Die Arbeit „Die Bekämpfung transnationaler Kriminalität im Kontext fragiler Staatlichkeit“ widmet sich dem Phänomen grenzüberschreitend tätiger Akteure der organisierten Kriminalität die den Umstand ausnutzen, dass einige international anerkannte Regierungen nur eine unzureichende Kontrolle über Teile ihres Staatsgebietes ausüben. Es wird untersucht, weshalb der durch die internationale Staatengemeinschaft geschaffene Rechtsrahmen, zur Bekämpfung transnationaler Kriminalitätsphänomene im Kontext dieser fragilen Staaten, nicht oder nur defizitär dazu beiträgt die Kriminalitätsphänomene zu bekämpfen.
Nachdem zunächst erörtert wird, was im Rahmen der Untersuchung unter dem Begriff der transnationalen Kriminalität verstanden wird, wird der internationale Rechtsrahmen zur Bekämpfung anhand von fünf beispielhaft ausgewählten transnationalen Kriminalitätsphänomenen beschrieben. Im darauffolgenden Hauptteil der Untersuchung wird der Frage nachgegangen, weshalb dieser durch die internationale Staatengemeinschaft geschaffene Rechtsrahmen, gerade in fragilen Staaten, kaum einen Beitrag dazu leistet solchen Kriminalitätsphänomenen effektiv zu begegnen. Dabei wird festgestellt, dass die Genese des internationalen Rechtsrahmens zu einem Legitimitätsdefizit desselbigen führt. Auch die mangelhafte Berücksichtigung der speziellen Lebensrealitäten, die in vielen fragilen Staaten vorzufinden sind, wirkt sich negativ auf die Durchsetzbarkeit des internationalen Rechtsrahmens aus. Es wird dargelegt, dass unterschiedlich hohe menschenrechtliche Schutzstandards zu Normenkollisionen bei der internationalen Zusammenarbeit der Staaten führen, insbesondere im Rahmen der internationalen Rechtshilfe. Da gerade fragile Staaten häufig durch eine defizitäre menschenrechtliche Situation gekennzeichnet sind, stellt dies konsolidierte Staaten im Rahmen der Zusammenarbeit mit fragilen Staaten öfters vor Herausforderungen. Schließlich wird aufgezeigt, dass auch die extraterritoriale Jurisdiktion und somit die strafrechtliche Verfolgung transnationaler Straftaten durch Drittstaaten mit rechtlichen und praktischen Problemen einhergeht.
In einem letzten Kapitel der Arbeit wird der Frage nachgegangen, ob nicht ein alternativer Strafverfolgungsmechanismus geschaffen werden sollte, um transnationale Kriminalitätsphänomene zu verfolgen, die aus fragilen Staaten heraus begangen werden und wie ein solch alternativer Strafverfolgungsmechanismus konkret ausgestaltet sein sollte.
Die Tötung Osama bin Ladens durch ein US-Sonderkommando Anfang Mai 2011, wenige Monate vor dem zehnten Jahrestag der verheerenden Terroranschläge vom 11. September, erhielt ein großes Maß an medialer Aufmerksamkeit. Der Tod des Mannes, der für die Terroranschläge verantwortlich gemacht wurde, führte zu einer erneuten Auseinandersetzung mit diesem Ereignis und dessen individuellen und globalen Folgen. Ausgangspunkt der Untersuchung dieses Pressediskurses ist die Annahme, dass eine solche gedankliche und sprachliche Auseinandersetzung, wie sie in der Presse kreiert und reflektiert wird, insbesondere auch von Metaphern bestimmt wird. Die Untersuchung stützt sich auf die Erkenntnisse kognitiver Metapherntheorien. Sie orientiert sich aber vor allem auch an jüngeren Untersuchungen innerhalb der Metaphernforschung, die speziell die sprachliche Dimension der Metapher wieder mehr in den Vordergrund rücken. Der Arbeit liegt daher ein multidimensionales Verständnis der Metapher zugrunde. Die kognitive Funktion der Metapher ermöglicht das Begreifbarmachen abstrakter bzw. unbekannter Phänomene. Metaphern können aber zugleich auch Indikatoren für die bewusste wie auch unbewusste Bewertung von Ereignissen, Handlungen und Personen sein. Die Untersuchung verfolgt einen vergleichenden Ansatz, der auf der Grundlage eines Arbeitskorpus aus US-amerikanischen und französischen Pressetexten zur Tötung bin Ladens den Metapherngebrauch in den beiden Ländern anhand ausgewählter Themenaspekte gegenüberstellt. Ziel der Untersuchung ist es, Gemeinsamkeiten und Unterschiede zwischen den beiden Landespressen zu identifizieren und diesbezüglich mögliche Interpretationen anzugeben. Dabei wird der Sprachgebrauch im Terror-Diskurs nach 9/11 einer kritischen Betrachtung unterzogen, um ein Bewusstsein für möglicherweise unbewusste metaphorische Konzeptualisierungen zu entwickeln. Im Vergleich des Metapherngebrauchs in der US-amerikanischen und französischen Presse werden deutliche Gemeinsamkeiten festgestellt. Die analysierten Unterschiede sind häufig sprachlich bedingt. Teilweise können sie aber auch im Hinblick auf Differenzen in der Positionierung der beiden Länder in Bezug auf bin Ladens Tötung interpretiert werden. Die weitgehende Übereinstimmung in den Metaphern lässt sich zum einen auf die Nähe der beiden Sprachen, zum anderen auf den ähnlichen politischen Hintergrund der beiden westlichen Länder zurückführen. Darüber hinaus wird die Hypothese aufgestellt, dass der verstärkt stattfindende internationale Austausch von Nachrichten, vor allem über Presseagenturen, auch zunehmend zu einer Globalisierung auf dem Gebiet der Metapher führt.
In den theoretischen Grundlagen moderner Verfassungsstaaten wird Angst als zentrale politische Größe ausgewiesen. In der Hobbesschen Ursprungsmythologie moderner Staatlichkeit spielt sie eine entscheidende Rolle für die Staatskonstituierung. Aufgrund ihrer Staatszentriertheit bietet die Vertragstheorie allerdings kein hinreichendes Erklärungspotential für die transnationale terroristische Strategie der Angst. Der Angstpolitik des Terrorismus steht aber auch eine Nutzbarmachung der Angst durch Regierungen bedrohter Staaten gegenüber.
Organized drug trafficking and transnationally networked terrorism are transnational threats in Latin America. Security experts see the first as the paramount problem, but regard the second as a mere potential security risk. Latin America’s specific conditions allow limited options for containing non-military threats. Should actors and instruments for containing crime and terrorism be organized on a subregional level, in the Latin American or in the Inter-American context? The author documents promising subregional approaches, especially in the extended Mercosur.
Since 9/11, the fight against the financial sources of terrorism has become a major arena for international co-operation. In the first part, the paper highlights the borderline between security studies and international political economy. The second part of the paper asks how successful the international community is in this fight. The authors show that the idea of seizing terrorist funds and denying access to the international financial system is not a very promising one. They conclude that, so far, results have been mixed and that only a political approach to the problem promises a solution.
Poverty, ethnicity and religious fundamentalism are the most pressing problems of the 21st century. According to this Indian author, democratisation on the national and international level is the only way to overcome these problems. One reason for the failing of the international institutions is the insufficient representation of the world community, especially in the UN Security Council. A reform of the United Nations seems indispensable. The war against international terrorism is essential but has to be waged without the differentiation between good and bad terrorists.
