Dabei galt es nicht nur die Verflechtung der Banken untereinander, sondern auch die Verbindung zwischen den Staatsfinanzen und der Solvenz der nationalen Bankensysteme (dem sog. Risikoverbund zwischen Staat und Banken) zu durchbrechen. Der Beitrag beleuchtet die Entwicklung der Forderungen gegenüber Staaten in den Bankbilanzen der Euroländer und des Eurosystems im Zeitverlauf sowie den daraus erwachsenden Risiken für die Finanzstabilität. Hierzu werden die Determinanten des Risikoverbunds theoretisch wie empirisch analysiert. Die fiskalische Kapazität der Eurostaaten wird anhand verschiedener Faktoren wie der Verschuldungsquote, dem Leistungsbilanzsaldo und der Kredit-BIP Lücke aufgezeigt; anschließend werden die Strukturen der Bankensysteme im Euroraum untersucht. Im Einzelnen werden die private und staatliche Gesamtverschuldung, die konsolidierte Bankenbilanzsumme und die darin enthaltenen Verbindlichkeiten sowie der Anteil des Bankensektors an der Bruttowertschöpfung in Relation zur Wirtschaftsleistung betrachtet. Außerdem finden NPE-Bestände in den Bankbilanzen sowie die Renditen der emittierten Staatsanleihen und damit in Verbindung stehenden CDS-Spreads Betrachtung. Zusätzlich werden die Konzentration, der Verschuldungsgrad, Liquiditätsziffern sowie länderspezifische Unterschiede in Art und Fristigkeit der Refinanzierung der Bankensektoren abgebildet. Auf Basis der empirischen Befunde werden im Hinblick auf die wechselseitigen Ansteckungseffekte zwischen Banken und Staaten Implikationen für die Finanzmarktregulierung diskutiert. N2 - Limiting systemic risks is an essential part of the new international financial market regulation. The purpose was not only to break the interconnectedness of banks, but also to reduce the link between public finances and the solvency of national banking systems (the so-called sovereign-bank diabolic loop). This article examines the development of sovereign exposures in the bank balance sheets of the euro countries and the Eurosystem over time and the resulting risks to financial stability. To this end, the determinants of the risk network are analysed both theoretically and empirically. The fiscal capacity of the euro countries is checked on the basis of various factors such as the debt ratio, the current account balance and the credit-GDP gap; the structures of the banking systems in the euro area are then examined. Specifically, total private and public debt, the consolidated banking balance sheet total and the liabilities contained therein as well as the share of the banking sector in gross value added in relation to economic output are evaluated. NPE holdings in bank balance sheets as well as the yields on government bonds issued and the associated CDS spreads are also analysed. Moreover, concentration, leverage ratio, liquidity ratios and country-specific differences in the type and maturity of refinancing in the banking sectors are studied. Based on the empirical findings, implications for the financial market regulation are discussed with regard to the reciprocal contagion effects between banks and states. N2 - This article explores the importance of the port city of Hamburg in the evolving discourses on the creation of a maritime future, a vision which became influential in the 1930s, 1940s and 1950s. While some Jewish representatives in the city aimed at preserving and intertwining Hanseatic and Jewish traditions in order to secure a Jewish presence in the port city under the pressure of the Nazi regime and thereafter, others wanted to create new emigration opportunities, especially to Mandatory Palestine, and create a Jewish maritime future in Eretz Israel. Different Zionist organizations supported the newly evolving maritime ideas, such as the “conquest of the sea”, and promoted the image of a Jewish seafaring nation. Despite the difficulties in the 1940s, these concepts gained influence post-1945 and led to the foundation of the fishery kibbutz “Zerubavel” in Blankenese/Hamburg. However, the idea of a Hanseatic Jewish future also remained influential and illustrates how differently a “Jewish maritime future” was imagined and used to link past, present and future. Jahrhundert. Seine Lebensgeschichte als Sohn eines schlesischen Bauern zeugt von sozialem Aufstieg und einer eindrucksvollen Beamtenkarriere. Rother formte die Seehandlung zu einem Konglomerat von gewerblichen Unternehmen, die durch Bankengeschäfte, Chausseebauprogramme und das Engagement des Staates in der Wirtschaftsförderung leistungsstark gemacht werden sollten. Der Erfolg blieb allerdings unterschiedlich. In den 1840er Jahren stießen diese Bemühungen darüber hinaus auf Kritik von unternehmerischen Konkurrenten. His life story as the son of a Silesian farmer bears witness to social advancement and an impressive civil service career. Rother shaped the Seehandlung into a conglomerate of commercial enterprises, which were to be made powerful through banking transactions, road construction programs and the state's involvement in economic development. It met with only partial success. In the 1840s, moreover, these efforts met with criticism from entrepreneurial competitors. A social institution founded by Rother, the Berlin-based “Rother-Stiftung” for poor and unmarried daughters of civil servants and officers, claimed lasting significance. N2 - The article examines the architectural history of the building of the Preußische Seehandlung up to its demolition and new construction in 1901–1903 and then traces the changes of this building up to the present. In a second step, an attempt is made to locate the position of these buildings within their urban context. The third part reconstructs by examples the distinctive contribution of the Preußische Seehandlung to the Berlin museums and in particular to the Kunstkammer located in the Berlin Palace as well as to the Museum für Naturkunde. In this paper, we discuss their usefulness and success by analysing the challenges present-ed during NAP processes as well as the benefits this set of actions entails: The challenges for their implementation outweigh its actual benefits. Nevertheless, NAPs have great potential. Based on new research, we elaborate a set of recom-mendations for improving the design and imple-mentation of national action planning. In order to effectively bring NAP into practice, we consider it crucial to plan and analyse every state local circumstances in detail. The latter is important, since the implementation of a concrete set of actions is intended to directly transform and improve the local living conditions of the people. In a long-term perspective, we defend the benefit of NAP’s implementation for complying obliga-tions set up by HR treaties. N2 - Nationale Aktionspläne (NAP) werden seit der Wiener Erklärung von 1993, in der die Verbesse-rung und Förderung der Menschenrechte gefor-dert wird, weltweit zunehmend angenommen. In diesem Papier diskutieren wir ihren Nutzen und Erfolg, indem wir die Herausforderungen, die sich während der NAP-Prozesse ergeben, sowie die Vorteile, die dieses Maßnahmenpaket mit sich bringt, analysieren: Die Herausforderungen bei ihrer Umsetzung überwiegen die tatsächlichen Vorteile. Dennoch haben NAPs ein großes Poten-zial. Beruhend auf neueren Forschungen erarbei-ten wir eine Reihe von Empfehlungen zur Ver-besserung der Gestaltung und Umsetzung der nationalen Aktionsplanung. Um einen NAP effek-tiv in die Praxis umzusetzen, halten wir es für entscheidend, die lokalen Gegebenheiten jedes Staates im Detail zu planen und zu analysieren. Parallel hierzu hatte bereits der Einsturz des Rana Plaza, einem Fabrikgebäude in Dhaka, Bangladesch, das zahlreiche Zulieferfirmen der europäischen sowie u.s.-amerikanischen Bekleidungsindustrie beherbergte, traurige Berühmtheit erlangt. Beide Vorfälle hatten in den Industriestaaten des globalen Nordens eine nachhaltige Debatte darüber ausgelöst, welche Verantwortung inländischen Abnehmerunternehmen für die Einhaltung internationaler Menschenrechtsstandards entlang der global angelegten Lieferkette zukommt. An deren vorläufigem Ende steht eine Reihe von Spezialgesetzen, die heimischen Betrieben ausdifferenzierte Sorgfalts- und Überwachungspflichten bezüglich der Arbeitsbedingungen in den – häufig im globalen Süden gelegenen – Produktionsstätten auferlegen. Als Folge dieses geostrategischen Nord-Süd-Konfliktes wohnt in Deutschland erhobenen Menschenrechtsklagen im Regelfall ein grenzüberscheitendes Moment inne, weshalb sich die Rechtsverfolgung individuell Betroffener mit den Fragen des Internationalen Privatrechts nach der gerichtlichen Zuständigkeit sowie des anwendbaren Sachrechts konfrontiert sieht. Dass ein Verfahren bereits auf dieser Ebene scheitern kann, verdeutlicht auf paradigmatische Weise das eingangs erwähnte Verfahren gegen KiK vor dem LG Dortmund, in welchem das ungünstige pakistanische Verjährungsrecht zur Anwendung gelangte. Rechtspolitisch wird die Funktion des Rechtsgebietes indes unterschiedlich beurteilt. Während ein Ansatz gleichsam auf materieller Ebene die Entwicklung spezieller Sorgfaltsnormen für Unternehmen in Abnehmerstaaten verfolgt („Verantwortungslösung“), führt eine andere Auffassung den Kern der Problematik nicht auf das – oftmals durchaus funktionale – Produktionslandrecht, sondern vielmehr auf dessen strukturelle Durchsetzungsdefizite zurück („Kognitionslösung“). Der Beitrag vollzieht die Implikationen beider Ansätze für Zivilprozesse in Deutschland nach. Hierfür wird die Menschenrechtsklage zunächst in das deutsche Verfahrensrecht eingeordnet (I.) bevor die Rolle des Internationalen Privatrechtes erörtert werden kann (II.). Anschließend werden sowohl die Sorgfaltsregime in den Abnehmerstaaten (III.) als auch Rechtsbehelfe in den Produktionsländern am Beispiel Bangladeschs (IV.) in den Blick genommen. N2 - In the aftermath of several tragic accidents affecting the textile industry, predominantly located in the Global South – including, but by no means limited to the collapse of the Rana Plaza, a garment factory building in Dhaka (Bangladesh) – a wide-ranging debate had been sparked in the industrialised countries of the Global North regarding the responsibility of their customer companies to comply with international human rights standards along the global supply chain. The first tangible results of this discussion have been reflected in a multitude of special legislation imposing detailed human rights due diligence and monitoring obligations on domestic businesses [e.g. Modern Slavery Act (UK), loi de vigilance (France); Supply Chain Due Diligence Act (Germany); Proposed Directive on Corporate Sustainability Due Diligence (EU)]. As a consequence of the North-South divide depicted above, human rights lawsuits in Germany will usually involve a conflict of laws, raising the notorious questions of Private International Law (PIL) about applicable law and the jurisdiction of the court – A threshold not yet sufficiently addressed in the various new legal acts. Nevertheless, taking these PIL issues into account is crucial to the success of human rights litigation. This has recently become evident in the civil action against KiK Textilien und Non-Food GmbH (acronym for „customer is king”) concerning the devastating fire of a textile factory based in Karachi (Pakistan), whose main customer was the defendant German discount clothing chain. The regional court (Landgericht) dismissed the case because the choice of law rules deemed Pakistani law applicable, or more precisely its stricter statute of limitation. However, it is still controversial in German jurisprudence what function would be appropriate for PIL in the context of the greater legal policy of human rights compliance. The major view seems to be in favour – with the general trend – of establishing substantive due diligence obligations for domestic companies with extraterritorial effect („due diligence approach”). From this perspective, the PIL’s main objective would be to ensure or not to interfere with the effective implementation of these rules. In contrast, some legal scholars identify not so much substantive law but rather structural deficits of the respective judicial systems (e.g. corruption, perversion of justice, investment protection) as the real obstacle to human rights. Accordingly, the main task of PIL is to have the – in principle quite operational – foreign law enforced before the more effective courts in the Global North (“jurisdiction approach”). This article examines the implications of both approaches for civil actions in Germany. To this end, the phenotype of human rights litigation is first classified according to German civil procedural law (I.). Second, the appropriate role of PIL is discussed (II.). Finally, against this background, the due diligence legislation in the Global North (III.) as well as legal remedies in the Global South (IV.) are examined, taking Bangladesh as an example.
