Global commons form a comparatively new part of international law, since the term appeared in international discussions and codifications only in the second half of the 20th century. The Common Heritage of Mankind is the corresponding legal principle that can establish an international regime to determine the legal status of non-sovereign territories and to allocate exploitation rights. Its main aim is to balance competing national claims by emphasising mankind’s common interest in the preservation and controlled exploitation of natural re-
sources. Against this background, the chapter sheds a critical light on attempts to transfer the institute of the Common Heritage of Mankind to the sphere of communication. Taking debates revolving around the New World Information and Communication Order in the framework of UNESCO since the late 1970s as a starting point, the author analyses the pitfalls and limits of attempts to establish governance structures for a global information order, including recent attempts to govern the internet.

Oftmals bescheinigt das Bundesverfassungsgericht den Fachgerichten objektive Willkür. Die vorliegende Untersuchung zeichnet die Herleitung dieses Topos aus Art. 3 Abs. 1 Grundgesetz nach. Die vom Bundesverfassungsgericht entschiedenen Urteilsverfassungsbeschwerden werden systematisiert und ausgewertet. Dabei wird deutlich, daß das Kriterium der objektiven Willkür in verschiedenen Bereichen recht unterschiedlich gehandhabt wird. Nach einem Abriß über das Verhältnis von Verfassungsgerichtsbarkeit und Fachgerichtsbarkeit setzt sich die Untersuchung mit den Zielen der Rechtsprechung zur objektiven Willkür auseinander. Der Dienst an der Gerechtigkeit wird durch ein gerechtes Verfahren, aus Sicht des Bundesverfassungsgerichts vor allem aber durch ein gerechtes Ergebnis im Einzelfall geleistet. Der Autor prüft nach, ob tatsächlich Defizite bestehen und ob das Bundesverfassungsgericht sie behebt.

In welcher Beziehung steht die praktische Philosophie zur Wirklichkeit der Menschenrechtsfragen in Recht und Politik? Wie kann und soll sie sich ihrem komplexen Gegenstand nähern? Inwieweit kommt ihr die Aufgabe zu, politisches Geschehen konkret zu kommentieren und Vorschläge für die Implementierung menschenrechtstheoretischer Annahmen zu machen? Wie lässt sie sich als anwendungsorientierte Disziplin denken, die jenseits reiner Begründungsdiskurse einen Beitrag zur globalen Stärkung der Menschenrechtsidee leistet?
Der vorliegende Sammelband geht diesen und verwandten Fragen in acht Beiträgen mit jeweils einem Kommentar nach und regt damit zum Nachdenken über das Selbstverständnis zeitgenössischer Menschenrechtsphilosophie an.
