Der Artikel untersucht, ob die Entscheidung einen Beitrag zur Weiterentwicklung des Klimaschutz- und Klimaanpassungsrechts auf Menschenrechtsebene leistet. Eine nähere Analyse der Entscheidungsgründe zeigt, dass sie weniger progressiv sind als teilweise angenommen. Dennoch stellt die Entscheidung einen Präzedenzfall dar, der angesichts der zunehmenden Bedeutung der Klimaanpassung, auch für nationale Gerichte und regionale Menschenrechtsgerichtshöfe wegweisend ist. N2 - The decision of the UN Human Rights Committee in the case of Billy et al. v Australia for the protection of the complainants from the consequences of climate change was celebrated as a significant victory. The Committee, however, only evaluated Australia's adaptation measures as insufficient. The article examines whether the decision contributes to the further development of climate protection and adaptation law on a human rights level. A closer analysis of the case demonstrates that findings by the Committee are less progressive than sometimes assumed. Nevertheless, the decision constitutes a precedent, which, given the increasing importance of climate adaptation, is also important for national courts and regional human rights courts.
