September, erhielt ein großes Maß an medialer Aufmerksamkeit. Der Tod des Mannes, der für die Terroranschläge verantwortlich gemacht wurde, führte zu einer erneuten Auseinandersetzung mit diesem Ereignis und dessen individuellen und globalen Folgen. Ausgangspunkt der Untersuchung dieses Pressediskurses ist die Annahme, dass eine solche gedankliche und sprachliche Auseinandersetzung, wie sie in der Presse kreiert und reflektiert wird, insbesondere auch von Metaphern bestimmt wird. Die Untersuchung stützt sich auf die Erkenntnisse kognitiver Metapherntheorien. Sie orientiert sich aber vor allem auch an jüngeren Untersuchungen innerhalb der Metaphernforschung, die speziell die sprachliche Dimension der Metapher wieder mehr in den Vordergrund rücken. Der Arbeit liegt daher ein multidimensionales Verständnis der Metapher zugrunde. Die kognitive Funktion der Metapher ermöglicht das Begreifbarmachen abstrakter bzw. unbekannter Phänomene. Metaphern können aber zugleich auch Indikatoren für die bewusste wie auch unbewusste Bewertung von Ereignissen, Handlungen und Personen sein. Die Untersuchung verfolgt einen vergleichenden Ansatz, der auf der Grundlage eines Arbeitskorpus aus US-amerikanischen und französischen Pressetexten zur Tötung bin Ladens den Metapherngebrauch in den beiden Ländern anhand ausgewählter Themenaspekte gegenüberstellt. Ziel der Untersuchung ist es, Gemeinsamkeiten und Unterschiede zwischen den beiden Landespressen zu identifizieren und diesbezüglich mögliche Interpretationen anzugeben. Dabei wird der Sprachgebrauch im Terror-Diskurs nach 9/11 einer kritischen Betrachtung unterzogen, um ein Bewusstsein für möglicherweise unbewusste metaphorische Konzeptualisierungen zu entwickeln. Im Vergleich des Metapherngebrauchs in der US-amerikanischen und französischen Presse werden deutliche Gemeinsamkeiten festgestellt. Die analysierten Unterschiede sind häufig sprachlich bedingt. N2 - The killing of Osama bin Laden by a US special task force in early May 2011, only a few months before the tenth anniversary of the devastating terror attacks of September 11, received a great deal of media attention. The death of the man who had been made responsible for the terror attacks triggered a fresh discussion of the events of 9/11 and both the individual and global consequences thereof. The starting point for an analysis of the relevant press discourse lies in the assumption that such a discussion taking place in language and thought, as it is created and reflected by the press, is to a great extent also determined by metaphors. The analysis draws on the insights of cognitive metaphor theories. It is, however, also primarily influenced by recent studies within metaphor research that aim to bring the linguistic dimension of metaphors back to the forefront. Therefore, a multidimensional understanding of metaphors forms the basis of the present study. The cognitive function of metaphors allows us to grasp abstract or unknown phenomena. Yet metaphors may further serve as indicators of conscious as well as unconscious evaluations of events, acts and people. The analysis follows a comparative approach: A study corpus of US and French press texts on the subject of bin Laden’s killing is analyzed with regard to selected aspects of the topic in order to compare the use of metaphors in the two countries. The aim of the study is to identify similarities and differences in the two countries’ press coverage and give possible interpretations for the results obtained. At the same time, the language used in the post-9/11 terror discourse is subjected to a critical examination in order to provide an understanding of metaphorical conceptualizations that are possibly unknown. In the comparison of metaphor use by the US and the French press clear similarities can be observed. The dissimilarities are often due to differences between the two languages. In some cases, however, they may be interpreted as the result of differences in the positions of the two countries on the subject of bin Laden’s killing. The extensive consistency in metaphor usage can be attributed to the closeness of the two languages as well as to the comparable political background of the two Western countries. Furthermore, it is hypothesized that the growing international exchange of news, especially via press agencies, may increasingly also lead to globalization in the field of metaphor. While many scholars have made valuable contributions to mapping Al Qaeda, several problems remain due to a lack of data and the omission of data provided by international organizations such as the UN. Thus, this article applies a social network analysis and subsequent mappings of the data gleaned from the Security Council's consolidated sanctions list, and asks what they can demonstrate about the structure and organizational characteristics of Al Qaeda. The study maps the Al Qaeda network on a large scale using a newly compiled data set. The analysis reveals that the Al Qaeda network consists of several hundred individual and group nodes connecting almost all over the globe. Several major nodes are crucial for the network structure, while simultaneously many other nodes only weakly and foremost regionally connect to the network. The article concludes that the findings tie in well to the latest research pointing to local and simultaneously global elements of Al Qaeda, and that the new data is a valuable source for further analyses, potentially in combination with other data. With a particular focus on the United Nations Security Council, we first develop a theoretical account of why such informal constraints might affect collective decisions even of powerful and strategically behaving actors. We show that precedents provide focal points that allow adopting collective decisions in coordination situations despite diverging preferences. Reliance on previous cases creates tacitly evolving doctrine that may develop incrementally. Council decision-making is also likely to be facilitated by an institutional logic of escalation driven by institutional constraints following from the typically staged response to crisis situations. We explore the usefulness of our theoretical argument with evidence from the Council doctrine on terrorism that has evolved since 1985. The key decisions studied include the 1992 sanctions resolution against Libya and the 2001 Council response to the 9/11 attacks. We conclude that, even within intergovernmentally structured international organisations, member states do not operate on a clean slate, but in a highly institutionalised environment that shapes their opportunities for action. In a preliminary re-mark, I will reflect on some recent developments in Germany, where nativist protest campaigns against immigration took place in the streets when voters were turning towards the populist radical right party Alternative für Deutschland (AfD). In the first section, I will outline an older tradition of anti-immigration protest in nineteenth and early twentieth century Germany, which is closely connected to modern antisemitism. In sections two and three, I will retrace how, from the late 1960s onward, the far right in the Federal Republic of Germany (FRG) discovered concerns about immigra-tion in the German population, addressed them in protest campaigns and developed narratives to integrate such sentiments into a broader right-wing extremist ideology, itself deeply rooted in antisemitism. Studying nativism and the radical right from an actor-oriented perspective, I will focus on traditionalist movements, including the Nationaldemokratische Partei Deutschlands (NPD) and neo-Nazi groups. Im darauffolgenden Hauptteil der Untersuchung wird der Frage nachgegangen, weshalb dieser durch die internationale Staatengemeinschaft geschaffene Rechtsrahmen, gerade in fragilen Staaten, kaum einen Beitrag dazu leistet solchen Kriminalitätsphänomenen effektiv zu begegnen. Dabei wird festgestellt, dass die Genese des internationalen Rechtsrahmens zu einem Legitimitätsdefizit desselbigen führt. Auch die mangelhafte Berücksichtigung der speziellen Lebensrealitäten, die in vielen fragilen Staaten vorzufinden sind, wirkt sich negativ auf die Durchsetzbarkeit des internationalen Rechtsrahmens aus. Es wird dargelegt, dass unterschiedlich hohe menschenrechtliche Schutzstandards zu Normenkollisionen bei der internationalen Zusammenarbeit der Staaten führen, insbesondere im Rahmen der internationalen Rechtshilfe. Da gerade fragile Staaten häufig durch eine defizitäre menschenrechtliche Situation gekennzeichnet sind, stellt dies konsolidierte Staaten im Rahmen der Zusammenarbeit mit fragilen Staaten öfters vor Herausforderungen. Schließlich wird aufgezeigt, dass auch die extraterritoriale Jurisdiktion und somit die strafrechtliche Verfolgung transnationaler Straftaten durch Drittstaaten mit rechtlichen und praktischen Problemen einhergeht. N2 - The thesis "The fight against transnational crime in the context of fragile statehood" addresses the phenomenon of transnational organized crime actors who benefit from the fact that some internationally recognized governments exercise insufficient control over parts of their territory. It examines why the legal framework created by the international community to combat transnational crime phenomena in the context of these fragile states does not or only insufficiently contribute to combating the crime phenomena. After first defining what is meant by the term transnational crime in the context of this analysis, the international legal framework for combating transnational crime is described on the basis of five selected examples of transnational crime phenomena. The following chapter examines the question of why this legal framework created by the international community makes little contribution to effectively countering such criminal phenomena, especially in fragile states. It is determined that the genesis of the international legal framework leads to a legitimacy deficit of the same. Furthermore, the inadequate consideration of the specific circumstances found in many fragile states has a negative impact on the effectiveness of the international legal framework. It is then explained that different levels of human rights protection standards can lead to norm conflicts in international cooperation between states, particularly in the context of international legal assistance. Since fragile states are frequently characterized by a deficient human rights record, this can pose challenges for consolidated states in their cooperation with fragile states. It is also shown that extraterritorial jurisdiction and thus the criminal prosecution of transnational offenses by third countries is accompanied by legal and practical problems. Against this background, the final chapter of the thesis examines the question of whether an alternative criminal prosecution mechanism should not be created for the purpose of prosecuting transnational criminal phenomena committed out of fragile states and how such an alternative criminal prosecution mechanism could be organized.
