Vorwort: Im vorliegenden Heft der Studien zu Grund- und Menschenrechten wird der Vortrag dokumentiert, den Prof. Dr. Georg Lohmann von der Ottovon- Guericke-Universität Magdeburg am 12. Mai 2004 im Rahmen der neu eingerichteten Reihe „Philosophie der Grund- und Menschenrechte“ an der Universität Potsdam gehalten hat. Die Veranstaltung bot Gelegenheit, die Frage zu erörtern, ob die unterschiedlichen Menschenrechte tatsächlich gleichgestellt sind oder doch eine Hierarchisierung von Menschenrechten stattfindet. Diese Diskussion soll in diesem Heft durch den Abdruck von drei Kommentaren zum Vortrag nachvollzogen werden. Inhalt: Die Menschenrechte: unteilbar und gleichgewichtig? Diese Studie will aufzeigen, welche Rolle der Achtung und Förderung der Menschenrechte in den Außenbeziehungen der Europäischen Union zukommt, und prüfen, welche Folgerungen daraus im innergemeinschaftlichen Bereich gezogen werden können. Dazu wird zunächst ein Überblick über die Entwicklung des Schutzes der Menschenrechte in den Außenbeziehungen, insbesondere im Rahmen der Entwicklungszusammenarbeit der Gemeinschaft gegeben. Daran schließt sich eine Darstellung der Rechtfertigung dieser Politik an. Die sodann vorzunehmende Würdigung ihrer heutigen Bedeutung schließt auch Fragen der Überwachung und Rechtsfolgen von Verstößen ein. Abschließend werden mögliche Rückwirkungen auf die innergemeinschaftliche Menschenrechtspolitik diskutiert.

Eine wertorientierte Rechtsordnung ist vor die Aufgabe gestellt, gegebenenfalls konfligierende Werte untereinander in Ausgleich zu bringen: Freiheit der Meinungsäußerung einerseits, das Verbot bestimmter Inhalte, um Ehre und Leben von Menschen zu schützen, andererseits. Der Aufsatz stellt den Umfang der Meinungsäußerungsfreiheit nach dem Internationalen Pakt über bürgerliche und politische Rechte dar und beschreibt die Möglichkeiten zulässiger Beschränkungen. Er geht weiterhin auf die Strafbarkeit der sogenannten Holocaustlüge in der Bundesrepublik Deutschland ein.

Heute wird selbstverständlich von einer aktiven Zivilgesellschaft als relevanter Akteurin des politischen Prozesses ausgegangen. Dies gilt für den innerstaatlichen Rahmen ebenso wie für die völkerrechtliche Ebene. Das Engagement zivilgesellschaftlicher Akteure im verfassungsrechtlich eingehegten Rahmen des politischen Prozesses ist mit Fragen verbunden, denen sich dieser Aufsatz nähern wird. Zunächst wird der Begriff der Zivilgesellschaft hergeleitet (I) und danach wird auf die Funktionen der Öffentlichkeit in einem rechtsstaatlich verfaßten republikanischen Gemeinwesen eingegangen (II), bevor zum Schluß aktuelle Themen, die sich in den letzten Jahren entwickelt haben, vorgestellt und als erste Forschungsfragen formuliert werden (III).
