N2  - In jüngerer Vergangenheit häuften sich Fälle, in denen die Verwaltung Entscheidungen von Verwaltungsgerichten bewusst nicht umsetzte. Der Autor nimmt diese Entwicklung zum Anlass und befasst sich mit der Frage, welchen Anteil die Vollstreckungsregeln der Verwaltungsgerichtsordnung an dieser Entwicklung haben. Dabei erfasst er sowohl die staatsrechtliche als auch die grundrechtliche Perspektive. Er überprüft insbesondere, ob die Vorschriften, die die Vollstreckung aus verwaltungsgerichtlichen Entscheidungen gegen den Staat regeln, verfassungsgemäß sind. Nach ausführlicher Diskussion denkbarer Lösungsansätze kommt der Autor zu dem Ergebnis, dass eine Änderung der Vollstreckungsvorschriften dringend geboten ist.
