N2  - Diskriminierungsverbote gehören zu den Grundpfeilern des internationalen Menschenrechtsschutzes. Es gibt sie in unterschiedlichen Ausprägungen: Manche schützen nur vor einer Ungleichbehandlung bei der Inanspruchnahme eines Freiheitsrechts (sog. akzessorische Diskriminierungsverbote), andere schützen demgegenüber vor einer Ungleichbehandlung in sämtlichen Rechtskontexten. Ein allgemeines und umfassendes Diskriminierungsverbot, welches in allen Rechtskontexten gilt, findet sich in Artikel 1 des 12. Zusatzprotokoll zur EMRK. Dieses Zusatzprotokoll wurde von vielen europäischen Staaten - darunter auch Deutschland - bisher nicht ratifiziert. Der Beitrag möchte die menschenrechtlichen Potenziale und Mehrwerte dieses Zusatzprotokolls aufzeigen und nimmt dabei auch umfassend Bezug auf die Lernerfahrungen des UN-Zivilpakts, welcher mit Art. 26 UN-Zivilpakt eine strukturanaloge Regelung kennt.
N2  - Prohibitions of discrimination are among the cornerstones of international human rights law. They exist in different forms: Some only protect against unequal treatment in the enjoyment of a freedom rights (so-called accessory prohibitions of discrimination), while others protect against unequal treatment in all legal contexts. A general and comprehensive prohibition of discrimination, which applies in all legal contexts, can be found in Article 1 of the 12th Additional Protocol to the ECHR. This additional protocol has not yet been ratified by many European states, including Germany. This article aims to demonstrate the human rights potential and added value of this Additional Protocol and also makes extensive reference to the lessons learned from the UN Covenant on Civil and Political Rights, which has a structurally analogous provision in Article 26 of the Covenant.
