Autorin die Verbreitung des Common Assessment Frameworks in den Steuerverwaltungen in den Staaten Mittelosteuropas thematisiert. Eine eigene Umfrage bei den polnischen Finanzämtern bringt mehr Klarheit über die Nutzung des CAF in der polnischen Steuerverwaltung. Schließlich ermittelt die Autorin mittels eines semantischen Differentials das Image der polnischen Steuerverwaltung in Deutschland und vergleicht dieses mit dem Selbstbild der deutschen Steuerverwaltung. In einer Schlussbetrachtung werden die Ergebnisse der verschiedenen Untersuchungen zusammengeführt. Die Antwort der Autorin auf die aufgeworfene Frage nach dem europäischen Charakter der polnischen Steuerverwaltung ist verhalten optimistisch.

Fragestellung (Auszug): Die polnische Landwirtschaft wird im Hinblick auf ihre Rolle in der EU als nicht wettbewerbsfähig einge-schätzt und es scheint unumstritten, dass strukturelle Reformen unabdingbar sind. Ratschläge für die Ent-wicklung der polnischen Landwirtschaft gibt es viele. Unter anderem wird Polen die Besetzung von potentiellen Marktnischen empfohlen. Als Hoffnungsträger gilt dabei der ökologische Landbau, für den die extensive, traditionelle polnische Landwirtschaft eine optimale Voraussetzung darstellt. Neben einer EU-weit steigenden Nachfrage nach Bio-Lebensmitteln spricht für diese verstärkte Nischenbesetzung die Tatsache, dass die arbeitsintensive ökologische Wirtschaftsweise zumindest teilweise der zu erwartenden hohen Arbeitslosigkeit im Agrarsektor entgegen wirken kann. Damit würde der Biolandbau einen entscheidenden Beitrag für eine nachhaltige Regionalentwicklung leisten. Trotz positiver Entwicklungen in den letzten Jahren, verlief die Entwicklung des ökologischen Landbaus in Polen allerdings schleppend, und das Potential Polens scheint in diesem Bereich noch längst nicht ausgeschöpft. Diese Arbeit widmet sich der Frage, welche institutionellen Erklärungen es für diese Entwicklung gibt, verbunden mit der Hoffnung, institutionelle Faktoren ausfindig zu machen, welche die Entwicklung besonders positiv befördern oder andererseits abbremsen. Dabei werden ausgehend von einem institutionentheoretischen Hintergrund relevante formale und informelle Institutionen auf polnischer und EU-Ebene untersucht, sowie ver-schiedene Akteursgruppen, sowie deren Interaktion mit den institutionellen Entwicklungen beleuchtet.

Aus der Einleitung: Vor 15 Jahren hat Polen mit dem Transformationsprozess begonnen, der das Land von einer sozialistischen Planwirtschaft mit autoritärem Regime in einen modernen demokratischen Staat marktwirtschaftlicher Ausrichtung verwandelt hat. Seither genießt das polnische Volk nach vielen Jahren der Fremdherrschaft wieder seine eigene Souveränität. Mit dem Ende der sozialistischen Ära begann eine Phase umfangreicher und weit reichender institutioneller, wirtschaftlicher und sozialer Veränderungen. Diese gehen einher mit hoher Arbeitslosigkeit und starker Verunsicherung im Umgang mit den sich neu bildenden Strukturen, was eine große Belastung für die Bevölkerung darstellt. Den Herausforderungen zum Trotz haben es die Polen geschafft, in nur wenigen Jahren ein institutionelles und wirtschaftliches Niveau zu erreichen, das sich an dem Niveau westeuropäischer Staaten orientiert. Diese Leistung wurde u. a. durch die Europäische Kommission anerkannt, indem 1998 zunächst die Beitrittsverhandlungen mit Polen eröffnet wurden und das Land im Mai 2004 zur Europäischen Union (EU) beitrat. Während die alten Mitgliedsstaaten der Europäischen Union eine lang andauernde Phase wirtschaftlichen Abschwungs erleiden, findet im angrenzenden Polen ein rasanter wirtschaftlicher Aufholungsprozess statt. Wachstumsraten von 5 % und mehr sind hierbei keine Seltenheit. Diese Entwicklung wird von vielen Bürgern der alten EU Mitgliedssaaten in Zeiten steigender Arbeitslosigkeit und sinkender Löhne wahrgenommen und teilweise als Ursache der eigenen Misere identifiziert. Tatsache aber ist, dass sogar bei anhaltender Dynamik der polnischen Wirtschaft ein Erreichen des westeuropäischen Standards, wenn überhaupt, erst in mehreren Jahrzehnten als realistisch erscheint. Ebenso wie im wirtschaftlichen Bereich stellt sich die institutionelle Diskrepanz zwischen Polen und den Ländern der EU der 15 dar. Zu groß sind die Unterschiede, als dass sie in nur einem Jahrzehnt hätten nachgeholt und ausgeglichen werden könnten. Als zusätzlich Hindernis ist zu werten, dass sich in den letzten Jahren die Berichte der Europäischen Kommission, der Weltbank oder Transparency International mehren, Korruption in Polen bedrohe sämtliche Sphären des öffentlichen und privaten Lebens und die junge „alte“ Demokratie somit durch hausgemachte Probleme ins Strudeln geraten könnte. Innerhalb der Europäischen Kommission scheint man sich des Problems der Korruption in Polen bewusst zu sein und befürchtet diese in Form eines trojanischen Pferdes importiert zu bekommen (Vgl. Dehley 2002: 4). Andere Organisationen wie GRECO1 zeichnen ein düstereres Szenario, da sie der Korruption in Polen attestieren, die demokratischen Institutionen auszuhöhlen.

Aus der Einleitung Ziel der folgenden Studie ist es, die Entwicklung des öffentlichen Dienstrechts in Polen, der Slowakei und Estland vergleichend zu analysieren. Die Schaffung eines professionellen und entpolitisierten Staatsdienstes ist eine zentrale Voraussetzung für die Konsolidierung von Marktwirtschaft und Demokratie im Zuge der politischen und wirtschaftlichen Transformationsprozesse im postsozialistischen Mittel- und Osteuropa. Eine Verfestigung demokratischer Institutionen und Ver-fahren kann nur gelingen, wenn die Gesetzesausführung und die damit Beauftragten selbst demokratisch legitimiert und kontrolliert sind. Das Verwaltungshandeln sollte nicht nur sachlich-inhaltlich, sondern auch personell-institutionell an Gesetz und Recht gebunden sein. Daher müssen insbesondere Fragen des Dienstverhältnisses der Beamten gesetzlich geregelt und von willkürlichen Entscheidungen der jeweiligen politischen Führung unabhängig sein. In der Mehrzahl der mittel- und osteuropäischen Staaten sind mittlerweile entsprechende Gesetze in Kraft. Die unterschiedlichen Zeitpunkte der Verabschiedung (1995 in Estland, 1998 in Polen und 2001 in der Slowakei) machen aber deutlich, dass die Notwendigkeit eines entsprechend den oben genannten Kriterien konzipierten Staatsdienstes keinesfalls überall erkannt wurde. Die in der Literatur verbreitete Einschätzung, dass in allen mittel- und osteuropäischen Staaten noch beachtliche Diskrepanzen zwischen den immensen politischen Herausforderungen einerseits und den begrenzten Regierungskapazitäten andererseits bestehen, deuten darauf hin, dass die Umsetzung der Beamtengesetze weiter verbesserungswürdig ist.

Am 1. Mai 2004 trat die Tschechische Republik der Europäischen Union bei. Aufgrund der aus Sicht der EU unzureichenden Reformbestrebungen der tschechischen Regierung erfolgte der Beitritt zu einem Zeitpunkt als sich die öffentliche Verwaltung noch am Beginn ihrer Reform befand, was negative Auswirkungen auf die Fähigkeiten Tschechiens die aus der Mitgliedschaft erwachsenden Verpflichtungen zu erfüllen aber auch auf die Entscheidungs-findung auf EU-Ebene entfalten kann. Diese Diplomarbeit befasst sich mit dem Einfluss der europäischen Integration auf den öffentlichen Dienst am Beispiel der tschechischen Ministerialverwaltung. Dabei wird nicht nur der Umfang des Einflusses der EU untersucht, sondern auch auf Probleme wie Korruption, mangelnde Professionalität, Politisierung, etc. eingegangen. Ein besonderes Interesse gilt zudem der Analyse des im Jahr 2002 verabschiedeten aber bisher nicht implementierten Beamtengesetzes. Grundlage der Arbeit ist eine Literaturanalyse, die durch Gespräche mit Vertretern des tschechischen Regierungsamtes und des Innenministeriums, der Delegation der Europäischen Kommission in Prag sowie einigen Akademikern ergänzt wurde.

This study is analysing the transformation of Slovak administration in the telecommunication sector between 1989 and 2004. The dynamic telecom sector forms a good example for the transition problems of post-socialist administration with special regard to the regulation regime change. After describing briefly the role of the telecom sector within economy, the Slovak sectoral policy is analysed. The focus is layed on telecom legislation (including the regulation framework), liberalization of the telecom market and privatisation of the former state owned telecom operator. The transformation of the organizational structure of the "Slovak telecommunication administration" is analysed in particular at the level of the ministry and the regulating agency.

Der bemerkenswerte Transformationspfad der zentralstaatlichen Verwaltung in Estland von der Sowjetbürokratie hin zum mustergültigen EU-Beitrittsland wird anhand des Landwirtschaftsministeriums beschrieben. Für dieses Gebiet gibt es im Gegensatz zu den bekannteren und gut recherchierten Aspekten der Transformation wie Demokratisierung, Wirtschaftsumbau und Außenpolitik noch keine Fallstudie. Daher wird hier die Entwicklung der staatlichen Verwaltung im Zeitverlauf anhand des Wandels der estnischen Agrarpolitik und Landwirtschaftsverwaltung nachvollzogen. Am Ende werden Schlussfolgerungen formuliert und verdeutlicht, dass viele Erkenntnisse über das eigentliche Untersuchungsland hinausgehen und ebenso für andere Transformationsländer in MOE gelten.

Agricultural policy in the transition states of Central Eastern Europe is a very complex issue – ranging from privatisation of farm land, the establishment of agricultural markets to detailed questions of veterinary care, plant health and animal nutrition. Its main elements are the introduction of market liberalization, farm restructuring, privatisation, the reform of the sector and the creation of supporting market institutions and services.1 In this process central state agriculture administration plays a decisive role. This paper is summing up the research of the author on Slovak agricultural administration between 2002 and 2004. This work was part of a DFG-funded research project on “Genesis, Organization and Efficiency of the central-state Ministerial Administration in Central and Eastern Europe”. The project was analysing the processes, results and efficiency of administrative structures at central-state level in Estonia, Poland and Slovakia with reference to public administration in the policy fields of agriculture and telecommunications. The paper is reflecting the situation in the sector and its administration at the beginning of 2004. At first, an overview of the role of the agricultural sector in Slovak economy in the past and presence is provided (section I). Against this background, the development of the agricultural policy in the different periods since 1989 will be analysed, mainly what privatisation, accession to the EU and subsidy policy are concerned (section II). A detailed study of the developments in agricultural administration forms the next part of the paper (section III), i.e. the changes taking place in the ministry of agriculture and in the other institutions responsible for the implementation of agricultural policy. The role of interest groups in agriculture is briefly analysed (section IV). In the conclusions two different scenarios on the further development of Slovak agricultural administration will be deployed.

This article examines the multiple governments of independent Estonia since 1992 referring to their stability. Confronted with the immense problems of democratic transition, the multi-party governments of Estonia change comparatively often. Following the elections of March 2003 the ninth government since 1992 was formed. A detailed examination of government stability and the example of Estonia is accordingly warranted, given that the country is seen as the most successful Central Eastern European transition country in spite of its frequent changes of government. Furthermore, this article questions whether or not internal government stability can exist within a situation where the government changes frequently. What does stability of government mean and what are the varying multi-faceted depths of the term? Before analysing the term, it has to be clarified and defined. It is presumed that government stability is composed of multiple variables influencing one another. Data about the average tenure of a government is not very conclusive. Rather, the deeper political causes for governmental change need to be examined. Therefore, this article discusses the conceptual and theoretical basics of governmental stability first. Secondly, it discusses the Estonian situation in detail up to the elections of 2003, including a short review of the 9th government since independence. In the conclusion, the author explains whether or not the governments of Estonia are stable. In the appendix, the reader finds all election results and also a list of all previous ministers of Estonian governments (all data are as of July 2002).
